VAWA 2013 requires HUD to prepare the Notice of Occupancy Rights to be distributed to applicants and residents; to prepare a certification form that serves as a means of documenting the incident or incidents of domestic violence, dating violence, sexual assault, and stalking; and to prepare a model emergency transfer plan as a guide for owner/agents.

As a result of the VAWA Final Rule published in the Federal Register on November 16, 2016, several new forms are now required; several existing forms have been updated; and a new policy must be implemented. Below is a brief description of each form or policy and their required use. Additional training and information will be provided at a later date.

The Notice of Occupancy Rights – form HUD 5380: Effective immediately, this form (VAWA Notice) must be provided to all new move-in households, to any applicant who is rejected and with all notices of termination of assistance or Lease as well as to existing residents at the time of their next AR between now and December 2017.

Pages 8 and 9 of the form require each property to insert information that is specific to your area. This information includes:  The name of your HUD Field Office that is listed on your 9887 form (will be inserted in 2 places on the form)  1) The name and phone # and/or email address for a local organization that can provide information regarding abusive relationships 2) The name and phone # and/or email address for a local organization that can provide information to residents who have been victims of sexual assault 3) The name and phone # and/or email address for a local organization that can provide information to residents who have been victims of stalking The same contact may be used as long as the agency or service provides information on all of these VAWA issues.

Please Note:

The Certification of Domestic Violence, Dating Violence, Sexual Assault, or Stalking and Alternate Documentation - form HUD-5382 (VAWA Certification) must be attached to the Notice of Occupancy Rights – form HUD 5380. These forms only have to be provided once. You do not have to provide the VAWA Notice and VAWA Certification at each AR. I have added these forms to a revised 2070 Move in Acknowledgment of Handouts and a revised 2076 Recert Acknowledgment of Handouts form.

If you have market renters who do not complete an annual HUD certification, they must be provided these forms at the time they complete their LIHTC certification and sign an acknowledgment of receipt for the HUD file. Until otherwise instructed by State LIHTC Agencies, we will not need to document the LIHTC files.

In addition to the new and revised forms noted above we are required to update our 4213 Resident Selection Policy and House Rules.

I have updated all RSPs and will be emailing them to each property today and tomorrow. Area and Regional Managers may access them on the shared drive. I have attached a template RSP Change Notice VAWA that will need to be mailed to all applicants on the waitlist and posted in the office.

I have also attached revised House Rules forms 2059, 2090 and 2091. These will need to be executed by your current residents and used now for new move ins. REMINDER: Residents must be allowed 30 days to review the House Rules before being required to execute. I have attached a template notice you should get out to the residents by 1/15/17 to make their new House Rules effective 2/15/17.
