1. CASE NO. BOA 2010-23/MS 2010-48

CONSIDERATION OF A REQUEST FOR VARIANCES AND WAIVERS TO THE FOLLOWING: MAXIMUM LOT COVERAGE, DRIVE AISLE REQUIREMENTS, PARKING REQUIREMENTS AND LANDSCAPING REQUIREMENTS FOR A CERTAIN PARCEL OF LAND GENERALLY LOCATED AT 7101 US HIGHWAY 19 IN THE “B-1” GENERAL COMMERCIAL ZONING DISTRICT. (BOA 2010-23/MS 2010-48 – Kenneth D. Keefe /Tim Healy , PE)

PUBLIC HEARING (QUASI-JUDICIAL)

NOTE: The applicant is requesting variances to the following: maximum lot coverage from 75% to 84%, ingress and egress aisle width dimensions to increase one way drive aisles from 16 feet to 22 feet for one way and from 24 feet to 20 feet for two-way, parking requirements for retail sales from 32 spaces to 28 spaces. The applicant is requesting the following waivers: streetscape landscaping to reduce streetscape buffer along Cypress Terrace from 6 feet to 1.3 feet and eliminate trees, and parking lot and vehicular use area buffer landscaping to reduce buffer

width between parcels from 5 feet to 1.73 feet and eliminate all landscaping for a certain parcel of land generally located at 7101 US Highway 19 in the “B-1” General Commercial Zoning District for the redevelopment of an existing site and building for retail uses. The adaptive reuse of the existing building and site for retail use from the previous furniture sales use has created the need to request variances and waivers due to changing Code requirements for the retail use. The proposed plan illustrates what the applicant believes is the best balance to achieve the minimum requests that could be allowed to permit the project to proceed. Subject to any matters that may be discussed at the hearing, staff has not identified any inconsistencies with the Comprehensive Plan. The proposal should have no adverse effect on adopted levels of service for City infrastructure.

ACTION:

After review of Case No. BOA 2010-23, the variance criteria established in Section 18-1504.3 of the Land Development Code, and the corresponding Findings of Fact identified in Section III, A-F of the staff report, I move to:

A. (Approve – Deny) Variance to section 18-1506.21(D)3: Maximum Lot Coverage from 75% to 84% B. (Approve – Deny) Variance to Section 18-1714.2(E): Ingress and Egress aisle width dimensions to increase one-way drive aisles from 16 feet to 22 feet for one way and from 24 feet to 20 feet for two-way. C. (Approve – Deny) Variance to Section 18-1714.4(C): Parking Requirements for retail sales from 32 spaces to 28 spaces.

Furthermore, after review of Case No. MS 2010-48, the waiver criteria of Section 18-1512.10(B) and the corresponding Findings of Fact identified in Section IV, A-E of the staff report, I move to:

A. (Approve – Deny) Waiver to Section 18-1512.6(B)2(d): Streetscape Landscaping to reduce streetscape buffer along Cypress Terrace from 6 feet to 1.3 feet and eliminate trees. B. (Approve – Deny) Waiver to Section 18-1512.6(C)2(a): Parking lot and Vehicular Use Area Buffer Landscaping to reduce buffer width between parcels from 5 feet to 1.73 feet and eliminate all landscaping.
