Brentwood Rules Communication

The purpose of this communication is to assure that everyone is aware of and in compliance with the rules that apply to owners and residents of Brentwood. Most of these rules are covered in the Maple Ridge and Brentwood Declarations but some of these are rules that have been adopted by the Board of Directors of Brentwood for the safety and protection of our neighborhood and property values. The Board’s authority to make and to enforce reasonable rules is covered under section 9b of the Brentwood Declaration.

Modifications to the Outside of Units – Please make sure you are familiar with section 13a of the Brentwood declaration. In summary it says that no exterior change, alteration or construction (including landscaping and painting) can be made without ACC approval. It also states that nothing can be erected on the common or limited common elements without ACC approval. Please make sure you understand that this includes playground equipment, antennas, lighting, storm doors and windows, etc. The standard for approval of such changes or alterations shall include, but not limited to, aesthetic consideration, materials to be used, harmony with the external design of the existing buildings, Units and structures, and the location in relation to surrounding structures and topography. The form to be used for approval is attached to this document.

Landscaping –

 Shrubs: Dead or deceased shrubs will be replaced by unit.  Flower beds: Annuals are authorized in the immediate area of front and rear entrances of units, owner responsible for maintenance and upkeep.  Outdoor landscape lighting: Requires approval of immediate neighbors and ACC.

Yard Art – In addition to the things that are obviously covered under the above paragraph, anything you place on our common or limited common elements is considered to be yard art. This includes things such as fountains, bird baths, bird feeders, pole mounted sun catchers, benches, flags, etc. A maximum of two pieces of yard art are authorized per unit. From this point forward, you need approval of the ACC for any yard art to be placed on the common or limited common elements. We are primarily concerned with the area that is visible from the street or from your neighbor’s front door. Also, please be considerate of your neighbors when selecting porch furniture or ‘decorative items’ for the porch. Plastic furniture and beach type furniture will not be considered as acceptable. Front porches should meet the aesthetic standards of our neighborhood. We would also expect that reasonable standards would be used for your rear porches, patios, and decks.

Garage Doors – All garage doors shall remain closed at all times except for ‘coming and going’ or when someone is actively working in or around the garage.

Non Operable Vehicles – Please remember that no vehicle may be left on any part of Brentwood, except in a garage, if it is unlicensed or in a condition that it can’t operate on public streets.

1 Use of the Section of Turnberry Lane within Brentwood – The road within Brentwood is part of our common elements and therefore subject to the rules established by our Declaration and by the Board of Directors. The following types of vehicles/activities are not permitted on our road: - No skateboarding or use of in line skates, roller blades, roller skates and related roller equipment. - No motorized recreational vehicles such as motorcycles, motor bikes, ATVs, motorized scooters, and motorized dirt bikes. Motorcycles are only allowed for transportation purposes, not for recreation.

Signs - Section 14a of the Declaration only allows one professional security sign not to exceed 6x6 inches and one professional for sale or for rent sign. No other signage is allowed on the property without specific approval of the ACC.

Rules Enforcement - Article V of the Brentwood By-Laws covers the procedure the Board is authorized to use relative to failure to comply to all rules and regulations governing living in Brentwood. In general, notices of noncompliance to rules will be issued by the Brentwood Condominium Association Board and the party in violation needs to correct the situation or request a hearing in front of the Board. The Board has the authority to impose fines and liens if noncompliance becomes a continuing problem.
