TOWN OF ROCKFORD
RESOLUTION ADOPTING SUBDIVISION ORDINANCE # 2004-11.1
WHEREAS, on the 19th of October, 2004, the Town Board of Rockford Township, Wright County, Minnesota, created a Planning Commission by Ordinance.
WHEREAS, the Planning Commission held a public hearing on 11-09-04__, 2004, to consider the adoption of a Subdivision Ordinance.
WHEREAS, the Planning Commission of Rockford Township has recommended the adoption of a Subdivision Ordinance, said Ordinance being attached hereto as Exhibit A.
WHEREAS, the Town Board of Rockford Township made extensive Findings in support of the Subdivision Ordinance and explained the Planning Commission’s recommendations and policy rationale for the adoption of the Subdivision Ordinance.
FINDINGS
NOW, THEREFORE, the Town Board of Rockford Township, having reviewed the record of the proceedings and recommended Findings of the Planning Commission of Rockford Township does hereby adopt each and everyone of the Findings of the Planning Commission of Rockford Township in support of adoption of a Subdivision Ordinance as if fully set forth herein.
The Town Board determines hereby to adopt the Subdivision Ordinance attached hereto as Exhibit A and as recommended by the Planning Commission.
ADOPTION OF ORDINANCE
NOW, THEREFORE, the Town Board of Rockford Township does hereby ordain as follows:
That Ordinance attached hereto as Exhibit A shall be and hereby is adopted by Rockford Township as its Subdivision Ordinance for all areas located within Rockford Township.
The Interim Ordinance adopting a Subdivision Ordinance adopted by Rockford Township on October 19, 2004, is hereby repealed in its entirety.
SUMMARY
The Town Board hereby adopts the following as its summary of the Subdivision Ordinance: Public Notice. On the 9th day of November, 2004, the Township of Rockford adopted the Subdivision Ordinance which regulates all subdivision of land including lot splits, planning and other division of parcels of property. This Ordinance is applicable to all areas within the Township and governs any such division, splitting, or dividing of property. The terms of the Ordinance define what kinds of divisions of property are legal within the Township and what kinds are not, the Ordinance provides provisions regarding the process of developing property within the Township and the allocation of expenses and risk associated with that development. The Ordinance provides penalties for violations of its terms. A full copy of the Ordinance is available from the Town Clerk at (763)682- 3499 and during regular Township office hours which are Monday, Wednesday, Friday 8 a.m. to 3:00 p.m.
A copy of the Ordinance has also been placed on file with Wright County.
The Town Clerk is forthwith directed to publish, post and record the Ordinance as follows:
a. The Clerk of the Township is instructed to publish the Ordinance summary in the Wright County Journal Press newspaper in body type no smaller than brevier or 8-point type.
b. The Clerk is instructed to record the Ordinance in the Town’s Ordinance book within twenty days after publication of the title and Ordinance. Proof of said publication shall be attached to the recorded Ordinance.
c. The Clerk is instructed to file a copy of the full text of the Ordinance with Wright County and to place a copy of the full text of the Ordinance in the County law library for public viewing.
