On June 14, 2017, at the Oxford Township Building, 780 Hanover Street, New Oxford, PA 17350, the Board of Supervisor's public meeting was called to order by Chairman Mario Iocco at 10:00am with the Pledge of Allegiance to the American Flag. The Quorum consists of Supervisors Mario Iocco, Jim Lafferty and Harry McKean. Sitting with the Board of Supervisors was Secretary Beverly Shriver.
Jim Lafferty second by Harry McKean motioned to approve the May 24, 2017 meeting minutes as written. 3 Aye Votes
Public Comments: Matt Janelli, District Representative of Recreation Resource USA; 425 McFarlan Road, Kennett Square, PA was present. Janelli saw our recreation proposal from 2008 and wanted to know the Township Recreation budget, status of the proposal and foot print of the park. Janelli could supply the Township a design fitting the Township budget and a 3D picture of equipment proposing in the future for the residents to look at, that helps drive it’s self. Janelli wants to help the Board of Supervisors achieve their goal for the park. The Board of Supervisors did not make a decision on how they are proceeding with the park but will keep Janelli’s information for future reference.
Motion on Tabled Fee Schedule: The Chairman asked for this to be tabled. Harry McKean second by Jim Lafferty motioned to table the Fee Schedule Ordinance. 3 Aye Votes
Motion on Per-Capita Taxes-The Brethren Home Personal Care Facility: The Board of Supervisors feel if the state says the residents of the personal care facility are eligible for the state rebate, then the personal care residents should be able to pay the $10. Adams County Assessment office feels they should pay the tax. The school district is not going after this tax; since they utilize The Brethren Home Community facilities. McKean second by Lafferty motioned to have Baranski write a letter stating the state regulations for the rebate and The Brethren Home Community should pay the $10 per capita tax for residents in the Personal Care Facility. 3 Aye Votes
Motion on Resolution 2017-13 Oposing the Elimination of the Community Development Block Grant Federal Program: This program was to be financed $54 billion dollars for the 2017-2018 Federal Budget. This service provides meals on wheels, blight demolition, public parks, public infrastructure, affordable housing, clean water programs and economic development. McKean second by Lafferty motioned to adopt Resolution 2017-13 Opposing the Elimination of the Community Development Block Grant Federal Program. 3 Aye Votes
McKean motioned to sign the updated PennDOT Traffic Signal Plan for the intersection of Route #30 and Route #94 second by Iocco. 3 Aye Votes
Solicitor’s Report: Oxford Heights, 5-Year Determination: Adams County Planning and Development has taken a stance this is an expired plan under the Municipality Planning Code; Baranski agrees. The property can no longer be built in accordance with the plan.
Property Acquisition at Red Hill Road: Baranski submitted the Letter of Intent to buy the property; waiting to hear from the property owner.
Cohen Law Group: Cohen responded; as a result of the audit, the Township is eligible to recover $4,836.17 in unpaid franchise fees. And the franchise fee payments to increase by $2,500 on an annual basis. The Township has to compose a findings letter to send to Comcast’s regulatory compliance department and also negotiate a settlement agreement. Baranski advises the Board of Supervisors to take action directing him to prepare and deliver that letter. The Board of Supervisors want Baranski to contact Cohen Law Group referencing their conclusion. Question what would be the best approach; who should handle it and conclusion takes all the other things into account.
Scozzaro’s Noise Exemption Hearing: The hearing decision deadline is July 30th.
Zoning & Code Enforcement Officer’s Report: The Board of Supervisors would like Ed Strevig to attend the Tuesday night meetings. If he has something specific to discuss with the Board; he can come to a workshop. It was reported there was one fine for tall grass, one property maintenance issue and one property line dispute.
Roadmaster’s Report: McKean reported there was a sinkhole repair done June 1st on Hanover Street.
PennDOT agreed to repair a guiderail damaged along Irishtown Road & Fish and Game Road. The repair will be done after the bridge rails are installed at Black Lane.
