TOWN OF PLEASANT VIEW FACILITY AND GROUP USAGE AGREEMENT

The undersigned agrees that it and its members using said facilities of the Town of Pleasant View will abide by all the rules and regulations from time to time in effect governing the use thereof. Rules and regulations attached.

The undersigned shall so conduct its activities upon the premises so as not to endanger any person lawfully thereon; and shall indemnify, save and hold harmless the Town of Pleasant View, Tennessee and all of their officers, agents and employees from any and all claims for losses, injuries, damages and liabilities to persons or property, however caused, while said premises and facility are under the control of the undersigned.

The undersigned will reimburse the Town of Pleasant View for any costs, expenses, or fees incurred in any litigation or negotiations prior to litigation, to which the Town of Pleasant View and/or their officers, agents, employees may be a party or be involved, caused by the acts of the undersigned or due to the accidents or occurrences against liability for which the undersigned hereby agreed to indemnify the Town of Pleasant View, their officers, agents and employees.

The undersigned hereby assumes full responsibility for the character acts, and conduct of all persons admitted to said premises by consent of the undersigned its officers, employees or agents.

The undersigned also agrees that if said premises, or the building, equipment or furnishings thereon, are damaged during the terms of this agreement, by the act, default or negligence of the undersigned, or its officers, agents, employees, guest, patrons or any person or person admitted to said facility by the undersigned, the undersigned shall pay to the Town of Pleasant View upon demand such sum as shall be necessary to restore said facility to the condition that it was in at the commencement of this agreement and to replace and to repair any equipment or furnishings so damaged.

The undersigned further agrees to leave such facility in a clean orderly manner and agrees to pay the Town of Pleasant View upon demand such sum as shall be necessary to restore such facility to a clean orderly manner.

It is understood that the Town of Pleasant View reserves the right to 1) cancel this agreement for any default by the undersigned in the terms of this agreement and 2) to reschedule the dates or time of permitted use of said facilities, for just cause, on ten days written notice to the undersigned mailed to the address set forth below.

It is understood that alcoholic beverages, smoking and firearms are strictly prohibited on all park property owned and operated by the Town of Pleasant View.

The undersigned is to pay $______in rental fees to the Town of Pleasant View prior to the subject date or this agreement is automatically voided.
