Minutes of 177th Meeting of Northern Regional Committee Held on January 27-29, 2010

The 177th meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from January 27-29, 2010 at Conference hall, NRC, NCTE, Jaipur.

In pursuance of the Gazette Notification No.213 dated 25.08.2010, NRC has been terminated under Section 21(2)(a) of NCTE Act, 1993 and the powers and duties on behalf of the Northern Regional Committee are being exercised and performed under Section 21(2)(b) by Shri Hasib Ahmad, former Member Secretary, NCTE. The following member and convenor were present:

The institution has appointed only 1 HOD and 4 lecturers, in addition to two lecturers of Fine Art/ Physical Education. The Principal appointed and shown in the list is that of B.P.Ed. course having a qualification in Physical Education. The minutes indicate selection of 1 Principal, 1 HOD, 4 lecturers + 2 lecturers of Fine Art/Physical Education. The minutes has been signed by the Principal and HOD also. How a candidate selected can be the member of the selection committee as well. The minutes, are therefore, not in order.

In view of above, clarification be sought from the institution on the above points within 30 days. 2. NRCAPP68 PRAMOD D.El.Ed. As per orders of the Hon’ble Court, MAHAVIDHYALAY the documents submitted by the MAHRARA institution were scrutinized afresh. MAHAMAYANAGAR, The following observations were VILL-MAHRARA POST- made: MAHARARA, DIST- MAHA MAYA NAGAR  The land documents are in order. U.P. However, a certified copy of the registered sale-deed, to be obtained from the Registrar, has not been submitted.  The FDR’s of Rs.5.00 lakhs and Rs.3.00 lakhs bearing No.465538 and 465539, which were returned on 07.05.2010 has not been deposited back.

Pending receipt of above two documents, a VT has been constituted for conducting inspection of the institution. Inspection be conducted immediately on receipt of the above two documents. Institution be asked to deposit the above documents immediately. 3. NRCAPP165 SRI RAM AVTAR D.El.ED In compliance to the order of the SINGH Hon’ble High Court of Allahabad dated 2 MINUTES OF 177th NRC MEETING HELD FROM JANUARY 27-29, 2010

The reply of the institution dated PUTREE DEGREE 16.08.2010 with reference to the COLLEGE, PATEL Show-cause notice dated 05.08.2010 NAGAR, NEW MANDI, was carefully considered and found DISTT.-MUZAFFAR satisfactory. NAGAR, UP Hence, NRC decided that the Institution be issued Letter of Intent Prior to Recognition under clause 7(9) of the NCTE Regulation, 2009 5. HP-299 THAKUR COLLEGE OF JBT The application of the institution for EDUCATION, grant of recognition for a JBT course DHALIARA TEHSIL- was considered in the light of the DEHRA, DISTT- orders of the Hon’ble High Court dated KANGRA, HIMACHAL 07.09.2010 and the following PRADESH observations were made:-  The land use certificate from the State Government of Himachal Pradesh vide their letter dated 07.06.2008 is conditional and was valid for 180 days from 07.06.2008. A proper revalidation certificate be submitted.  The institution submitted photocopy of the land document. However, it is not a certified copy of the land document issued by the Registrar/ Sub-Registrar. A certified copy be submitted.  In the inspection report of the institution dated 17.10.2008, it has been mentioned that the institution has only one existing B.Ed. course with an annual intake of 100 seats.

