[267-1] 1 2 3 4 5 6 7 8 9 A BILL 10 11 TO AMEND SECTION 21180 OF THE 1976 CODE, RELATING 12 TO ADJOURNMENT OF THE GENERAL ASSEMBLY, TO 13 CHANGE THE DATE FOR THE MANDATORY 14 ADJOURNMENT OF THE GENERAL ASSEMBLY FROM 15 THE FIRST THURSDAY IN JUNE TO THE FIRST 16 THURSDAY IN MAY, AND PROVIDE THAT IN ANY YEAR 17 THAT THE HOUSE OF REPRESENTATIVES FAILS TO GIVE 18 THIRD READING TO THE APPROPRIATIONS BILL BY 19 MARCH FIRST, RATHER THAN MARCH THIRTY-FIRST, 20 THE DATE OF ADJOURNMENT IS EXTENDED BY ONE 21 STATEWIDE DAY FOR EACH STATEWIDE DAY AFTER 22 MARCH FIRST, THAT THE HOUSE FAILS TO GIVE THE 23 BILL THIRD READING. 24 Amend Title To Conform 25 26 Be it enacted by the General Assembly of the State of South 27 Carolina: 28 29 SECTION 1. Section 2-1-180 of the 1976 Code is amended to 30 read: 31 32 “Section 2-1-180. (A) The regular annual session of the 33 General Assembly shall adjourn sine die each year not later than 34 5:00 five o’clock p.m. on the first second Thursday in June May. 35 In any year that the House of Representatives fails to give third 36 reading to the annual General Appropriation Bill by March 37 thirtyfirst, the date of sine die adjournment is extended by one 38 statewide day for each statewide day after March thirtyfirst that the 39 House of Representatives fails to give the bill third reading. The 40 session may also be extended by concurrent resolution adopted by 41 a twothirds vote of both the Senate and House of Representatives. 42 During the time between 5:00 p.m. on the first Thursday in June
[267] 2 1 and the extended sine die adjournment date, as set forth herein, no 2 legislation or other business may be considered except the General 3 Appropriation Bill and any matters approved for consideration by 4 a concurrent resolution adopted by twothirds vote in both houses. 5 Provided, either house of the General Assembly may convene at 6 the call of the presiding officer until five o’clock on the first 7 Thursday in June to consider only: 8 (1) receipt and consideration of gubernatorial vetoes; 9 (2) receipt and consideration of the general appropriations 10 bill, the supplemental appropriations bill, the capital reserve fund 11 Bill, and introduction, receipt, and consideration of a continuing 12 resolution to fund the ordinary expenses of state government, if 13 necessary, until the passage of the general appropriations bill, 14 concurrence and nonconcurrence and amendments to these bills 15 returned from the other house, and the appointment of members to 16 conference and free conference committees and receipt, 17 consideration, and disposition of conference and free conference 18 reports on the matters identified in this item; 19 (3) introduction, receipt, and consideration of resolutions 20 affecting sine die adjournment; 21 (4) receipt, consideration, and confirmation of appointments; 22 (5) introduction, receipt, and consideration of resolutions 23 expressing sympathy or congratulations; 24 (6) receipt and consideration of local legislation which has 25 the unanimous consent of the affected delegation; 26 (7) receipt, consideration, and disposition of conference and 27 free conference reports on matters not provided for in item (2), for 28 which a committee of conference has been appointed prior to five 29 o’clock on the second Thursday in May; and 30 (8) convening of a joint assembly to conduct elections for 31 offices or vacancies in any offices filled by election of the General 32 Assembly. 33 (B) The regular session of the General Assembly shall stand 34 adjourned sine die each year not later than five o’clock p.m. on the 35 first Thursday in June. 36 (C) The sine die adjournment date may be extended by 37 concurrent resolution adopted by a twothirds vote of both the 38 Senate and House of Representatives. Between five o’clock p.m. 39 on the first Thursday in June and the extended sine die 40 adjournment date, no legislation or other business may be 41 considered except the general appropriations bill and matters 42 approved for consideration by a concurrent resolution adopted by 43 twothirds vote in both houses.”
