MINUTES OF 330th MEETING OF REGISTRATION COMMITTEE HELD ON 16.07.2012 AT 3.00 P.M. IN COMMITTEE ROOM NO-142, KRISHI BHAVAN, NEW DELHI.

The 330th meeting of Registration Committee (RC) was held under the Chairmanship of Dr. Gurbachan Singh, Chairman, ASRB on 16.07.2012 in Committee Room No. 142, Krishi Bhawan, New Delhi. Dr. T.P. Rajendran, ADG(PP), ICAR, Dr. V.K. Yadava, Plant Protection Adviser and Dr. B.S. Phogat, Addl. Plant Protection Adviser & Secretary (CIB&RC) attended the meeting. At the outset, the Chairman welcomed the members and experts of Registration Committee and requested APPA & Secretary(CIB&RC) to take up the agenda, item-wise for discussions. Each issue was deliberated in detail and following decisions were taken by the RC:-

Agenda Particulars of Agenda item No.

1.0 Confirmation of minutes of the 329th meeting of the Registration Committee.

The minutes of the 329th meeting were confirmed with modification that the decision taken with respect to Agenda Item No. 8.10 may be read as “approved” in place of “approved subject to fixation of MRL” as MRL on the product Lambda cyhalothrin 4.9% CS in Chilli is already fixed.

2.0 Follow up action on the decision taken by the Registration Committee in its 329th meeting. RC noted the follow-up-action taken by the Secretariat of CIB&RC with satisfaction. The members were specifically informed that

(i) with respect to Agenda Item No. 1 of 329th meeting, the members were informed that MGR Industries Association had filed a writ petition in the Hon’ble High Court of Delhi against the decision of the Registration Committee granting registration to M/s Meghmani Organics Ltd., Ahmedabad for import of Emamectin Benzoate Technical from the new source alleging that the purity of the product of the proposed source of import was less than 95%. However, Institute for Control of Agrochemical, Ministry of Agriculture (ICAMA), China has confirmed that the purity of the said insecticide of the proposed source is 95% minimum. An affidavit in this regard is being filed in the Hon’ble Court. In view of above the certificate of registration has not been issued so far; and

(ii) the Agenda Item No. 6.2 of 329th meeting wherein the team of experts revisited the replies in response to queries raised in 328th meeting and put up the case for consideration to the Chairman, who approved the grant of registration for the product to the applicant. Accordingly, the certificate of registration was issued.

2.1 Applications pending under various sub-sections of the Insecticides Act, 1968.

RC noted the status with satisfaction.

2.2 Presentation of M/s Bayer Crop Science Pvt. Ltd., for grant of registration for indigenous manufacture of Beta cyfluthrin 8.49% + Imidacloprid 19.81% w/w OD under section 9(3).

The presentation was made by the representatives of M/s Bayer Crop Science Pvt. Ltd. It was decided to approve the product for use on Brinjal only with waiting period of seven days and it was not approved for use on Okra because the lower doses of Imidacloprid are approved for control of sucking pests. It was also decided that they should submit the study on Acute Oral Rat as per OECD 401 guidelines (within a period of 6 months) besides submitting the post marketing surveillance data on all target insects for one year. Accordingly, these conditions be incorporated in certificate of registration. 3.0 Government Business 3.1 Harmonization of data requirement as per OECD and EU guidelines as recommended by Dr. Kanungo Committee Report-protocol reg.

It was decided that Dr. (Mrs.) Sandhya Kulshreshtha, Consultant (Pharmacology) shall continue as the Chairperson of the Group and that the remaining protocols shall be submitted to the Committee before its meeting in Sept., 2012.

3.2 Packing of Boric Acid in Jute Bags.

The comments of Co-opted member of the Committee on packaging may be sought for which a self-contained note may be sent to him.

3.3 Violation of Insecticides Act, 1968 by virtue of malpractice and misleading activities adopted by M/s Syngenta India Ltd., with respect to Emamectin benzoate 5% SG in India – Cancellation of Certificate of registration – reg.

In view of the communication from DAC, RC deliberated the agenda and clarified that the term “Liquidation” was used by the Committee to allow use of the product, imported from the approved source against a valid certificate of registration, in the country within its shelf-life period. As the product had been imported as per approval of Registration Committee, it is not likely to be harmful to human beings, animals and plant health. As enough time has lapsed, State Governments may be requested to undertake random sampling from such stocks of Emamectin Benzoate 5% SG to verify the quality. Therefore, above decision will be applicable for phasing out the left over stocks of Emamectin Benzoate 5% SG to the tune of 33913.65 kg within its shelf-life with the approval of DAC. Committee further decided that the expired material may be disposed of as per Hazardous Waste Management Rules framed under Environment (Protection) Act in environmentally sound manner. 4.0 Export Cases

4.1 List under section 9(3) Export of applications

The Committee approved the list except S. No. 3,4,7,8 & 10 as the products are not allowed to be manufactured. S.No. 6 is subject to revalidation of Chemexil Certificate. The list of applications of Star Export Houses is also approved.