It is noted that the institution has an additional intake in B.Ed. course and has also been sanctioned B.P.Ed., M.Ed. and M.P.Ed courses. The circumstances in which the full information of the institution was not given to the inspection team be explained within 30 days from the date of issue of the letter. 3 MINUTES OF 177th NRC MEETING HELD FROM JANUARY 27-29, 2010

The contention PRADESH of the institution that variations in the land documents submitted by the institution initially and subsequently are essentially the typographical mistakes, has not been accepted by the NRC. The two land documents mention the name of the institution as SS college of Education in its Hindi version whereas the name written in English against this name in Hindi, varies in the two documents. In one document, photocopy of which is available with NRC, the English version has been written as SS College of Education whereas in the documents now submitted the English version has been mentioned as ESS ESS College of Education. The two photocopies bears the same serial no. i.e. A289243. In any case, if it was a case of typographical error, proper authenticated correction should have been carried out by the Registering Authority in the original document and its photocopy with proper certification should have been submitted by the institution to NRC. At present, the NRC is in possession of two sets of photocopies bearing same number eg. A289243 in one the name of the institution is written as S.S. College of Education and in another it is written as ESS ESS College of Education. The institution has failed to explain this discrepancy.

The submission in para 6 of the institution’s letter dated 20.01.2011 mentioning that Hon’ble High Court observed that it is a typographical mistake and has been rectified has not been properly understood as there is no such mention in the orders of the Hon’ble High Court. Moreover, this observation was made after scrutiny of the papers by NRC on December 24-26, 2010.

Hence, NRC decided that the application of the institution for D.El.Ed. course be refused under clause 14(3)(b) of NCTE Act 1993 4 MINUTES OF 177th NRC MEETING HELD FROM JANUARY 27-29, 2010

TEHSIL-SADAR, AGRA, UP NRC decided that VT be constituted to conduct inspection of the institution. 8. UP-2654 SWAMI VIVEKANAND B.Ed. In pursuance to the orders of the COLLEGE Hon’ble High Court, the photocopy of MUSTAFABAD, the file of the institution received from PANCHEND, KALA BYE NCTE, Hqrs., on 29.1.2011 has been PASS ROAD, scrutinized. The NRC in its 158th MUZAFFAR NAGAR, Meeting held on 19-22 April, 2010 U.P. decided to refuse recognition to the institution on the ground that the HOD and other three lecturers appointed by the institution were not qualified as per NCTE Norms. On the basis of the documents earlier submitted by the institution its contention that all of its teacher appointed were qualified as per NCTE norms was examined and following observations made:-

i) The HOD and three lecturers possessed the required qualification and experience, as per NCTE Norms.

Hence, NRC decided to issue Formal Recognition Order under Clause 7(11) of NCTE Regulation, 2009 and in terms of Section 14(3)(a) of NCTE Act, 1993 subject to the usual terms and conditions. 9. UP-3475 L.R INSTITUTE OF B.ED In pursuance to the orders of the EDUCATION, PLOT Hon’ble High Court of Allahabad dated NO- 198, VILLAGE- 11.10.2010 which was submitted by DAULA RAJPURA, the concerned institution to the NRC POST- SIKANDRABAD, on 06.01.2010, the entire matter TEHSIL- SADAR, related to the institution was DISTRICT- GAUTAM considered afresh. BUDHA NAGAR, UTTAR PRADESH. The copy of the CLU issued by SDM, Greater Noida, Gautam Buddha Nagar has been accepted. However, since the said order dated 19.04.2009 clearly directs that any construction activity on the said land shall be done with the prior approval of the Greater Noida Development Authority/ Competent Authority, the observations of the NRC, as endorsed by the Appellate Authority vide its order dated 11.09.2010 continues to be valid. The institution should have got its building plan approved from the Greater Noida Development Authority after the issue of CLU dt. 19.04.2009.

The Pradhan in its certificate dated 06.02.2009 has categorically mentioned that there is no need for approval of any other authority for constructing of the building in the said land as the Gram Panchayat has no objection on the construction. This certificate is contrary to the condition mentioned by SDM in the CLU issued by it on 19.04.2009.