The Boss snow plow plates are revised and being shipped to us.
The road crew is busy doing base repairs on Brickyard Road.
McKean reported sitting at a bad intersection similar to Brickyard and Hanover St. There was a stop sign with a solar panel on the top to power the flashing lights on it. This might be something to look at and price out down the road. If this works, Iocco would like to see it on both sides of the road.
Secretary’s Report: EMS System is in Crisis: The Ambulance Association of PA is asking for our support in writing a letter to our State Representative and Senator for a medical assistance increase. Shriver typed their sample letter for the Township; McKean second by Lafferty motioned to sign the EMS System letters for an increase in funds. 3 Aye Votes
The Township received from the Community Aid $300 in $25 credit cards to spend at a Community Aid Store. Lafferty and Iocco said they will take $100 each and offer to their church to distribute.
Shriver contacted Nate Grove and Larry Feeser if they are interested in mowing the recreation park and what amount would they pay the Township; none have responded back. T. J. Smith offered $70 an acre. Harry McKean motioned to accept T. J. Smith’s offer of $70 an acre to mow the recreation park this year second by Jim Lafferty. 3 Aye Votes
The Township received a SAMS Club flyer; the Township could join and buy township supplies there.
CSX is performing maintenance on the rail road crossing in New Oxford Borough; June 19th to June 23rd on Route 30. The road will only be closed at the railroad crossing; traffic will be detoured.
CodeRED was bought and the new name is “OnSolve”.
There is a PSATS training, at PSATS on how to plan for a successful county convention June 29th 10:00am to 3:00pm. Bev Shriver would like to attend with Diane Groft from Mt. Pleasant. McKean second by Iocco motioned Shriver could attend the PSATS training, June 29th. 3 Aye Votes
Received email ARLE Funding Program is accepting applications from June 1st – June 30th.
Shriver typed a letter to be sent to the local businesses to support our Map project with New Oxford Borough.
Thursday, June 15th @ 1:00pm; Terry Myers along with Jeff Stough, Rick Groft and Mario Iocco will walk the streets in Oxford Glen to discuss what repairs need done before the Township would accept the offer of dedication.
Tom Beamer informed the office he has no intention on signing the Larry and Audrey Feeser Jr. Plan until Larry Feeser pays his invoice (connecting to the sewer). It’s a Township requirement for NOMA to sign plans going through Oxford Township’s Subdivision and Land Development process.
Vulcan Materials is renewing their NPDES Permit, Quarry Mining permit. Vulcan wants to increase the amount of stormwater discharge. Vulcan is the biggest contributor to the potential need for the Township to do MS4 requirements. Terry Myers will advise us at the next meeting.
Board of Supervisor’s List of Outstanding Issues:
Lafferty talked to Tom Beamer about the 63 fire hydrants; and it was discussed to pay $10 per hydrant per month. Lafferty wants to offer NOMA a package deal to take over the maintenance of the fire hydrants. Iocco and McKean are not in favor of offering a package deal; we will pay as we go. Black Lane Bridge project is at a standstill because another sinkhole was found. The company is waiting to hear from PennDOT (two weeks) how to proceed. No work has been done for two weeks and depending on what they are told, it could add a month to the project time line.
The Board of Supervisors received a plaque from the sponsored Orioles Baseball team.
McKean motioned to go into an executive session to discuss personal issues at 11:44am. The Chairman called the meeting into session at 12:05 pm.
McKean second by Lafferty motioned to authorize Shriver to draft an advertisement for a part-time Code Enforcement and Zoning Officer to approve at the next meeting. 3 Aye Votes
Shriver informed the Board of Supervisors there is a section in Chapter 11 Fences & Walls still in our codebook that was moved to Chapter 27 when the Township adopted Zoning. The Board of Supervisors directed Shriver to have Baranski prepare an ordinance deleting that section in Chapter 11.
Harry McKean motioned to adjourn the meeting second by Lafferty. 3 Yea Votes Meeting adjourned at 12:13pm.
