1Introduced by the Land Use and Zoning Committee: 2 3 08-974.tif 4 ORDINANCE 2008-974-E 5 AN ORDINANCE APPROVING A DEVELOPMENT AGREEMENT 6 BETWEEN THE CITY OF JACKSONVILLE AND BRIAN 7 SCHUMAN ET AL, CONCERNING A DEVELOPMENT (CCAS 8 NO. 41900) KNOWN AS “BALLARD OAKS”, CONSISTING 9 OF APPROXIMATELY 8.19 ACRES LOCATED IN COUNCIL 10 DISTRICT 5, AT THE TERMINUS OF BALLARD OAKS 11 ROAD, EAST OF ST. AUGUSTINE ROAD (R.E. NOS. 12 152617-0010 & 152626-0000), AS MORE 13 PARTICULARLY DESCRIBED THEREIN, FOR 90,000 14 ENCLOSED SQUARE FEET OF WAREHOUSING USE, 15 SUBJECT TO A PERFORMANCE SCHEDULE AND THE 16 PAYMENT OF AN ANNUAL RENEWAL FEE FOR THE 17 PURPOSE OF RESERVING TRAFFIC CIRCULATION 18 CAPACITY, PURSUANT TO PART 2, CHAPTER 655, 19 ORDINANCE CODE; PROVIDING AN EFFECTIVE DATE. 20

21 WHEREAS, Part 2, Chapter 655, Ordinance Code, authorizes 22Development Agreements, subject to the procedures and requirements 23set forth therein; and 24 WHEREAS, the Planning and Development Department has 25recommended approval of the Development Agreement between the City 26of Jacksonville and Brian Schuman et al, concerning a development 27(CCAS No. 41900) known as “Ballard Oaks” consisting of 28approximately 8.19 acres located in Council District 5, at the 29terminus of Ballard Oaks Road, east of St. Augustine Road (R.E. 30Nos. 152617-0010 & 152626-0000) as more particularly described

2 1therein, for 90,000 enclosed square feet of warehousing use, 2subject to a performance schedule and the payment of an annual 3renewal fee; and 4 WHEREAS, the required Planning and Development Department 5informative workshop was held and the required public hearings were 6held by the Land Use and Zoning Committee and the City Council, all 7with public notice provided, pursuant to Section 655.206, Ordinance 8Code; now therefore 9 BE IT ORDAINED by the Council of the City of Jacksonville: 10 Section 1. Approval of Development Agreement. The 11Development Agreement between the City of Jacksonville and Brian 12Schuman, et al, is hereby approved in substantially the same form 13as the copy attached hereto as Exhibit 1. The Mayor and Corporation 14Secretary are authorized to execute said Agreement on behalf of the 15City. 16 Section 2. Effective Date. This ordinance shall become 17effective upon the signature by the Mayor or upon becoming 18effective without the Mayor’s Signature. 19