As such, NRC decided that show cause Notice be issued to the Institution before refusing the recognition under section 14 (3) (b) of NCTE Act 1993 to produce all the relevant documents as mentioned above within 30 days of the issue of the Show-cause notice. 10. UR-135 SHAKUNTLA DEVI M.Ed. In pursuance of orders of Hon’ble High EDUCATION Court of Nanital dated 30.12.2010, INSTITUTE, PLOT NO. the application of the institution for 88, ADARSH HIHAR, the M.Ed. course was considered by KARGI ROAD, taking into account the option given DEHRADUN - -228001, by the institution for running the UTTARAKHAND M.Ed. course. The application of the institution submitted simultaneously for M.Ed. course will no longer be considered. The orders of the NRC dated 16.12.2010 on the basis of 171st Meeting held on October 28-29, 2010, therefore be set aside. Thereafter, the application of the institution for the M.Ed. course was considered and following observations made:-

 The building plan submitted by the institution is approved by a private architect and is not approved by any Civil Authority.

 Since the institution has submitted that it has already completed its building as per NCTE norms, a copy of the completion certificate in the prescribed form, giving details of the land and measurement of the 6 MINUTES OF 177th NRC MEETING HELD FROM JANUARY 27-29, 2010

Therefore, NRC decided that the institution be asked to submit the proper documents as mentioned above within 30 days of the issue of the clarification letter. 11. PB-479 SHAHEED UDHAM ETT Consequent upon the orders of the SINGH TEACHER Hon’ble High Court of Punjab and TRAINING Haryana dated 24.09.2010, the INSTITUTION, VPO- institution be asked to submit the MEHLAN CHOWK, requisite information about TEHSIL- SUNAM, appointment of the Principal/HOD to DISTRICT- SANGRUR, the ETT course for which the following PUNJAB. observations are made:-

 Smt. Asha Arora, Sr. Lecturer of their B.Ed. college has been appointed as HOD of Elementary Teacher training institution. A perusal of the bio-data of Smt. Arora reveals that she has no teaching experience in the primary/elementary teacher training institution. Since, five years of such experience is essential, she is not eligible for appointment as HOD as per NCTE norms.

 Since, a Sr. lecturer of the B.Ed. college has been appointed as HOD in the ETT course. The institution has not given any details about appointment of a lecturer against the consequential vacancy of Smt. Arora.

Hence, NRC decided that a Show- cause notice be issued to the institution under section 17 of NCTE Act 1993 for a reply within 30 days. 12. UP-3001 SMT. GENDA DEVI M.Ed. The institution be asked to provide full MAHAVIDYALAYA, details about selection and ALLIPUR BARWARA, appointment of faculty including the POST. SIRAWALI, approval of the university for the KASGANJ, ETAH- UP appointments made. Following details may be submitted in this regard:-  A copy of the advertisement 7 MINUTES OF 177th NRC MEETING HELD FROM JANUARY 27-29, 2010

HR-1156 SHRI KRISHNA D.ED. The institution was given permission COLLEGE OF to run a D.Ed. course and formal EDUCATION, KARNAL, recognition order under clause 7(11) KARNAL- HARYANA of the Regulations 2007 were issued on 20.08.2008. The approval was from academic session 2008-2009. One of the conditions of approval of the course to the institution was that it would convert the Endowment fund and Reserve fund into joint account to be operated with an officer of NRC within one month of the receipt of the recognition order. The institution failed to do so and thus, violated one of the conditions of grant of permission. Similar is the situation in case of B.Ed course, where FDR’s in joint account has not been submitted. 2) It is also noted that the institution was given a letter of conditional recognition on 19th September 2006. The institution did not submit the compliance of the ten (10) conditions mention in Para four (4) of said letter. 3)The institution submitted a lease deed dated 17.02.2007 whereby a piece of land having 25 rooms etc. was taken on 30 years lease in the name of one Mr. Ishwar Singh. However, the said lease deed is not registered. The institution is not yet having a valid land tenancy for 30 years. The request of the institution for shifting of its D.Ed. course students of the academic session 2010-2011 to some other institution has been done in total contravention of the NCTE Act and Regulations as there is no such provision in the said Act and Regulations. Since the B.Ed course is also on the same land this discrepancy is valid for B.Ed course as well as and is continuing. 4) The institution is thus running the B.Ed. course in the same campus in violation of the NCTE norms, in view of above. As such, a Show Cause Notice under section 17 of the NCTE Act, 1993 be issued to the institution for withdrawal of its D.Ed. and B.Ed. course, in view of above violations. 14. HR-1727 DR. RAGHBIR SINGH D.ED. The college was issued Letter of intent COLLEGE OF prior to recognition u/s 7(9) of NCTE EDUCATION, KARNAL- Regulations 2009 in favour of Dr. 132001, HARYANA Raghbir Singh College of Education, Teh. Karnal, Haryana on 18.10.2010, consequent upon the orders of the Appellate Authority dated 27.09.2010.

