Lecture One

Hello – and welcome to Copyright OR Copywrong: a tutorial for educators [project]

We are going to take a look at some issues that are near and dear to the heart of every librarian, school librarians in particular and they are: copyright and fair use……

By the end of the tutorial you should…… have:

- An understanding of what Fair Use is and how it applies to education

- An awareness of tools you can use to determine Fair Use

- An awareness of the copyright free – open content movement that is occurring [project]

So let’s get started:

First take the quick pre-test that is embedded below and then click on the A Fair (y) Use Tale video – this video was a produced by Temple University’s Media Education Lab and is an example of some of the great tools at your disposal for copyright education.

Lecture Two

I hope you enjoyed the show….it is a very entertaining introduction to copyright and fair use and let’s face it – it’s rather ironic that they chose to use Disney clips in their “educational” video since Disney has always been very protective of their copyright. But this is a perfect example of what can and should be done when using copyrighted materials under the statues of fair use.

So let’s take a look at what fair use is….

Fair Use applies to copyright exceptions - meaning there are times and circumstances under which materials can be used without acquiring permission from the copyright holder.

These exceptions usually fall in one of these seven categories

Commentary……criticism…….news reporting…….. Research……….teaching…….. Library archiving….. And scholarship. [project] Now……teaching is included in many fair use exceptions BUT that doesn’t mean you have carte blanc to copy anything and everything. Fair Use is usually different than your idea of what is FAIR. For instance you might find a really nice workbook that would be a wonderful addition to your lesson and since you don’t have the budget to purchase it you just copy it for your students – because it’s not fair that they shouldn’t get the benefit of this great resource…….that does not make it fair use. You are depriving the copyright holder of their fair market share….the workbooks need to be purchased or an alternative needs to be found. You might not think it fair to deprive your students – but more importantly it’s not fair to deprive the copyright holder of their livelyhood – even if you are a non-profit organization.

Lecture Three

Okay…. You have now read learned the four element of consideration

 the purpose and character of your use [project] Including the transformative aspect of fair use  the nature of the copyrighted work [project] Remember you have more leeway with nonfiction than fiction – and steer clear of unpublished works Also according to Code of Best Practices for Fair Use in Media Education you also have more leeway when posting presentations in-house as opposed to posting things in the internet. Your PowerPoint that includes diagrams and illustrations from your textbook is probably okay as long as you show it only in the classroom,( but remember to include the credits at the end) – but problems can arise if you choose to post the same PowerPoint as a video to YouTube.  the amount and substantiality of the portion taken [project] This is a definite case of less is best – but also consider the “heart” of the work…….. and don’t be afraid to link together several snippets of audio for background music  the effect of the use upon the potential market [project] We talked about this in our example earlier, remember to “follow the money” – if you are denying the copyright holder monetary gain you need to reconsider what you are doing Just below this video you’ll see a link to a pdf that you can print out and use to determine if what you are doing falls under the statues of fair use or not….it is made available through Georgia University’s Copyright Policy center Well if you now find yourself frustrated because you realize that showing the entire movie “A Bug’s Life” to your biology students does not fit within the parameters of Fair Use (although there are inexpensive ways to get licensed to show movies for non-commercial use – but that’s another lesson) Take heart……. Even though the big publishing and media companies have succeeded in having laws passed that give the holders of copyright the entire lifetime of the author – plus 70 years before a work is considered public domain……. there is a wonderful movement afoot that is actually trying to get works out to the public, where they can be used and built upon without fear of cease and desist letter. Lecture Four

Creative Commons your new……. “best friend” when designing presentations or looking for information you can freely share or build upon.

Learn the basics of Creative Commons at creativecommons.org/about [project website]

And check out their Open Education Resources at creativecommon.org/education – use the forward & backward arrows to see all of the educational facilities that ALLOW you to use their information freely, such as MITOpenCourseware or the CK-12 Foundation which is the state of California’s free digital textbook initiative. To search for things at Creative Commons go to their home page at creativecommon.org and use the search box….once you type in a search term you’ll see several tabs across the top try a couple of searches such as folk songs in Jamendo or try Brooklyn Bridge in Flickr, Google image, and then try it in SpinExpress – one of the most powerful options, because you can choose the type of license you need from the dropdown menu [project website]

Animoto.com (a great multimedia design tool for student use) also has audio and images in their archives that have creative commons licenses, as do many other web based programs. So watch for the “cc” when you’re looking for resources. [Animoto.com]

And one more thing…..consider becoming a member of the creative commons community by sharing YOUR work with others. Add your photos to Flickr and set up a creative commons attribution license or download your new video or your latest punk rock composition – who knows maybe you’ll get discovered and become the next American Idol…..or maybe not…..but whatever, remember to share as well as borrow.
