WAPAKONETA CITY COUNCIL NOVEMBER 2, 2015

President Pro Tem Bonnie Wurst called the meeting to order at 7:30pm on November 2, 2015 at 701 Parlette Court with the following members present: Daniel E. Lee, Bonnie Wurst, Chad Doll, Randy Fisher, Rachel Barber and Dan Graf. Also present were Mayor Rodney Metz, Service Director Bill Rains and Law Director Dennis Faller. There were 4 visitors present. President Steve Henderson and Jim Neumeier were absent.

Received Income Tax Summary Report for Month Ending 10-31-2015.

Motion by Fisher, second by Lee to approve the minutes of the October 19, 2015 Council Meeting as submitted. Vote – 6 yeas, 0 nays.

Mayor Metz announced a proclamation to declare November 9th as ‘Make a Wish Day’ in the City of Wapakoneta. A basketball game between the Wapakoneta Fire Department and the Wapakoneta Police Department will occur at 7:00pm on November 9, 2015 at the Wapakoneta High School to raise money for the Make a Wish Foundation.

Communications – Clerk McDonald read a notice from the Ohio Division of Liquor Control regarding a permit transfer from H & F Food Mart Inc of 803 Apollo Drive, Wapakoneta, Ohio to Bhavik LLC of 803 Apollo Drive, Wapakoneta, Ohio. Council did not wish to take any action.

Clerk McDonald noted an email that was sent to Council and Administration regarding a citizen complaint about AIP noise. Mayor Metz advised that he and Law Director Faller have been communicating with an engineering firm that is conducting testing of the noise levels in that area.

President Pro Tem Wurst asked Clerk to read Ord 2015-40 for the third time re: AN ORDINANCE TO ACCEPT THE APPLICATION FOR THE ANNEXATION OF 14.663 ACRES, MORE OR LESS, LOCATED IN THE TOWNSHIP OF DUCHOUQUET, AUGLAIZE COUNTY, OHIO TO THE CITY OF WAPAKONETA, OHIO. Motion by Fisher, second by Doll to adopt Ord 2015-40. Vote – 6 yeas, 0 nays. Motion passed.

President Pro Tem Wurst asked Clerk to read Ord 2015-41 for the third time re: AN ORDINANCE ENACTING CHAPTER 1038 UNDER TITLE FOUR OF PART TEN OF THE CODIFIED ORDINANCES OF THE CITY OF WAPAKONETA REGARDING CONNECTION TO CITY UTILITIES AND REQUIRING ANNEXATION. Motion by Lee, second by Fisher to adopt Ord 2015-41. Vote – 6 yeas, 0 nays. Motion passed.

President Pro Tem Wurst asked Clerk to read Ord 2015-42 for the second time re: AN ORDINANCE ESTABLISHING THE ZONING CLASSIFICATION FOR 14.663 ACRES, MORE OR LESS, LOCATED IN DUCHOUQUET TOWNSHIP, AUGLAIZE COUNTY, OHIO, AS ANNEXED TO THE CITY OF WAPAKONETA.

President Pro Tem Wurst asked Clerk to read Ord 2015-43 for the second time re: AN ORDINANCE AUTHORIZING THE DIRECTOR OF SAFETY AND SERVICE TO ENTER INTO A LEASE / PURCHASE AGREEMENT FOR ONE VAC-CON SEWER JET AND ROVVER X CAMERA SYSTEM THRU THE OHIO COOPERATIVE PURCHASING PROGRAM, REPEALING ORD 2015-36 AND DECLARING AN EMERGENCY. Motion by Fisher, second by Wurst to suspend the rules for Ord 2015-43. Mr. Fisher noted that said ordinance has now been read four times, and the reason it is before Council again is due to a change in wording by Auditor Walter. Vote – 6 yeas, 0 nays. Motion passed. Motion by Fisher, second by Doll to adopt Ord 2015-43. Vote – 6 yeas, 0 nays. Motion passed. President Pro Tem Wurst asked Clerk to read Ord 2015-44 for the second time re: AN ORDINANCE AMENDING CHAPTER 248 “RESCUE SQUAD SERVICE” OF THE CODIFIED ORDINANCES OF WAPAKONETA, OHIO, REPEALING ORD 2015-26 AND DECLARING AN EMERGENCY. Motion by Wurst, second by Fisher to suspend the rules for Ord 2015-44. Ms. Barber asked why Mrs. Wurst made a motion to suspend the rules. Mrs. Wurst replied that said ordinance has now been read four times. Mr. Rains advised that the charges in Ord 2015-26 were incorrect, and Ord 2015-44 corrects these numbers. Vote – 6 yeas, 0 nays. Motion passed. Motion by Doll, second by Lee to adopt Ord 2015-44. Mr. Graf asked for an explanation of how this affects indigent citizens. Mayor Metz and Mr. Faller answered that the amount provided by Medicare or Medicaid must be accepted. Vote – 6 yeas, 0 nays. Motion passed.