2) The reply of the institution dated 20.10.2010 giving details of the faculty appointment etc. were considered by the NRC in its meeting held on 21-22.10.2010 and the institution was issued a Show-cause notice as the following discrepancies were noted in the appointment of the faculty made by the institution:-

 The institution failed to provide supporting documents to establish that it followed due process of selection of the faculty.  The selection committee comprised of three representatives of the management only, whereas the two experts nominated in the selection committee were not from the discipline of elementary /primary teacher education.  The Principal appointed by the institution namely Mrs. Devender Lamba did not possess the prescribed qualification as per NCTE norms. Moreover, Mrs. Lamba has crossed the age of 62 years and is not eligible for appointment as Principal.  The Show-cause notice under section 14(3)(b) was issued on 03.11.2010 for a reply within 30 days of the issue of the letter.

3) The reply of the institution dated 27.10.2010 to the Show- cause notice was on the basis of minutes and was carefully considered by the NRC in its 172nd

The institution was asked to further clarify its position on the following:-  The institution claimed that it made the appointment of the faculty prior to issue of letter of intent prior to recognition u/s 7(9) of NCTE Regulations 2009 and issued advertisement in News Line and Kalam Yug in June 2010 and October 2010 respectively. However, since the photocopies of the advertisements submitted was not convincing as to whether the advertisement were actually published in the newspapers, the institution was asked to submit the photocopies of the advertisement in a manner that could establish that the advertisement was actually published.  The minutes of the selection committee were not properly drawn as it did not indicate the no. of applicants who appeared for the interview and no list of such applicants duly signed by the candidates was submitted.

4) The institution was asked to clarify its position on the reply to the Show- cause notice with all necessary documents within 21 days and a letter to this effect was issued to the institution on 19.11.2010 through speed post. The letter was addressed to the Principal Dr. Raghubir College of Education, Jundla, Haryana. This letter has been returned by the postal authority with a remark on the envelope from that in village Jundla, there is no school with the above said name. The return of the letter that could not be delivered on the said address caused serious apprehensions and needed to be seen in the light of the observations of the visiting team initially that the society is running a Pratap Public School at Village Jundla, Karnal and the building of this school is being extended and it is in the extended part “where the D.Ed. course is proposed.”

5) The NRC, therefore, felt at loss as 10 MINUTES OF 177th NRC MEETING HELD FROM JANUARY 27-29, 2010

The website of the institution was therefore perused and it was noted that it does not provide any details about the location of the institution. It does not give a building map or photographs of the building indicating its location in the website. Although, the institution was asked to launch its own website covering inter- alia the details of the institution, its location, name of the course applied for with intake availability of physical infrastructure, land building classrooms etc.

