Village Council - Regular Meeting Approved Minutes as Amended Brandon Township Office 395 Mill Street, Ortonville, MI 48462 July 24, 2017 – 7:00 P.M.
President Wills called the meeting to order at 7:01 p.m. Trustee Dylus led the Pledge of Allegiance followed with the Invocation by President Wills.
Roll Call: Trustees Present: Brice, Butzu, Dylus, Eschmann, Skornicka, Wills Absent: Sleva with notice Also Present: Interim Manager John Lyons, Treasurer Beth Forys, Citizen Reporter Susan Bromley and 12 members of the public.
Approval of Agenda: *Motion by Skornicka, seconded by Eschmann to approve the Agenda as amended to add under OLD BUSINESS item B. Iron Bell Trail. All in favor, motion carried

*Amendments to Minutes are below
Disbursements: Trustees requested clarification of items on the Disbursements Report and asked that going forward any costs shared with the DDA be separated out on the report.
*Motion by Eschmann, seconded by Skornicka to approve the Disbursements Report ending July 19, 2017 and pay the Village’s bills in the amount of $18,195.70

2 Village Council Approved Minutes July 24, 2017
Trustee Skornicka indicated that the Personnel Committee had received six applicants for the open Village Manager position. She reiterated the posting will be closing on August 4, 2017 at 5:00 p.m. The Personnel Committee will be reviewing the applications and deciding on which applicants to interview. She will provide another update at the August 28, 2017 meeting.
Trustee Skornicka provided a courtesy reminder of the Michigan Municipal League Conference in September and that she would be attending.
Trustee Butzu indicated that the Fire Authority did not meet but they were going to try to schedule a meeting in August followed by a joint meeting with the Village and Brandon Township.

Trustee Dylus indicated that he felt the Joint Organizational meeting of July 17, 2017 had a positive impact and that efforts should be made to continue having joint meetings either quarterly or semi-annually.
President Wills – None
Public Comments: (Agenda Items)* One member of the public a Village resident, spoke about the current ordinance under review to allow chickens in the Village, indicating only that there should not be a fee to register or have chickens.
Village Manager Report Animal Ordinance - Interim Manager Lyons is currently reviewing the Animal Ordinance for an update to possibly allow chickens in the Village. The ordinance currently explicitly states no chickens. In an effort to save time, Lyons suggested updating the ordinance then taking it to the Planning Commission as a courtesy.

Skate Park - Lyons has a couple of references to take the equipment down at Skate Park and return it to Brandon Township Parks and Recreation.
Enviro-Assist - Lyons provided clarification on letters that were sent out to residents in the ‘higher at risk’ zone based on the Enviro-Assist Report. He indicated that the letter informs the residents that they don’t necessarily have problem but conditions are that they could have problem. Lyons indicated that it should be left at the letter for now and issue should be revisited at a later date.
Village to Bueche’s Path - Lyons noted that a walking path from Narrin Street to Bueche’s requires a permanent easement from the property owner located at 110 Oakwood Road.
Sidewalks were discussed. Trustee Dylus indicated that the next steps are to start seeking grants for SEMCOG.
Lyons noted that the Village was awarded grant funding from the Pilot Local Road Improvement Matching Fund in the amount of $2,981.00 which the Village will match. The funds will be used on chip/crack sealing.
Lyons indicated that at the Joint Organizational meeting on July 17, 2017 the Village’s current Master Plan and lack of Capital Improvements Plan may have a negative impact when exploring some grant options. He has engaged McKenna and Associates to prepare a proposal for a complete Master Plan and for an update to the current Plan. McKenna will also put together a proposal for a Capital Improvements Plan.
Trustee Brice asked that trash hauling and limiting the number of days and times that contractors enter the Village be addressed.
Trustee Dylus asked about getting a quote from DTE to change the street lighting to LED.
Old Business A. Project Updates were covered in the Manager’s Report. B. Iron Belle Trail Trustee Eschmann read a prepared statement regarding the Trail and asked the Trustees to support a Heritage Highway Route or Route E that could connect to South, Narrin, Mill and

Myron streets. He noted that Brandon Township is considering a route that would come down Seymour Lake road and M-15 and that the sidewalk for the schools along M-15 possibly could be used as a connector.
After discussion, Trustee Eschmann asked that the topic be added to the agenda for the August 28, 2017 Council Meeting. Trustee Brice asked that Kristin Woodpine be contacted for her input.
New Business A. Cedar/Schoolhouse Streets Paving Project Interim Manager Lyons indicated that the Village was successful in obtaining funding with the Michigan Department of Quality Scrap Tire Market Development program. The Village was approved for a match grant of $103,000.00 on a $206,000.00 project that is set up for reimbursement payments to the Village.
*Motion by Wills, seconded by Butzu to approve the contract with MDEQ for funding for the 2017 Scrap Tire Market Development Grant in the amount of $103,000.00

C. Scrap Tire Paving Project

Interim Manager Lyons indicated that Rowe Professional Services has submitted a proposal for the design and engineering for the Scrap Tire Paving Project in the amount of $14,700.00. The proposal includes bidding, and pre-construction administration.
*Motion by Dylus, seconded by Butzu to approve the design engineering proposal submitted by Rowe Professional Services for design engineering of the Scrap Tire Paving Project in the amount of $14,700.00

D. Ortonville DDA 2017-18 Budget Approval The DDA has prepared and approved its operational budget for 2017-18 and is seeking approval from Council.
ODDA Executive Director Jenkins answered questions and provided clarification on Grant Revenues, what the DDA is doing to bring business downtown and the role of Friends of AMOS.
*Motion by Dylus, seconded by Brice to approve the Ortonville Downtown Development Authority 2017-18 as presented with revenues and expenditures of $117,658.47

Fire Chief Kwapis provided a brief update on the Brandon Township Fire Department. He indicated that the number of calls into the Fire Department are trending up. He noted that if the trend continues the Department will need to hire additional full time help.

*Minutes of July 10, 2017 Updated formatting of sections for consistency. New Business, Item A paragraph two was updated to read - Council was advised that former Manager Trent requested severance through the month of August as well as 14 days of paid time off (PTO). President Wills indicated that based on his calculations, Trent was entitled to nine days PTO. A discussion followed on the terms the former Manager was asking for. Trustee Skornicka cited the PTO policy as well as an Offer Letter that indicated PTO accrual. infractions “it may be immediate, with no other pay other than that already earned”. Council agreed to three PTO days and no severance. New Business Item B paragraph one was updated to read - Trustee Skornicka was asked to contact former Manager John Lyons on Thursday July 06, 2017. Mr. Lyons indicated his availability in a proposal letter submitted to Council and for consideration. Mr. Lyons proposal letter was distributed for Council review.
