Waterford Township Supervisors Regular Business Meeting Wednesday, May 3, 2017

The regular meeting of the Board of Supervisors of Waterford Township was held on May 3, 2017 at 7:00 p.m. at the Waterford Township Municipal Building. The meeting was opened with the Pledge of Allegiance.

Chairman Coffin presided, with Supervisors Stull and Malinowski in attendance. Also present were Roadmaster Kevin Cromwell, Secretary Wendy Burbules, Zoning Officer Marilyn Evans, Leeann Ormsbee, Penny Bengel, Cindy Kelley, Brian Kelley, Allen Yard and Larry Thompson.

PUBLIC COMMENT Cindy Kelley – 7576 Middleton Road. She and the others that came with her are concerned with what is happening with Merv Troyer’s gravel pit. They’ve heard that the new owners want to put in a gravel storage area and bring in processing equipment. They are concerned with the equipment noise and the coming and going of heavy trucks in a residential area. They don’t want the value of their homes to go down. They also believe the area is in a flood plain. They feel the heavy trucks are going to make the road a mess as well. Discussion ensued. Bruce stated he would have to have Marilyn look into the zoning of the area. The Township will look and see if there are any operating hour regulations.

MOTION TO APPROVE THE MINUTES FROM THE APRIL 19, 2017 MEETING Motion by Stull to approve the minutes of the April 19, 2017 meeting, seconded by Malinowski. Motion carried 3/0.

ROADMASTER’S REPORT Kevin stated all the roads have been touched up. They were out with the one ton and patched old holes that needed fixed. He’s waiting on the Conservation District to get back to him with other options with the hill on Haugh Road. They tiled Benson and are ditching it now. Tamarack Road/Trout Run Bridge – The creek has been eating away at the road. We received a letter from the engineer he doesn’t think we can re-align the creek. The permits are costly but it would be cheaper material and time wise in the long run; but we still may not get the approval. We could be out the money for trying. He recommends to reinforce the bank next to Talcott Road. That involves a lot of materials being use. Jack stated we are permitted do the Talcott Road option. Kevin said yes but it’s not a long-term fix. In July and August, the creek is dry so there wouldn’t be any silt going into French Creek, if that’s an issue. He’ll talk more with the engineer. Bruce is frustrated with the cost of the permit and then still not knowing if we can proceed. The stream needs to be re-directed to correct the problems. Antiskid – Kevin received more information back from the state. We can bid this out both delivered and picked up. Roller – Kevin has been looking into a roller. Cooley’s had one but it’s not heavy enough. Five Star is working up a bid for a 46 inch one. Another option would be a roller attachment to go on a skid steer or a small loader. Showman has a Bobcat they really like. It is an older version so it doesn’t have the down pressure. They are going to try a newer one with the down pressure. That could be a roller, broom, forks and a bucket that could go onto a small loader. Jack asked if we could rent a roller from Suit-Kote. Kevin stated there are a number of places we could rent them from. Five Star rents them for $275/day, $750/week. Cooley’s had a sale price of $6500 or rent it for $2400/month. Kevin would like to be able to grade and cold patch at the same time. Brine – Jack would still like to look into getting the free brine in OH. He thinks we should have a part- time driver to go after 3:00 p.m., come back and unload it into the tank so it’s ready for the next day. This wouldn’t need to be done every day. Bruce asked if we had already bought brine. Kevin stated we did in February to treat the antiskid. All the good stuff has been used. Shirts – Kevin would like to reorder 50 more safety colored T-shirts. Bruce asked this be tabled to next meeting so Kevin can get some prices together.

ZONING OFFICER’S REPORT Marilyn mentioned that the Supervisors had her report in front of them. She sent a letter to the property owners on Seroka Road giving them 30 days to clean up the property. The mess is worse now. She received a complaint about a property on Route 19. She looked at it, there were some full garbage cans by the garage but it wasn’t bad. She let it go for now. Marilyn also wanted to mention that she cannot deny anyone a permit for a Conditional Use.

SOLICITOR’S REPORT none

OLD BUSINESS Clute Road Ditch – Tabled from last meeting. Nothing new was discussed. Sornberger Conditional Use – This was tabled from the last meeting. Jack stated we didn’t get a developer’s agreement and the Township’s attorney fees were well over the $195 Conditional Use Application Fee that Mr. Sornberger paid. Motion by Coffin to refund the $195 Conditional Use Application Fee to Mr. Sornberger, seconded by Malinowski. Motion carried 3/0.

NEW BUSINESS Gregg Subdivision – Subdivision has been approved by the Waterford Township Planning Commission and Erie County Planning Commission. Motion by Stull to approve the Gregg Subdivision, seconded by Malinowski. Motion carried 3/0.

Finch Subdivision - Subdivision has been approved by the Waterford Township Planning Commission and Erie County Planning Commission. Motion by Stull to approve the Finch Subdivision, seconded by Malinowski. Motion carried 3/0.

Neal/Fox Subdivision - Subdivision has been approved by the Waterford Township Planning Commission and Erie County Planning Commission. Motion by Stull to approve the Neal/Fox Subdivision, seconded by Malinowski. Motion carried 3/0.

Resolution 04-17 - Resolution of the taxing district to approve an agreement among the county of Erie, Erie County Tax Claim Bureau and the law firm of MacDonald, Illig, Jones and Britton LLP. Motion by Stull to adopt Resolution 04-17, seconded by Malinowski. Motion carried 3/0.

Niemeyer Road Bridge - HRG is requesting a three-month time extension. The letter needs signed and returned. Motion by Stull, seconded by Coffin to sign the extension letter from HRG. Motion carried 3/0.

They are as follows: Russell Standard - $1.036/Square Yard, $189,738.22, bid bond was included Suit-Kote – $1.18/Square Yard, $216,111.10, bid bond was included Motion by Stull to accept the low bid of $1.036/Square Yard, $189,738.22, from Russell Standard. Seconded by Malinowski. Motion carried 3/0.

Surface Treatment Bids – The bids were opened at 10:00 a.m. today. They are as follows: Russell Standard – $2.731/Square Yard, $154,102.14, bid bond was included Suit-Kote - $3.45/Square Yard, $194,673.15, bid bond was included Motion by Stull to accept the low bid of $2.731/Square Yard, $154,102.14, from Russell Standard. Seconded by Malinowski. Motion carried 3/0.

Supervisor Coffin called an Executive Session to discuss employee wages at 7:48. The meeting was called back to order at 7:49.