6) However, the reply of the institution dated 30.11.2010 and 13.01.2011, which were based on the minutes of the 172nd Meeting of held from November 12-13, 2010 have been carefully considered by the NRC and following observations are made:-

 The photocopy of the advertisement in Kalam Yug and News Line now submitted continues to suffer from the same deficiency and the photocopy fails to establish that the advertisements were actually published in the newspaper. The institution should have provided the copies of the newspaper, in case they were genuine and were interested to establish beyond doubt that they published the advertisement.  The institution could not provide the number of applications which were received in response to the said advertisement and vaguely replied that sufficient no. of applications were received and “suitable candidates were called for interview”. The institution could have at least given the signed list of candidates who appeared for the interview but they failed to do so.  The institution has vaguely claimed that more than 80 applications were received for interview, out of which 8 faculty members including Principal on contract basis were selected by 11 MINUTES OF 177th NRC MEETING HELD FROM JANUARY 27-29, 2010

It is not understood, as to how the applicants will respond when one of the letter of NRC on the same address through speed post has been returned with the remark of the postal authorities about non-existence of such an institution in Village Jundla, Karnal.  The college authorities have as identified one Mr. Shankar Narayan of Bokaro Steel City, Jharkhand, who is working in Chetana Primary Teacher Training Institute, Puruliaya, West Bengal. An unsigned photocopy of the curriculum vitae of Shri Shankar Narayan has been enclosed with the letter dated 13.01.2011. The institution has not yet conducted any selection committee and has not even appointed Shri Shankar Narayan as the Principal of the college. The website of the institution continues to show Smt. Devender Lamba as Principal of the college who is not eligible for appointment of Principal and whose appointment has already been disallowed by NRC

In view of above, NRC came to the following conclusion:-

 The appointments of the faculty made by the institution prior to issue of Letter of intent under clause 7(9) of NCTE Regulations 2009 has not been found in order. It had been made without following the due process of selection and the institution could not come out fairly to establish its claim that they did issue the advertisement, held the meeting of the selection committee and conducted proper interviews before making selection of the faculty. 12 MINUTES OF 177th NRC MEETING HELD FROM JANUARY 27-29, 2010

The existence of a separate building for the D.Ed. course with the name Dr. Raghbir Singh College of Education needs to be verified afresh by NRC.

Hence, NRC decided to constitute a inspection team to verify the facts about the existence of the college building in the light of the remarks of the postal authorities that no such school exist in the Village Jundla. This is essential before the institution could complete its process of selection of Principal/faculty in response to the advertisement given by it now in Tribune dated 10.01.2011 and submit the same to NRC. 15. CH-29 INSTITUTE OF B.A. Hons. The letter of the Registrar, Punjab EDUCATIONAL (Edu.), University, Chandigarh received in the TECHNOLOGY AND B.Ed. office on 25.05.2010 has been VOCATIONAL Innovative considered in view of the opinion of COURSES, PUNJAB course Legal Counsel of the NCTE that UNIVERSITY, appropriate steps need to be taken on CHANDIGARH the application of the University while the review application of the NCTE is pending before the Hon’ble High Court. The following observations are made on the basis of scrutiny of various documents submitted by the Registrar of the University:-  The University needs to develop an Information and Communication Technology (ICT) resource centre in accordance with the recommendations made by the NCTE in its Manual on organizing teaching learning resources in teacher education institution published by NCTE in 2009. The present arrangement made by the University is to share the facility of language lab in the Arts Block, for the proposed B.A. honors (Education) B.Ed. course. While there is no harm to do so but the course itself needs to have a departmental library. The Registrar’s letter admits that they have a departmental library but it has not given any details about the dimension of the departmental library, availability of number of books in the library and the number of titles on education in this library, including seating capacity.  The University proposes to utilize the facility of University auditorium but this facility is in no way, a substitute to the requirement of Multipurpose Hall of adequate size, available exclusively for the B.A. B.Ed. course. The Registrar did mention the availability of one multipurpose room but in the absence of its dimensions and its furnishing, the reply cannot be accepted. Since the institution propose an intake capacity of 100 seats for the course, the department needs to have a multipurpose hall of adequate size to accommodate the course students. As such, the requirement of the multipurpose hall of appropriate size is essential.

