FACT SHEET Ivy Industrial Park Agreements Bostik CACP, Sandvik CACP and Bostik/Sandvik CO&A June 4, 2011

Site History

 The Ivy Industrial Park Site contains certain volatile organic chemicals in the soils and groundwater, including, but not limited, to perchloroethylene (“PCE”) and Trichloroethylene (“TCE”).

 Some or all of the hazardous substances, including, but not limited to, PCE and TCE, are contained in one or more groundwater plumes which have impacted certain private water supply wells in and around the Site, known as the "Affected Area" located in Scott, South Abington, North Abington and Abington Townships, Lackawanna County, PA.

 Bostik, Inc. is the owner of a facility which manufactured adhesives from 1977 until it was closed in 2003. The Bostik facility is located within the Ivy Industrial Park, 1200 Griffin Pond Road, South Abington Township, Lackawanna County, Pennsylvania

 Sandvik, Inc. is the owner and operator of a steel products manufacturing facility located on approximately 35 acres within the Ivy Industrial Park, 982 Griffin Pond Road, Scott Township, Lackawanna County, Pennsylvania.

 DEP alleges that, in the past, Bostik and Sandvik released substances that contained PCE and/or TCE into the soils and groundwater within the Site.

 Bostik and Sandvik have conducted environmental investigations of each of their properties, as well as at various other locations within the Affected Area which included, but were not limited to, the installation of monitoring wells and soil borings. DEP, Bostik and Sandvik have sampled over 500 private residential and business production wells at the Site.

 Bostik and Sandvik have submitted site characterization reports toDEP. The characterization activities have identified various concentrations of PCE, TCE, cis-1,2-Dichloroethylene ("cis-1,2-DCE") and various other contaminants in the soils and groundwater at the Site.

 DEP has agreed to enter in settlements in the form of a Consent Order and Agreement (“CO&A”) and a Consent Assessment of Civil Penalty (“CACP”) with Bostik and Sandvik. CO&A Requirements

 Within 60 days of the CO&A becoming effective, Bostik and Sandvik shall submit a work plan for the installation of a new water source and water mains.

 Bostik and Sandvik will pay to install a new water main, approximately 21 miles in length, provide for a new water source outside the Affected Area and offer a connection to approximately 500 properties, within the Affected Area.

 Bostik and Sandvik will contact the current owner of each property currently being served by a private well that is located within the Affected Area.

 Bostik and Sandvik will seek an agreement with the property owner and pay to abandon, decommission and/or disconnect the existing groundwater well on the property. They will also install meters and piping from the property to the water main.

 Bostik and Sandvik shall restore excavated areas to as close to the pre-excavation condition as possible by performing site restoration and re-vegetation.

 Bostik and Sandvik shall reimburse the past and future response costs incurred by DEP.

DEP is seeking civil penalties, through separate CACP agreements, totaling $2,500,000 from both Bostik and Sandvik. Bostik and Sandvik shall pay the Department a civil penalty of $1,250,000.

Public Comment

 DEP is making the settlement documents available for public review. A 60-day comment period begins on Saturday, June 4, 2011 and ends on Wednesday, August 3, 2011. A public meeting to discuss the settlement documents and the case as a whole will be held during that comment period.  The CO&A and CACP agreements are available for public review at DEP’s Northeast Regional Office in Wilkes-Barre.
