MAHONING TOWNSHIP BOARD OF SUPERVISOR’S MEETING Monday, November 8, 2010

CALL TO ORDER: John Wieczorek called the meeting to order at 7:00 p.m. at the Mahoning Township Building, 2685 Mahoning Drive East, Lehighton, PA 18235

PLEDGE OF ALLEGIANCE: John Wieczorek led the Pledge of Allegiance.

ROLL CALL: PRESENT: John Wieczorek, Chairman; Travis Steigerwalt, Vice-Chairman; Franklin Ruch, Supervisor (arrived at 7:25 PM); George Stawnyczyj, Supervisor; Linda Benner, Supervisor; Thomas Nanovic, Solicitor and Natalie D. Haggerty, Secretary-Treasurer

APPROVAL OF MINUTES: MOTION Travis Steigerwalt made a motion to approve the minutes of the October 25, 2010 Board of Supervisors Meeting. Seconded by Linda Benner. John Wieczorek, yes; Travis Steigerwalt, yes; George Stawnyczyj, yes and Linda Benner, yes. 4-0 vote. Motion carried.

APPROVAL OF TREASURER’S REPORT: October 2010 MOTION John Wieczorek made a motion to approve the Treasurer’s Report for October 2010. Seconded by Travis Steigerwalt. John Wieczorek, yes; Travis Steigerwalt, yes; George Stawnyczyj, yes; and Linda Benner, yes. 4-0 vote. Motion carried

APPROVAL OF TRANSFERS: MOTION Linda Benner made a motion to approve the following transfers: $334.80 from Residential Fire Hydrant Money Market to General Checking $537.97 Residential Street Light Money Market to General Checking Seconded by Travis Steigerwalt. John Wieczorek, yes; Travis Steigerwalt, yes; George Stawnyczyj, yes and Linda Benner, yes. 4-0 vote. Motion carried.

APPROVAL OF REPORTS: MOTION John Wieczorek made a motion to approve the following reports: Mahoning Township Equipment and Fuel Log for October 2010 Mahoning Township Zoning Officers’ Report for October 2010 Mahoning Township Road Crew Daily Work Log for October 11, 2010-November 5, 2010 Mahoning Township Police Report for October 2010 Seconded by Linda Benner. John Wieczorek, yes; Travis Steigerwalt, yes; George Stawnyczyj, yes and Linda Benner. 4-0 vote. Motion carried.

OLD BUSINESS: DeAngelo Brother Contract for Spraying MOTION John Wieczorek made a motion to accept DeAngelo Brothers Contract for three years at a cost of $1,296.00 year for 2011 thru 2013. Seconded by George Stawnyczyj. John Wieczorek, yes; Travis Steigerwalt, yes; George Stawnyczyj, yes and Linda Benner. 4-0 vote. Motion carried.

Wind Turbines MOTION George Stawnyczyj made a motion to forward wind turbine zoning ordinance to the Carbon County and Mahoning Township Planning Commissions for review and comment. Seconded by John Wieczorek. John Wieczorek, yes; Travis Steigerwalt, yes; George Stawnyczyj, yes and Linda Benner. 4-0 vote. Motion carried.

Expansion of Non Conforming Structures MOTION Travis Steigerwalt made a motion to forward zoning amendment of expansion of non conforming structures to the Carbon County and Mahoning Township Planning Commissions for review and comment. Seconded by John Wieczorek. John Wieczorek, yes; Travis Steigerwalt, yes; George Stawnyczyj, yes and Linda Benner. 4-0 vote. Motion carried.

Ordinance 98-4 Hazardous Cost Clean Up MOTION John Wieczorek made a motion to accept as drafted Ordinance 98-4 Hazardous Cost Clean Up and forward to Mahoning Valley Vol. Fire Co #1 for review and comment. Seconded by Travis Steigerwalt. John Wieczorek, yes; Travis Steigerwalt, yes; George Stawnyczyj, yes and Linda Benner. 4-0 vote. Motion carried.

CDBG Program Forward to Tim Edinger, Engineer advised of eligible projects: Troxells Road, Beaver Street, Rex’s Bridge, ADA restrooms and energy saving projects, i.e.: doors windows, etc.

Advertise Budget Workshop MOTION George Stawnyczyj made a motion to advertise a budget workshop for November 15, 2010 at 6:30 PM. Seconded by John Wieczorek. John Wieczorek, yes; Travis Steigerwalt, yes; Franklin Ruch, yes; George Stawnyczyj, yes and Linda Benner. 5-0 vote. Motion carried.

Addendum to Traffic Light Maintenance Agreement between Borough of Lehighton and Mahoning Township MOTION Franklin Ruch made a motion to approve the addendum to Traffic Light Maintenance Agreement between the Borough of Lehighton and Mahoning Township. Seconded by George Stawnyczyj. John Wieczorek, yes; Travis Steigerwalt, yes; Franklin Ruch, yes; George Stawnyczyj, yes and Linda Benner. 5-0 vote. Motion carried.

Advertise public Notice (Notice of Intent to Appoint Kirk, Summa & Co., LLP Certified Public accountants to replace the elected township auditors for the 2011 year and to conduct the 2010 calendar year audit of the townships books and accounts) MOTION John Wieczorek made a motion to advertise public notice of intent to appoint Kirk, Summa & Co., LLP Certified Public Accountants to replace the elected township auditors for the 2011 year and to conduct the 2010 calendar year audit of the townships books and accounts. Act 44 Disclosures Forms for Entities Providing Services to the Mahoning Township Pension System Disclosure forms will be distributed to all supervisors, complete and return to office by December 17, 2010

OFFICIALS: George Stawnyczyj  Congratulations to Governor elect Corbett , Senator elect Toomey, and Representative to Congress Lou Barletta and State Representative Doyle Heffley. God Bless them for wanting to take on those thank less jobs. Franklin Ruch  Called DeAngelo Brothers they will spray anytime we want them to spray all we need to do is mark on the contract when we would like them to spray, just mark contract mid April to mid May, with that if any re- growth they will come out and re spray.  Barrier contract proposal will be emailed to me John Wieczorek  Will make calls to Tim Edinger  Short executive session at the conclusion of this meeting regarding legal matters Travis Steigerwalt  Information provided by Natalie of deadlines through out the year