The University may be asked to develop the above facilities and submit its details with documentary evidences about the facilities created within 30 days, before further action is taken for the recognition of the course 16. RJ-1645 SIDDHARTH S.T.C The institution applied for two-year COLLEGE OF STC course in December 2007. The EDUCATION, institution was proposed to be started BILWA, TONK ROAD, at Plot No.1, Mohana Road, Opposite SANGANER, JAIPUR- VT road, Mansarovar, Jaipur. 3) A deficiency letter was issued on 11.03.2008, asking for a copy of the approved building plan in addition to other relevant documents. In response the institution submitted building plan of the proposed college at Bilwa Tehsil, Tonk Road, Sanganner, Jaipur. The building plan has again no mention of the name of the college i.e. Siddharth College of Education and was not approved by the competent authority and is only signed by the Secretary, Managing Society.

4) The proposed building was a seven storey building to be constructed at the said premises which was submitted to the Jaipur Development Authority for approval. Nowhere in the building plan, the institution mentioned the purpose of the seven storey building. At no place, there was any mention of the Siddharth College of Education in these maps. Similarly, nowhere there is any mention of any area earmarked for Siddharth College of Education. No approved building plan whatsoever was submitted by the institution. However, the inspection of the institution was got conducted on 19.05.2008. In the report, the name of the college has been mentioned as Siddharth College of Education Plot No.1, Mohana Road, Opposite VT road, Mansarovar, Jaipur. The inspection was conducted in this premise and in the inspection report under the column of existing course, an entry of not applicable has been made, although, the institution was already running a B.Ed. course. 5) After due consideration of the inspection report and relevant facts, a Show-cause notice was issued to the institution under section 14(3)(b) of the NCTE Act, 1993 for refusing recognition of the course due to lack of built up area, small size of hall, non-availability of demarcated map etc.

6) In response to the Show-cause notice, the institution sent a reply on 18.09.2008, wherein a map was submitted to show that the built up area available to the institution is 1680 sq.mt. Again this document was not approved by any civil authority but was only signed by the Secretary of the Society. No earmarking for the STC course and for the B.Ed. course was indicated and the institution again concealed the fact and did not reply to the question whether they were running a B.Ed. course in the premises as mentioned in the Show- cause notice.

7) Subsequent to the above Show- cause notice, a letter dated 26.09.2008 was also received wherein the institution mentioned that they are going to shift the premises to a newly constructed building at 655, Tonk Road, Bilwa, Sanganner, Jaipur, wherein a total land area of 12124 sq.mts. was available. The land documents with this letter were of the land allotted by the JDA and were already available on file. This letter included a building map of a seven storey building under the project “proposed college at Khasra No.655, Tonk Road, Bilwa, Sanganner, Jaipur”.

8) However, before a decision could be taken by the NRC on the basis of various documents submitted by the institution about recognition of the 16 MINUTES OF 177th NRC MEETING HELD FROM JANUARY 27-29, 2010

