Subject :- Procedural requirement for obtaining Export Authorisation Registration of raw cotton (lint), cotton waste (including yarn waste and garneted stock), cotton, carded or combed, with the Textile Commissioner, Mumbai, prior to shipment in terms of Notification no.26 (RE-2008)/2004-2009 dated 22.07.2008 of Directorate General of Foreign Trade, Ministry of Commerce and Industry, issued under the Foreign Trade Policy 2004-2009.

A copy of Memorandum-I dated 26.07.2008 issued from F.No.1/162/2008/Cotton/169, by the Textile Commissioner, Government of India, Ministry of Textile Commissioner, Mumbai prescribing the terms and conditions for Export Authorisation Registration in respect of raw cotton/Cotton waste/cotton, carded or combed, is enclosed herewith for information, guidance and necessary action.

All the Trade Association/Chamber of Commerce and Members of Regional Advisory Committee and Custom House Agents’ Association are requested to publicise the contents of this Public Notice among their members/constituents, for their information and necessary action.

M E M O R A N D U M - I

Subject :- Procedural requirement for obtaining Export Authorisation Registration of raw cotton (lint), cotton waste (including yarn waste and garneted stock), cotton, carded or combed, with the Textile Commissioner, Mumbai, prior to shipment in terms of Notification no.26 (RE-2008)/2004-2009 dated 22.07.2008 of Directorate General of Foreign Trade, Ministry of Commerce and Industry, issued under the Foreign Trade Policy 2004-2009.

As per ITC Code No. 5201, 5202 and 5203 of Chapter 52 of the ITC (HS) Classification of Export & Import Items, 1st September, 2004-31st March, 2009 issued under the Foreign Trade(Development & Regulation) Act, 1992 (No. 22 of 1999) by the Directorate General of Foreign Trade, Government of India, New Delhi, raw cotton (lint), cotton waste (including yarn waste and gernetee stock), cotton carded or combed, can be exported only against valid Export Authorization Registration for shipment issued in this regard by the Textile Commissioner, Mumbai. The detailed guidelines for such Export Authorization Registration are issued hereunder accordingly. Every person/firm/unit/corporation/company desirous of exporting raw cotton (lint), waste (including yarn waste and garneted stock), cotton, and carded or combed is required to fulfil these terms and conditions. The application on plain paper for obtaining Export Authorization Registration, in the prescribed form as at Annexures-IA (Raw cotton – Lint), IB(cotton waste) & IC (cotton, carded or combed) * II, may be submitted in the Office of the Textile Commissioner, (Cotton Section, 3rd floor), Nishta Bhavan (New C.G.O. Bldg.), 48, Vithaldas Thakarsee Marg, Post Bag No. 11500, Mumbai – 400 020, on all working days upto 3.00 P.M.

2. Procedure for submission of application.

The applicant should submit the Export Authorization Registration Form (Annexures – IA, IB & IC & II as the case may be) alongwith the following documents.

Application in the form at Annexures – IA, IB & IC & II, as the case may be, of this Memo filed properly, as per detailed instructions contained in this Memo. On being satisfied that the information furnished in Annexures-IA, IB&IC &II, as the case may be, is duly completed in all respects, the Textile Commissioner or his authorized officers (Joint Textile Commissioner/Director/Deputy Director/Asstt. Director) shall issue Export Authorization Registration in prescribed form as at Annexure-II. The Export Authorization Registration (Annexure-II) duly signed with the Government seal will be issued to the applicant for submission to Customs authority prior to shipment.

(i) The Export Authorization Registration Application should be submitted within 30 days prior to the date of actual shipment. If the export is not effected within the stipulated 30 days, then the Export Authorization Registration issued would stand lapsed. The Export Authorization Registration issued would stand lapsed. The exporter shall have to get it re-validated before shipment again.

(ii) If due to some reason, the Export Contract is cancelled (by Importer / exporter) or export is not effected, the exporter shall inform the Textile Commissioner of such cancellation / non-exportation within 15 days from the date of cancellation.

(iii) If default is on the part of the exporter in fulfilling the export shipment for two times, then no further Export Authorization Registration Application will be entertained till such time the shipment details mentioned at Sr. No. 4 of Annexure-II are submitted.

(iv) After the actual export of full registered quantity, the exporter shall submit a legible exchange control copy of shipping bills as issued by the Customs alongwith the details of quantity of goods exported, its value and destination mentioned at Sr. No. 4 of Annexure-II.

(v) Maximum tolerance of +-5% is permissible in the total weight registered.
