NOTICE OF LICENCE CONDITIONS

Issued in Accordance with the YOUTH AND COMMUNITY SERVICES ACT 1973

1 The Licence

1.1 The maximum number of persons who may at one time reside at the premises is xx, including staff sleepovers, accommodated in xx rooms.

1.2 The Licensee shall display, in a prominent place, the licence and conditions and an itemised schedule of all standard fees charged for services provided at the residential centre. Any notice varying any condition or requirement of the licence shall be displayed at the premises in such a way as to be readily available for inspection by any person seeking to make use of the services provided by the licensee.

1.3 The licensee and the licensed manager shall comply at all times with the Conditions, applicable to them, and to relevant legislation.

1.4 No person under the age of 18 years shall reside as a resident of the centre.

2.1 A building used for the purpose of conducting a residential centre for persons with disabilities shall comply with all Local Government Authority requirements.

2.1.1 The wall divisions between bedrooms must be an approved structure under local government requirements and be of a construction consistent with the primary structure of the premises.

2.1.2 Adequate provision shall be maintained in the licensed premises for the preventing and extinguishing of fire, and for the protecting and saving of life and property in case of fire.

2.2 The licensed premises, including the grounds, shall be maintained in a clean and satisfactory condition and free from vermin and insect pests.

2.3 The premises shall be adequately and safely fenced.

2.4 There shall be adequate protection from heating and electrical equipment. Such equipment shall be maintained in good repair and safe working order.

2.5 A separate, adequately equipped laundry shall be provided and no washing machine shall be operated in any other room. The floor of this laundry shall be constructed of impervious material.

2.6 A room, separate from leisure and recreation space shall be available for residents to receive guests in private. This room should be furnished in a comfortable manner.

2.7 A room convenient to bathing and toilet facilities shall be available for use as a sick or quiet room.

2.8 A room used for sleeping may not accommodate more than two persons.

2.9 A room used for the purpose of sleeping shall not in any case have a floor area of less than 7.5 square metres.

2.10 A room used for the purpose of sleeping shall not have less than 5.5 square metres of floor area for any person.

2.11 Sleeping accommodation occupied by any couple in a relationship shall be in a room separate from that occupied by any other person with a disability who is a resident.

2.12 The structure and buildings on the licensed premises and all fittings, furniture, furnishings and equipment shall be adequately maintained and kept in efficient working order.

In addition the premises of any residential centre for persons with disabilities and all furniture, fittings and other equipment contained therein shall be kept at all times in a clean and sanitary manner and in good repair.

3 Food Dining and Food Preparation Requirements

3.1 A dining room shall be provided which is sufficient in area to permit comfortable seating accommodation for all occupants.

3.2 Adequate and sufficient dining room furniture shall be available so that every person with a disability is provided with a separate chair at a table accommodating not more than eight persons.

3.3 Adequate provision shall be made for the storage and protection of food and for its preparation and serving. A kitchen shall not open into any room used for sleeping or toilet purposes and shall be fly-proof.

4 Record Keeping and Responsibilities of Licensee and Licensed Manager

4.1 The licensee shall maintain such records and forward such returns as the Chief Executive may from time to time require.

4.2 The licensee shall establish a procedure which is to be followed when a fire alarm is given.

4.3 Notice of death of a person with a disability in a residential centre for persons with disabilities shall be forwarded to the Chief Executive and shall be in or to the effect of the attached "NOTICE OF DEATH".

4.4 The licensee of licensed premises, or a person acting on his/her behalf shall, within one month prior to the licensee ceasing to control such premises, give notice in writing to the Chief Executive of such cessation.

5 Staffing Suitability

5.1 The staff shall be trained in the proper use of the fire fighting equipment.

6 Resident's Rights and Welfare

6.1 Where residents are required to use stairs to access any section of the premises, the licensee shall ensure mobility assistance to any resident who has an ambulatory impairment.