President Pro Tem Wurst asked Clerk to read Ord 2015-45 for the second time re: AN ORDINANCE TO AMEND CHAPTER 890 OF THE CODIFIED ORDINANCES OF THE CITY OF WAPAKONETA REGARDING MUNICIPAL INCOME TAX. Mr. Faller explained that due to House Bill 5, all municipalities must have legislation in place to be in compliance by January 1, 2016.

The Mayor gave the following report: 1. Participated in monthly Sister Cities meeting. 2. Participated in one Department Head meeting. 3. Participated in meeting with Dominion for our industrial JRS gas needs. The meeting did not go as well as I had hoped. There may be associated cost to get a large volume of gas to the JRS site. 4. Sworn in new Firefighter, Jared Phillips. 5. Participated in presentation for check award to Wapakoneta Police Department for body cameras from the Lions Club. 6. Presented Aaron Birkemier with an award recognizing his achievement as Eagle Scout. 7. Participated in monthly Hometown Holiday meeting. The event will be held December 4 through December 6. 8. Met with Dennis Faller to discuss complaints received concerning noise from industrial business. 9. Performed one wedding. 10. Attended Chamber of Commerce Halloween program held on Halloween.

Mayor Metz added that alley work and pot holes are currently being addressed, and the City has been made aware of drainage issues at Optimist Park. Ms. Barber asked for further explanation of the City’s response to the AIP noise complaint. Mayor Metz replied that an engineering firm is completing an analysis in that area regarding this problem. Law Director Faller added that it is an ongoing situation that is being investigated. Mr. Lee asked if the citizen who has issued a complaint has been made aware of the testing being done. Mr. Faller answered that he believes they are aware, and that said email complaint predates the day the study was done. Mayor Metz also added that a full rehearsal of a hazardous material spill response will be conducted on Saturday. Mr. Graf asked if there was any training or equipment that the City could perform regarding noise complaints. Mr. Rains responded that noise testing equipment, as well as equipment that tests the effect of noise on the body is what is needed, which is why an engineering firm is completing the study. Mayor Metz added that many other factors are also considered, such as wind, rain, and distance from the noise. Ms. Barber asked for an update on the Waste Minimization Committee. Mayor Metz replied that Randy Fisher will make an appointment to the committee. Mr. Graf thanked the Lions Club for a substantial donation to the Wapakoneta Police Department for the purchase of body cameras. Ms. Barber asked Mayor Metz to explain item number 3 in his activity list. Mayor Metz replied that this was regarding what was needed to increase the capacity at the JRS site.

The Service Director gave the following report: Regarding the Blackhoof Street bridge, the underground work is done. Concrete and asphalt work is next. However, due to ODOT requirements, any concrete poured after October 15 th must sit untouched for 45 days. Therefore, the bridge will be done yet closed to traffic for this amount of time due to ODOT requirements. The next step for the Long Term Control Plan is to close traffic between the railroad and Water Street. Once the manhole is set, Harrison Street can be paved. A final coat on West Auglaize Street should happen this week. Mr. Graf asked if the asphalt plants are closing. Mr. Rains advised that Helms has an agreement in place, but time is running out. Ms. Barber asked for an update on Skinner Run and the former Gibson property. Mayor Metz replied that Mary Ruck will be getting the locations needed to Mr. Rains.

The Law Director gave the following report: Ms. Barber asked for an update on conversations with Dominion. Mr. Faller replied that he has been sorting through many emails to organize all the details of what occurred. Ms. Barber asked for the status of the hazardous tree at 512 West Auglaize Street. Mayor Metz replied that Mary Ruck is working with the property owner and Dominion to accomplish removal of the tree.

SCHEDULING OF MEETINGS: Lands & Buildings Committee will meet on November 17th at 5:00pm at City Hall. Communications & Rules Committee will meet on November 18th at 3:30pm at City Hall.

Miscellaneous Business – Motion by Fisher, second by Lee to nominate Joe Lynch to the Waste Minimization Committee. Vote – 6 yeas, 0 nays.

Motion by Fisher, second by Doll to adjourn at 8:10pm. Vote – 6 yeas, 0 nays.
