Section 50-21-860 of the 1976 Code, as last 24 amended by Act 420 of 1996, is further amended to read: 25 26 “Section 50-21-860. As used in this section, ‘airboat’ means a 27 watercraft propelled by air pressure caused by a motor mounted on 28 the watercraft aboveboard. 29 (A) It is unlawful for a person to operate an airboat on the 30 public waters of this State from the freshwater-saltwater dividing 31 line, established by Section 50-17-30, seaward. 32 (B) It is unlawful to operate an airboat on the waters of the 33 Waccamaw, the Great Pee Dee, the Little Pee Dee, the Black, and 34 the Sampit Rivers in Georgetown and Horry Counties this State 35 during the period from one hour before after legal sunset to one 36 hour after legal sunrise and anytime during the season for hunting 37 waterfowl. 38 (C) It is unlawful to operate an airboat on the waters of that 39 portion of Lake Marion and Santee Swamp west of the I-95 bridge 40 upstream to the confluence of the Congaree and Wateree Rivers 41 during the season for hunting waterfowl.
1 [3654] 1 1 A person violating the provisions of this section, upon 2 conviction, must be punished as provided by Section 50-1-130. 3 The provisions of this section do not apply to the operation of 4 airboats by law enforcement, emergency medical, civil defense, 5 noxious weed control, military personnel, state and federally 6 approved wildlife banding, surveying, biological research 7 programs, and private waters.” 8 9 SECTION 2.
