By the Chief, Policy and Rules Branch, Commercial Wireless Division, Wireless Telecommunications Bureau:

1. In this Order, we dismiss as moot the “Petition for Order to Remove Service Area Boundary Extension” (Petition) filed on April 2, 1993, by Parmer Communications d/b/a Liberty Cellularphone Network (LCN).1 As discussed below, the Petition is rendered moot by the Commission’s approval of certain requests for assignment involving the stations authorized to the parties in this matter.

2. LCN’s Petition was originally filed to request the removal of a service area boundary extension of C.I.S. of Lubbock, Inc., Debtor-in-Possession (CIS).2 Since the filing of LCN’s Petition, the Commission has granted requests for assignment of LCN’s call sign KNKN-754 and CIS’s call sign KNKA-530 and both stations are currently authorized to WWC Texas RSA Limited Partnership (WWC).3 On September 12, 1994, counsel for LCN notified the Commission that an assignment of call sign KNKN-754 had been consummated.4 On October 14, 1997, counsel for CIS filed a Request for Dismissal of Petition as Moot, citing the consummation of the assignment of LCN’s station.5 Because call signs KNKA-530 and KNKN- 754 are currently authorized to the same party and there is no remaining dispute between the parties in this matter, we dismiss LCN’s Petition as moot.

Accordingly, IT IS ORDERED that, pursuant to Section 4(i) of the Communications Act of 1934, as amended, 47 U.S.C. § 154(i), and Section 0.331 of the Commission's rules, 47 C.F.R. § 0.331, the Petition for Order to Remove Service Area Boundary Extension, filed on April 2, 1993, by Parmer Communications d/b/a Liberty Cellularphone Network is hereby DISMISSED as moot.
