Resolution #2015-0269 Awarding Professional Services Contract for Design, Bid and Construction Phase Services for the Standby Power Generator in the Municipal Building to Nancy C. Wohlleb, P.E., C.M.E., NJ License #24GE04552200 of the firm Hatch Mott MacDonald – In the Not to Exceed Amount of $20,500.00 (To Include Reimbursable Expenses as Required)

WHEREAS, the Township of Bernards requires Professional Design, Bid and Construction Phase Services for a Standby Power Generator located in the Municipal Building; and

WHEREAS, Nancy C. Wohlleb, P.E., C.M.E., NJ License #24GE04552200 of the firm Hatch Mott MacDonald, 111 Wood Avenue South, Iselin, NJ, 08830 has submitted a proposal dated June 15, 2015 outlining Professional Design, Bid and Construction Phase Services to the Township; and

WHEREAS, section N.J.S.A. 40A:11-5 of the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) exempts such professional services from competitive bidding; and

WHEREAS, this contract is awarded without public advertisement as defined in N.J.S.A. 19:44A-20-7 and pursuant to the provisions of N.J.S.A. 19:44A-20-4; and

WHEREAS, the Chief Financial Officer has certified funds are available in Energy Allocation Initiative Grant G-02-25-EAI-214.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards that a professional service contract be awarded to Nancy C. Wohlleb, P.E., C.M.E., NJ License #24GE04552200 of the firm Hatch Mott MacDonald, 111 Wood Avenue South, Iselin, NJ, 08830, as follows: 1. The contract will encompass services as outlined in the submitted proposal dated June, 15, 2015. 2. The contract term is from July 15, 2015 through July 14, 2016 for the construction phase services not to exceed an amount of $20,500.00. This amount includes reimbursable expenses as required for copies of drawings and any additional consultation fees other than those outlined in the Scope of Work. The design and bidding portion of the professional services shall be charged to Resolution #2015-0237 which is not to exceed $10,000.00. 3. Billings must be rendered by the contractor within 30 days of service delivery. 4. Any modification to this contract shall be in writing and signed by both parties and upon obtaining said signatures shall immediately become part of the contract. 5. No payments in excess of the “not to exceed” contract amounts will be approved, unless such services/expenditures are negotiated and agreed upon in advance of service delivery. 6. As required by law, the parties to this contract agree to incorporate into this contract the mandatory affirmative action language promulgated by the Treasurer pursuant to P.L. 1975, c.127, which is attached to this resolution as Exhibit A. 7. This contract shall, for all purposes, be deemed a NJ Contract and any provisions of this contract shall be governed and interpreted with the Laws of the State of New Jersey. 8. The contractor shall report directly to Pat Monaco, Director of Public Works, who will be the chief contact for the Township of Bernards on this project. NOW THEREFORE BE IT FURTHER RESOLVED that the Business Disclosure Entity Certification and the Determination of Value be placed on file with this resolution. NOW THEREFORE BE IT FINALLY RESOLVED, by the Township Committee of the Township of Bernards that a copy of this resolution be published in the official township newspaper, and be placed on file and available for public inspection in the office of the Bernards Township Purchasing Agent.

Agenda and Date Voted: July 14, 2015 Explanatory Statement The proposal provided for Professional Design and Bid Phases as follows: Prepare a final set of bid documents for installation contract, technical specifications for site concrete and electrical work and final cost construction estimate. During the project bid phase, Hatch Mott MacDonald will assist the Township in response to questions from bidders and will review the apparent low bidders experience and provide a bid award recommendation letter.

The proposal for Construction Phase Services as follows: Final review and approval of the procurement contractor’s shop drawings for the generator and load equipment as well as for equipment testing, review application for payment by procurement contractor, attend preconstruction meeting with Contractor and Township staff, review installation contractor’s initial submittals and shop drawings for site and installation work, perform inspection services during the preparation and installation of the concrete pad, conduit installation, site and restoration work; coordinate for concrete testing of concrete pad, attend 1 four hour load bank test and 1 day of generator testing and startup, and preparation of an as-built plan depicting final site features constructed under the contract. The project costs for this proposal shall be funded by Resolution #2015-0237 which was in the amount of $10,000 and this resolution which is requesting $20,500.

We therefore recommend awarding a professional services contract to Hatch Mott MacDonald for the Professional Design, Bid and Construction Phase Services for the Standby Power Generator in the Municipal Building.
