TOWN OF IXONIA MONTHLY TOWN BOARD MINUTES January 14, 2013

TIME & PLACE: The regular Town Board Meeting of the Town of Ixonia and Sanitary District #2 was called to order by Chairman Perry Goetsch at 7:00 P.M. at the Town Hall located at W1195 Marietta Avenue pursuant to notice requirements of Wisconsin State Statute 19.84 Public Notice.

ATTENDANCE: Present with Chairman Perry Goetsch was Supervisors Carl Jaeger, Brian Derge, Joe Mallow, Peter Mark, Clerk Donna Hann and Attorney Riffle. Also, in attendance were about 9 citizens.

ITEM #3: PLEDGE OF ALLEGIANCE

ITEM #4: APPROVAL OF MINUTES AND TREASURER’S REPORT FOR TOWN OF IXONIA – Joe Mallow made a motion to approve the minutes for December 10th and January 7th, seconded by Peter Mark. Motion carried. Brian Derge made a motion to approve the treasurer’s report subject to audit, seconded by Carl Jaeger. Motion carried.

ITEM #5: SANITARY DISTRICT #2 A) Approval of Expenditures Report and Reconciled Balances – Carl Jaeger made a motion to approve the Expenditures Report and Reconciled Balances, seconded by Brian Derge subject to audit. Motion carried.

ITEM #6: COUNTY SHERIFF’S REPORT AND/OR COUNTY SUPERVISOR’S REPORT. County Supervisor, Amy Rinard was present. The present County Administrator has decided to retire so the search for his replacement has just begun. The purchase for a site to be utilized for a new county highway department is moving forward but make take some time to get permits and zoning approval.

ITEM #7: PLANNING COMMISION A) Layne & Shola Fohr, W1901 Gopher Hill Road, WI, Parcel #012-0816-0843-001. Petitioner Seeks Approval for Conditional Use Permit To Open a Kennel for Boarding and Training of at Most 20 Dogs Utilizing an Existing 30x50 building on site. Parcel is 25.197 acres and is A-1 Exclusive Agricultural. Layne and Shola Fohr would be training retriever dogs in obedience, training collar and gun dogs. They would be boarding all breeds. They plan to kennel the dogs in an existing building and hope to add on a fenced in area behind the building upon approval of the conditional use permit. The Planning Commission unanimously approved the request. Carl Jaeger made a motion to approve the conditional use permit, seconded by Brian Derge. Motion carried.

ITEM #8: FIRE DEPARTMENT A) Review and Possible Action to Approve 2013 Fire Department Officers – Matt Petrie stated that the 2013 officers would be the same as 2012. Carl Jaeger made a motion to approve the 2013 officers, seconded by Peter Mark. Motion carried.

ITEM #9: REVIEW AND POSSIBLE ACTION ON CHANGES TO ORDINANCES FEES AND PENALTY CHARGES – Donna Hann met with Supervisors Carl Jaeger and Joe Mallow to review the ordinances of other municipalities and one of the findings was that the Town of Ixonia has minimums of $5 and $10. It is recommended that it be changed to a minimum of $50 and all penalties should include the court costs incurred by the Town. The following three chapters would need to be changed based on that recommendation. Attorney Riffle said he would take care of giving the information to Attorney Val Anderson to update. Peter Mark made a motion to approve the recommendation given by Stan Riffle in regards to the Ordinance Fees and Penalty Charges, seconded by Carl Jaeger. Motion carried. A) Chapter 25.04 Construction and Effect of Ordinances Penalty Provisions B) Chapter 12.10 Licenses and Permits Penalty C) Chapter 10.05 Public Nuisances Penalty D) Adding Court Cost to all tickets and fees

ITEM #10: REVIEW AND POSSIBLE ACTION TO CHARGE FEE FOR NSF CHECKS PLUS BANK CHARGES – The Board currently does not have a policy that allows additional fees to be charged when the Town receives a NSF check. Currently we just charge what the bank charges us. Donna Hann is recommending that the Town charge a $20 fee in addition to the $8 bank fee to cover the cost and time it takes to resolve the NSF check. Peter Mark asked Attorney Riffle if the Town can charge such a fee. He was not sure if an ordinance was needed to do this. The Board decided to table this item until next month to allow Attorney Riffle to look into it.

ITEM #12: ADJOURN – Peter Mark made the motion to adjourn, Joe Mallow seconded the motion. Meeting adjourned
