DISCLOSURE OF INFORMATION OF HARICHANDANPUR TAHASIL U/S 4(1) (b) OF RTI ACT- 2005

4 (1) (b) (i) - The Tahasil office at Harichandanpur has been created vide Revenue and Disaster Management Notification No. 14913/R& DM /dt 29.03.08 it has come into operation from 23.04.08

The Tahasil area is Co- Terminus with the villages of Harichandanpur Panchayat Samiti, * 01 Village of Telkoi Panchayat Samiti. * 24 villages of Ghatagaon Panchayat Samiti

There are three Revenue Circles: - Harichandanpur with 82 Villages, Pandapada with 84 Villages and Bhagamunda 55 Villages.

The Tahasil is basic unit of Revenue Administration. The Tahasil looks to collection of Land Revenue, safe guards Government land through enactment of land related law, undertake relief work etc. But maintenance of Record of Right and updation of Village Maps is the primary duty of Tahasil.

2. POWER AND DUTIES OF THE OFFICERS AND THE EMPLOYEES

The Tahasildar is the over all in-charge of the Tahasil; which includes the Additional Tahasildar.

4 (1) (b) (ii) The ministerial staff of the offices i.e. the Head Clerk, Senior Clerk and Junior Clerk assist the Tahasildar in day to day Revenue Administration.

The Revenue Supervisor is a non- gazetted Tahasildar; assisting administration of fieldwork.

The Revenue Inspector is the lowest Revenue officer; he is the custodian of all Revenue Properties. He is in-charge of Revenue Collection and other miscellaneous work entrusted to him under various rules. //2//

3. Rules, Regulation, Instruction, Manual and Records held by it or under its comfort or used by its employees for discharging the functions.

1. Manual of Tahasil Account.

The rules of the manual prescribe the formatal guideline in which Tahasil and Revenue Circle register and records are to be maintained Rule 61-65 for remission of compulsory Basic Water Rate.

2. The Orissa Prevention of Land Encroachment Act. 1975

It is implemented to protect Government land from unauthorized occupation provides; provides rules for penalty and eviction.

3 The Orissa Public Demand Recovery Act. 1962

Large sum of Government Revenue pending with the defaulters is collected through certificate case against the defaulters through legal proceeding (Govt. Revenue- Land Revenue, Miscellaneous Revenue)

4. The Orissa Land Reforms Act. 1960 An Act. to reform the law relating to land tenures for conferring better right to the agriculturalists.

(i) Conversion of agricultural land to non- agricultural purpose under See 8 (A) of OLR Act: -

The section 8 a (i) of the act envisage that a Rayat is liable to be evicted if he uses the agricultural land and renders it unfil for agricultural use.

See 8 A of OLR is an enabling provision which allows conversion of agriculture land to non agricultural purpose subject to condition applied.

(ii) Partition of Land U/S 19(1) (C) of OLR Act, 1960

Partition of holding among co- share can be effected mutual consent under the provision of this section. (iii) Restriction of alienation of land by Scheduled Tribes U/S 22 of OLR Act. (iv) Restoration of property for transfer in contravention of Sec 22 of OLR Act. U/S 23 (A) of OLR Act. //3//

5. Orissa Regulation of 1956

Law envisages regulation to control and check transfer of immovable properties of scheduled tribe in the scheduled area of the state.

1. Orissa Government Land Settlement Act. 1962.

This Act. Regulates the Settlement of Government Land.

2. Orissa Minor Mineral Concession Rules, 2004

This Rules regulates the settlement of minor minerals.

8. Orissa Relief Code

Assessment of Crop loss for winter paddy and Ragi under section 28 of ORC.

9. Manual of Tahasil Accounts

Rules 61-65 for remission of basic water rate.

10. Orissa Miscellaneous Certificate Rules

(i) Identify certificate, Resident Certificate, Income Certificate, Solvency Certificate below one lakh, Legal heir certificate for withdrawal of pension, gratuity, arrears of the deceased as per Miscellaneous Certificate Rule, 1987 issued under the Rules

(ii) Caste Certificate as per Miscellaneous Rules, 1980.

(iii) SEBC and OBC Certificate as per Orissa State Commission for backward Classes Act, 1993.