4.2 Consideration of an application of M/s Rallis India Ltd., Bangalore for grant of registration for indigenous manufacture of Tetrachlorvinphos Technical under section 9(3) for Export only.

Approved.

4.3 Consideration of an application of M/s Cheminova India Ltd., Mumbai for grant of registration for indigenous manufacture of Thifensulfuron 375 + Tribenuron 187.5 + Metsulfuron 150 g/Kg under section 9(3) Export only.

Approved. 5.0 9(3B) Cases

5.1 Consideration of application of M/s SRT Agro Science Pvt. Ltd.. Patan (C.G.) for 1st extension of provisional registration of Beauveria bassiana 1.15% WP u/s 9(3B) for controlling Rice leaf folder in rice crop.

Extension approved for a period of one year with commercialization on the same conditions.

5.2 Consideration of application of M/s Sun Agro Biosystem Pvt. Ltd., Chennai for 2nd extension of provisional registration of Beauveria bassiana 1.15% WP u/s 9(3B) for controlling Rice leaf folder in rice crop.

Extension approved for a period of one year with commercialization on the same conditions.

5.3 Consideration of application of M/s S R T Agro Science Pvt. Ltd., Patan (C.G.) for 1st extension of provisional registration of Verticillium lecanil 1.15% WP u/s 9(3B) for controlling mealy bug & scales insect on Citrus.

Extension approved for a period of one year with commercialization on the same conditions.

5.4 Consideration of application of M/s Advance Crop Care (India) Pvt. Ltd., Indore for 1st extension of provisional registration of Bacillus thuringiensis var. Kurstaki 0.5% WP u/s 9(3B) for controlling Castor Semilooper in Castor crop.

Extension approved for a period of one year with commercialization on the same conditions. 5.5 Consideration of application of M/s International Biotech Products, Ratlam (M.P.) for grant of registration for indigenous manufacture of Beauveria Bassiana 1.15% WP us 9(3B).

Approved with commercialization for a period of two years subject to submission of registration code number with respect to deposition of microbial strain in the National Repository as per decision of 314th meeting of the Committee. The process of generation of certificate of registration shall be initiated only after receipt of code number in the Secretariat of CIB&RC.

5.6 Consideration of application of M/s Jothiraditya Bio Solutions Ltd., Mysore for grant of registration for indigenous manufacture of Pseudomonas fluorescens 1.0% WP (ITCC B0034) u/s 9(3B).

Approved for a period of two years with commercialization.

5.7 Consideration of application of M/s Microplex Biotech & Agrochem Pvt. Ltd., Wardha (M.S.) for grant of registration for indigenous manufacture of Beauveria Bassiana 1.15% W.P. u/s 9(3B).

Approved with commercialization for a period of two years subject to submission of registration code number with respect to deposition of microbial strain in the National Repository as per decision of 314th meeting of the Committee. 5.8 Consideration of application of M/s Central Institute for Subtropical Horticulture, Lucknow for grant of registration for indigenous manufacture of Pseudomonas fluorescens 1.0% WP u/s 9(3B).

Approved with commercialization for a period of two years subject to submission of registration code number with respect to deposition of microbial strain in the National Repository as per decision of 314th meeting of the Committee. The process of generation of certificate of registration shall be initiated only after receipt of code number in the Secretariat of CIB&RC.

5.9 Consideration of application of M/s Krishi Bio-Products & Research Pvt. Ltd., Indore for grant of registration for indigenous manufacture of Pseudomonas fluorescens 0.5% WP u/s 9(3B).

The applicants may be asked to clarify as to how they submitted the second sample for testing in CIL without any communication from Sectt. of CIB&RC?

5.10 Consideration of application of M/s Krishi Bio-Products & Research Pvt. Ltd., Indore for grant of registration for indigenous manufacture of Paecilonyces lilacinus 1.0% WP u/s 9(3B).

The applicants may be asked to clarify as to how they submitted the second sample for testing in CIL without any communication from Secretariat of CIB&RC?

5.11 Consideration of application of M/s Krishi Bio-Products & Research Pvt. Ltd., Indore for grant of registration for indigenous manufacture of Trichoderma viride 1.0% WP (ITCC No. 6914) u/s 9(3B). Approved for a period of two years with commercialization.