9) The application of the institution has been considered afresh in the light of the directions of the Hon’ble High Court and in continuation to the Show-cause notice issued to the institution on 18.09.2008, so as to decide the case independently on merit. The following observations in this regard are made after careful consideration of the various documents submitted by the institution after the issue of Show- cause notice on 18.09.2008 :-  The institution applied for STC course and an inspection for the purpose was made by the NRC in its premises at Siddharth College of Education Plot No.1, Mohana Road, Opposite VT Road, Mansarovar, Jaipur.  The Show-cause notice was issued to the institution before refusal for recognition of the said course to which institution responded with various documents. These documents relate to their campus at Khasra No.655, Tonk Road, Bilwa, Sanganner, Jaipur. Since, no inspection whatsoever was conducted on this premises, the institution is not eligible for recognition of a STC course in this building.  The building plan submitted by the institution for the proposed STC course in their campus at Khasra No.655, Tonk Road, Bilwa, Sanganner, Jaipur did not give any approved building plan for the proposed Siddharth College of Education. It is evident that institution got inspection conducted at Plot No.1, Mohana Road, Opposite VT Road, Mansarovar, Jaipur for both B.Ed. course and STC course at different point of time without indicating that they were running a B.Ed. course at the time of inspection of STC course.  The 12124 sq.mts. land allotted by JDA was to the Shri Birbal Medical Society for certain specified courses. While submitting the allotment letter of this land, the society nowhere mentioned as to what are the courses being run by the society at this premises and in the seven storey building approved by the JDA on this premises. The assertion by the society that the land and building is on the ownership of the society to run the newly proposed STC course cannot be accepted as apparently neither the total land nor the building constructed thereon is for the STC course. As such, the institution is not even entitled for an inspection in its new premises.  The lease deed documents has a clear clause that any building constructed on this piece of land will have to have a prior approval of the JDA. Since, the society has not constructed any building in the name of Siddharth College of Education in this premises their application for STC course in a composite building for various other courses in addition to STC courses would not be in 18 MINUTES OF 177th NRC MEETING HELD FROM JANUARY 27-29, 2010

In view of above, NRC decided to refuse the recognition of the institution for the STC course. However, since the earlier Show- cause notice given to the institution dates back to 18.09.2008 and a considerable time has passed since then, a fresh Show-cause notice be issued to the institution before said refusal on the above grounds. The reply of the institution be submitted within 30 days 17. HR-1739 MAHENDRA COLLEGE B.ED. The application of the institution dated OF EDUCATION, 03.01.2011 was consequent upon the MAJRA ROAD, VILL- issue of the letter dated 04.12.2010 MAJRA KHURD, POST- by RD, NRC for giving fresh MAHENDER GARH, application in accordance with the TEHSIL/DISTRICT- orders of Hon’ble High Court of Punjab MAHENDER GARH, and Haryana dated 29.07.2010. The HARYANA. institution in its application reiterated its earlier documents which it felt meet the requirement of the fresh application and established that they had met the deficiencies pointed out in NRC’s earlier letter. The documents have been scrutinized afresh and following observations made:-  The initial building plan submitted by the institution with its application for B.Ed. course was not approved by any competent civil authority. The map submitted for B.Ed. course was the same which was submitted in a separate application for JBT course (File No. HR-1597). Although, the two maps are essentially the same, the one submitted for the B.Ed. course has been tampered with, to indicate the construction in the ground floor as 9252 sq.ft. instead of 7252. Similarly, the area of the first floor has been tampered with, to indicate it as 9050 sq.ft. instead of 405 sq.ft. Thus, the total area which is only 7657 sq.ft has been tampered to make it 1650 sq.mts.  The new building plan submitted with the approval of Sub- Divisional Engineer, P.W.D.

The application for the B.Ed. course does not even give the date of submission of application.

2) As per clause 8(2) of NCTE Regulations 2009, an institution is eligible for one basic unit at one time. As such, an institution is not even eligible to apply for B.Ed. course when it had already applied for JBT course. The application for B.Ed. course was submitted on 29.07.2008 whereas the institution had already applied for JBT course on 16.04.2008. The application for B.Ed. course was therefore processed in default only.

In view of above, NRC decided to issue show cause notice to the institution for rejection of application for B.Ed. course under clause 8(2) of NCTE Regulations 2009 and NCTE Regulations 2007.

Apparently, the D.El.Ed. course is proposed to be started in the proposed building. The details of existing built up area and area of proposed building has not been indicated.  It is apparent that the total plot area of 5010 is housing its existing building covering considerable portion of the plot. The remaining area is earmarked for proposed building/course. This leaves no land available for playground etc.  The application of the institution is silent about the existing courses run by the college and the manner in which existing building of the college is being used for these courses. This made the application incomplete and liable to be rejected on the above grounds.

Hence, show cause notice be issued to the institution on the above points for a reply within 30 days. 20. UP-3300 BAIJNATH B.Ed.
