PURPOSE AND USE: To provide a record of illegal distillery searches and seizures

NUMBER TO BE COMPLETED: Three (3)

COMPLETION: To be filled out by the investigating agent after the search and seizure has been completed

DISPOSITION: Original should be retained by the investigating agent. A copy is to be sent to the DDO and to the district supervisor for use in media contacts as well as other uses requiring detailed information regarding distillery seizures File according to district file plan

REQUIRED ATTACHMENTS AND SUPPORTING DOCUMENTS: A diagram of the distillery site shall be attached as page two of the illegal distillery report

NOTES: The illegal distillery report is also used to document compliance with the North Carolina Department of Environment and Natural Resources guidelines in reference to mash and illegal alcohol disposal.

Completion Instructions:

1. Case number: An agent will generate his/her case number

2. Case type: Check all that apply; investigation, arrest, and property

3. Distillery type: Check the appropriate block for the type of distillery

4. Location of offense: Location of the distillery in this block. If located in a residence or an out building at a residence, list the street or road address of the residence. If located in a remote area, list the nearest road as the address. Also list the county in this block

5. Hour: Time that the warrant was served using “AM” or “PM”. If the distillery was discovered without a warrant, indicate the time the distillery was discovered

6. Day of week: Day of the week that the warrant was served or if the distillery was discovered without a warrant, indicate the day of discovery

7. Month: Month of discovery 8. Day: Day of discovery

9. Year: Year of discovery

10. Subject(s) and offense(s): Names of person(s) involved and which criminal action has been taken or is anticipated. List criminal charges for each subject including statute numbers. These should be listed as follows:  First name, middle name or initial, last name  The criminal charges should follow the name with the statute number at the end of each charge

11 Seizures: Use standardized values for seized alcoholic beverages, mash and distillery seizures:  Capacity of Distillery – Enter capacity in gallons  Distillery Value – Enter total value of the distillery components, materials, tools, pumps, etc  Mash Capacity: Mash capacity in gallons  Value of mash destroyed: Total value of mash destroyed  Mash Destroyed: Total amount of mash destroyed in gallons. (Note: this amount may be different than the total mash capacity.)  US currency – Enter the amount of any money seized  Non-taxpaid liquor – Enter the amount of non-taxpaid liquor seized or destroyed in gallons  Non-taxpaid liquor value – Enter the total value of non-taxpaid alcoholic beverages seized and or destroyed

12 D.E.N.R. Information: This section is to document compliance with the Department of Environmental and Natural Resources guidelines in reference to the destruction of mash and alcohol  Distance to nearest pond, lake, stream, ditch, or other surface water source – Indicate the distance in feet to the nearest surface water source. The minimum distance is 500 feet. If the distance is more than 500 feet, but you are unable to determine the exact distance due to obstacles, enter “more than 500 feet” in this section. (Note: This distance is to surface water sources and does not include ground water sources such as a well).  If the amount of mash to be destroyed is greater than 10,000 gallons, a D.E.N.R. representative must be called. The representative’s name must be listed on the AL-61  A diagram of the distillery site must be attached. This diagram shall indicate the distillery location, where the mash was dumped, and the nearest surface water source if known

13 Federal tax: The federal tax value of the alcoholic beverages and mash should be listed here if known

14 NC Tax: The North Carolina tax value of the alcoholic beverages and mash should be listed here if known and if BD4L is served or prepared

15 Convictions/ fines/ cost: This information shall be entered on the agent’s case file copy when the case is closed

17 Agent’s signature: Agent’s signature 18 Supervisor’s review – The report shall be submitted to the district supervisor for review within twenty-four hours from the time the warrant was served or the distillery was located. The supervisor shall sign in this block after reviewing the document and forward it to the DDO at ALE Headquarters