5.12 Consideration of application of M/s Krishi Vikas Sahakari Samiti Ltd., Jaipur for grant of registration for indigenous manufacture of Bacillus thuringiensis var. kurstaki 0.5% WP u/s 9(3B).

Approved with commercialization for a period of two years subject to submission of registration code number with respect to deposition of microbial strain in the National Repository as per decision of 314th meeting of the Committee. The process of generation of certificate of registration shall be initiated only after receipt of code number in the Secretariat of CIB&RC.

5.13 Consideration of application of M/s Nova Agri Tech Pvt. Ltd., Secunderabad for first time extension of validity period of provisional certificate of registration of Trichoderma viride 1% WP u/s 9(3B) for one year with commercialization.

Extension approved for a period of one year with commercialization on the same conditions.

5.14 Consideration of application of M/s Agri Bio Care, Kottayam for first time extension of validity period of provisional certificate of registration of Trichoderma viride 1% WP u/s 9(3B) for one year with commercialization.

5.15 Consideration of application of M/s Tari Bio Tech, Thanjavur for third time extension of validity period of provisional certificate of registration of Trichoderma viride 1% WP u/s 9(3B) for one year with commercialization.

5.16 Consideration of application of M/s Southern Fertilizers & Chemicals, Kottayam for first time extension of validity period of provisional certificate of registration of Trichoderma viride 1% WP u/s 9(3B) for one year with commercialization.

Extension approved for a period of one year with commercialization on the same conditions.

5.17 Consideration of application of M/s Chaitra Agri Organics, Bangalore for third time extension of validity period of provisional certificate of registration of Trichoderma viride 1% WP u/s 9(3B) for one year with commercialization.

5.18 Consideration of application of M/s Nova Agri Tech Pvt. Ltd., Secunderabad for first time extension of validity period of provisional certificate of registration of Pseudomonas fluorescens 0.5% WP u/s 9(3B) for one year with commercialization. 5.19 Consideration of application of M/s Surya Bio products, Eluru for second time extension of validity period of provisional certificate of registration of Pseudomonas fluorescens 0.5% WP u/s 9(3B) for one year with commercialization.

5.20 Consideration of application of M/s Bio Agro Ferticons, Pune for second time extension of validity period of provisional certificate of registration of Pseudomonas fluorescens 0.5% WP u/s 9(3B) for one year with commercialization.

5.21 Consideration of application of M/s Neesa Agri Tech Pvt. Ltd., ahmedabad for first time extension of validity period of provisional certificate of registration of Pseudomonas fluorescens 0.5% WP u/s 9(3B) for one year with commercialization.

Extension approved for a period of one year with commercialization on the same conditions.

5.22 Consideration of application of M/s Deepa Farm Inputs Pvt. Ltd., Trivandrum for first time extension of validity period of provisional certificate of registration of Pseudomonas fluorescens 0.5% WP u/s 9(3B) for one year with commercialization.

Extension approved for a period of one year with commercialization on the same conditions.

5.23 Consideration of application of M/s Agri Bio Care, Kottayam for first time extension of validity period of provisional certificate of registration of Pseudomonas fluorescens 0.5% WP u/s 9(3B) for one year with commercialization.

Extension approved for a period of one year with commercialization on the same conditions.

5.24 Consideration of application of M/s Anshul Agro Chemicals, Bangalore for second time extension of validity period of provisional certificate of registration of Pseudomonas fluorescens 0.5% WP u/s 9(3B) for one year with commercialization.

Extension approved for a period of one year with commercialization on the same conditions.

5.25 Consideration of application of M/s Tari Bio Tech, Thanjavur for third time extension of validity period of provisional certificate of registration of Pseudomonas fluorescens 0.5% WP u/s 9(3B) for one year with commercialization.

Extension approved for a period of one year with commercialization on the same conditions. As this is the third extension, no further extension shall be considered.

5.26 Consideration of application of M/s Agro Pesticides, Itarsi for first time extension of validity period of provisional certificate of registration of Trichoderma viride 1% WP u/s 9(3B) for one year with commercialization.

Extension approved for a period of one year with commercialization on the same conditions.

6.0 9(3) CASES

6.1 Consideration of an application of M/s Dhanuka Agritech Ltd., Gurgaon for grant of registration of Carbendazim 25% + Flusilazole 12.5% SE (Suspo-emulsion) for indigenous manufacture under section 9(3).

