On joint motion of all Councilmen present, the following Ordinance was offered: SUMMARY NO. 23787 ORDINANCE NO. ______An ordinance to amend Chapter 20, Article V, Section 20-102(g) of the Code of Ordinances of Jefferson Parish, Louisiana, in order to revise exemptions, and to provide for other related matters. (Parishwide) THE JEFFERSON PARISH COUNCIL HEREBY ORDAINS: SECTION 1. That Chapter 20, Article V, Section 20-102(g) be amended to read as follows: Sec. 20-102 – Noise. (g) Exemptions. The following are exempt from sound level limits of Table 1: (1) Domestic power tools, lawn movers and agricultural equipment, when operated with a muffler, between the hours of 7:00 a.m. to 9:00 p.m. on weekdays and Saturdays and 8:00 a.m. to 9:00 p.m. on Sundays and holidays.

(2) Noises resulting from any authorized emergency vehicles when responding to an emergency.

(3) Noises made by persons having obtained a permit.

(4) Any noise resulting from activities of a temporary duration, for which a permit has been granted pursuant to this section, and which conforms to the conditions and limits stated thereon.

(5) Noises from church bells and chimes.

(6) Noises from temporary construction activity are exempt from Table 1, except that the industrial sound level limit shall apply in all land use categories and the restrictions for use of equipment in construction activity as stated in section 20-102(h)(6) shall be applicable as specified in that section.

(7) Collection of garbage, refuse, or recyclables by the parish and/or its contractors.

(8) Infrastructure construction, repair or maintenance by or on behalf of the Parish of Jefferson.

(9) Any noise resulting from the use of a generator(s) while there is a power outage in the area or resulting from routine testing or maintenance of the generator(s). SECTION 2. That all ordinances in conflict with the provisions of this proposed ordinance are hereby repealed. SECTION 3. That any and all sections found to be void or in conflict with other laws be repealed without the repealing of the entire ordinance. SECTION 4. That the Chairman of the Jefferson Parish Council, or in his absence, the Vice-Chairman, is authorized to sign and approve this ordinance to amend Chapter 20, Article V, Sections 20-102(g) of the Code of Ordinances of Jefferson Parish, Louisiana, in order to revise purchasing requirements, and to provide for other related matters. The foregoing ordinance having been submitted to a vote, the vote thereon was as follows: YEAS: NAYS: ABSENT: The ordinance was declared to be adopted on this ____ day of ______, 2013, and shall become effective as follows; if signed forthwith by the Parish President, ten (10) days after adoption, thereafter upon signature by the Parish President, or if not signed by the Parish President, upon expiration of the time for ordinances to be considered finally adopted without the signature of the Parish President, as provided in Section 2.07 of the Charter. If vetoed by the Parish President and subsequently approved by the Council, this ordinance shall become effective on the day of such approval.
