NOTICE OF PROPOSED RULEMAKING—NOTICE OF MODIFICATIONS TO TEXT OF PROPOSED AMENDMENT TO THE CALIFORNIA CODE OF REGULATIONS, TITLE 23. WATERS, DIVISION 3, CHAPTER 6, REVIEW BY STATE BOARD OF ACTION OR FAILURE TO ACT BY REGIONAL BOARD

On May 7, 2003, the Office of Administrative Law (OAL) issued a notice of disapproval of the above-referenced rulemaking. In accordance with the findings contained in OAL’s Decision Regarding Disapproval of a Rulemaking Action, OAL File No. 03-0325-02s, a revised draft of the proposed regulations has been prepared. Pursuant to the requirements of Government Code section 11346.8(c) and section 44 of Title 1 of the California Code of Regulations, the State Water Resources Control Board (SWRCB) is providing notice of changes made to the proposed regulations referenced above, sections 2050(a)(2), 2050(a)(9), 2050(b), 2050(c), 2050.5(d)(2), 2050.6(a), and 2064.

A draft is enclosed, illustrating changes to the proposed regulations in the following manner: regulation language previously proposed is underlined, while deletions previously proposed are shown in strikethrough; additions to the language previously proposed are double-underlined; and deletions from the language previously proposed are shown in double-strikethrough.

If you have any comments regarding the proposed changes, the SWRCB will accept written comments from the date indicated above through June 25, 2003. All written comments must be submitted to the SWRCB no later 5:00 p.m. on June 25, 2003, and addressed to: Marleigh Wood, Office of Chief Counsel, State Water Resources Control Board, P.O. Box 100, Sacramento, CA 95812-0100, telephone (916) 341-5169. The full text of the modifications to the proposed amendments to the regulations can be found on the State Board website at: www.swrcb.ca.gov.