Approved subject to conditions on the Certificate of Registration as per recommendation of the Review Committee for Carbendazim viz:

(i) The impurities 2,3 diaminophenanine (DAP) and 2-amino-3-hydroxyphenazine (HAP) should not be more than be 0.003 g/Kg maximum and 0.0005 g/Kg maximum as prescribed in the FAO specification; and

(ii) Label and leaflets should contain the warning, “Pregnant women should avoid contact with Carbendazim formulations.”

The Committee also decided that Bronopol in the formulation should be of food/pharmaceutical grade/quality.

6.2 Consideration of application of M/s Sumitomo Chemicals Pvt. Ltd., Mumbai for grant of registration of technical import of Metofluthrin Technical along with indigenous manufacture of Metofluthrin 5% EC, Metofluthrin 0.005% Mosquito Coil under section 9(3).

The agenda was deliberated with specific reference to the objections raised in 305th meeting of the Committee and onwards.

The Committee noted that the vapour pressure of Metofluthrin technical is similar to that of transfluthrin, which is already registered in India for use for last many years without any adverse report. Moreover, the vapour pressure gets lowered on making its EC formulation, which is further used for making mosquito coils. Mosquito coils are solid wherein the particles of Metofluthrin are embedded in solid matrix and, thus, stabilized with reference to vapour pressure. The Committee also noted that formulations of Metofluthrin are registered in many tropical countries.

As far data on toxicity is concerned, the Committee noted that primary skin irritation, methodology adopted in Japanese study and study carried out in the country was at some variance. The study abroad was for the duration of four hours while the study from India was for 24 hours. Obviously, the results could not be expected to be identical. The reports of many international bodies reveal that the product is not likely to be carcinogenic to human at doses that do not result in a mitogenic response [US EPA (2007)].

The case was referred to ICMR, Delhi for review, which advised a study for inhalation toxicity for whole body exposure on rabbit and rat for 90 days. The applicants have got the study done on rabbit at IIBAT, Padappai (TN) for 90 days and also submitted the studies on:

(i) 28-days inhalation toxicity report on 0.005% LV on rat;

(ii) 14-days inhalation toxicity report of technical on rat;

(iii) 14-days inhalation toxicity on rat; and

(iv)30-days clinical trial on human volunteers (8 hours exposure /day) on mosquito coil under consideration.

In the 329th RC meeting, it was decided in view of the communication dated 19.3.2012 from ICMR and opinion of Special Invitee from ICMR that the applicant will get the safety studies, i.e. inhalation studies carried out at IIBAT, Padappai (TN) done at some other independent institution with expertise in inhalation toxicity, like, ICMR Institute at NIN, Hyderabad for verification. The applicants have approached various institutions, like, National Institute of Nutrition (NIN), Hyderabad and National Institute of Occupational Health (NIOH), Ahmedabad, which are under ICMR, and Indian Institute of Toxicological Research (IITR), Lucknow, which is under CSIR. However, none of the laboratories located at above mentioned institutes has facilities to carry out the whole body exposure studies as suggested by the Registration Committee on the advice of ICMR. Central Drug Research Institute (CDRI), Lucknow, which is under CSIR, informed that they conduct regulatory toxicological studies of drugs and not of insecticides and that some other institute may be contacted for such study. The Indian Council of Medical Research have also informed that facility for inhalation toxicity with whole body exposure for an insecticide is presently not available with any ICMR institute.

The Registration Committee reviewed the whole case, wherein an argument that toxicological data generated at IIBAT (TN) was being considered in several cases of registration and nothing wrong with its current report on the subject has been pointed out, wherein no evidence of toxicity has been found and no other laboratory/institute in India is carrying out the said study. In view of these facts, the verification, as stated above, is not necessary.

Therefore, the registration for import of Metofluthrin Technical alongwith registration for indigenous manufacture of its Manufacturing Use Product (MUP) Metofluthrin 5% EC and Metofluthrin 0.005% Mosquito Coil is approved with the condition that data on post-marketing surveillance for health monitoring on exposure of inhabitants of 100 houses in each region (east, west, north and south) shall be conducted by the applicant for a period of one year and submitted to the Registration Committee within three years from the date of issue of CR for ensuring safety of the Mosquito Coil to human beings.

6.3 Consideration of application of M/s Godrej Consumer Products Ltd., Mumbai for grant of registration for indigenous manufacture of Transfluthrin 1% FU under section 9(3).

Approved along with condition of post-marketing surveillance as per the protocol submitted at the time of submission of file. 6.4 Consideration of application of M/s Cheminova India Ltd., Mumbai for grant registration for indigenous manufacture of Monocrotophos 15% w/w SG under section 9(3).

The Member from ICAR mentioned about the Observations of Review Committee, chaired by Dr. C.D. Mayee which brought the need for study of endocrine disruption due to monocrotophos. The Member from ICAR raised query, why the bioefficacy data from non-cotton areas such as Nadia and Bangalore are considered. Deferred for discussion in next RC meeting.

7.0 9(4) CASES

7.1 List of application for registration under section 9(4)

The committee deliberated the agenda in detail and approved the applications which are complete and for which MRLs have been fixed, partially fixed or not required (Annexure-I).

7.2 Consideration of application of M/s GSP Crop Science Pvt. Ltd., Ahmedabad for grant of registration for indigenous manufacture of Metribuzin Technical under 9(4).

Approved.

7.3 Consideration of application of M/s Crystal Phosphate Ltd., Delhi for grant of registration for indigenous manufacture of Copper Oxychloride Technical under Section 9(4).

Approved.

7.4 Consideration of application of M/s Shyam Chemicals Pvt. Ltd., Mumbai for grant of registration for indigenous manufacture of Metsulfuron Methyl Technical under Section 9(4).

Approved.

8.0 ENDORSEMENT CASES

8.1 Consideration of request of M/s Bayer CropScience Ltd., Mumbai for expansion of bio-efficacy claim of Thiacloprid 21.7% SC w/w in Apple u/s 9(3) of the Insecticides Act, 1968.

Approved subject to fixation of MRL.

8.2 Consideration of request of M/s Excel Crop Care Ltd., Mumbai for expansion of bio-efficacy claim of Profenofos 50% EC in soybean u/s 9(3) of the Insecticides Act, 1968.

Approved subject to fixation of MRL.

8.3 Consideration of application of M/s Vestergaard Frandsen India Pvt. Ltd., - additional bioefficacy data for removal of condition laid down in section xviii i.e. “The applicant should generate additional bioefficacy data as per guidelines in one endemic area, failing which the registration of the product shall be withdrawn after three years”. Approved to delete the bio-efficacy conditions from the Certificate of Registration to submit the bio-efficacy data as applicant has submitted the satisfactory additional bio- efficacy data as per guidelines from the endemic area.

9.0 MISCELLANEOUS ITEMS

9.1 Consideration of application for Revalidation of Registration Certificate u/s 9(4) in respect of M/s J.K. Chemicals, Shahjahanpur.

Approved.

9.2 Request of M/s E.I. Dupont India Pvt. Ltd., Gurgaon for Import of sample quantity of DPX-RAB 55 0.5% GR for data generation.

Approved a quantity of 47 Kg.

9.3 Request of M/s E.I. Dupont India Pvt. Ltd., Gurgaon for Import of sample quantity of DPX-RDS 63 Tech for data generation.

9.9 Consideration of applications for Enhancement of Shelf Life u/s 9(4) of the Insecticides Act, 1968.

9.10 Cases of RTT permits issued during June, 2012 for Ex-Post Facto approval of Registration Committee.

Approved.

9.11 Consideration of application for import permits for Boric Acid and other substances for non-insecticidal use.

Approved as per list at Annexure-III (Parts-I, II & III).

9.12 The Pending files for more than 3 years under section 9(3b) bio-pesticides category.

The committee decided to issue a letter to all the applicants giving one month’s notice for submission of reply for consideration of the application failing which the applications shall be treated as closed without further notice. Applications inadvertently listed in the agenda on which decision has already been taken by the Committee shall stand withdrawn from the list in agenda.

10.0 Online filing of application for registration under different categories:-

10.1 On-line applications under section 9(4)/FIM/FI/TI.

The Committee deliberated the agenda in detail and approved the applications for grant of registration u/s 9(4) FIM/FI/TI, which are complete and satisfactory as per guideline from Chemistry angle for which MRL has been fixed / partially fixed/ not required. The applications which were found incomplete as per guidelines for this category was rejected. The details of the reasons for rejection is given as indicated against each application/file. (Annexure-IV).

11.0 Any other item with the Permission of Chair.

11.1 Proforma for issuance of Import Permit for import of insecticides for non- insecticidal purposes.

The Committee deliberated the issue in detail and decided that the proforma as at Annexure-V shall be used for issuance of import permits for import of insecticides for non-insecticidal purposes. It was also decided that source of import with complete address shall also be sought in the application proforma, which was approved in the 312th meeting of Committee under Agenda Item No. 9.5 (Annexure-VI). This application proforma, with source of import, and the new format for issuance of import permits shall come into force for the applications, received on or after October 01, 2012.
