MINUTES WEST VIRGINIA BOARD OF EDUCATION Board Conference Room Capitol Building 6, Room 353 1900 Kanawha Boulevard, East Charleston, West Virginia August 14, 2013

I. Call to Order

Following the welcome, introductions and Pledge of Allegiance, President Gayle C. Manchin called the meeting of the West Virginia Board of Education (WVBE) to order at 10:04 a.m. on August 14, 2013, in the Board Conference Room, Capitol Building 6, Room 353, Charleston, West Virginia.

The following members were present: President Manchin, Vice President Michael I. Green, Secretary Robert W. Dunlevy, Tina H. Combs, Thomas W. Campbell, Lloyd G. Jackson II, and L. Wade Linger Jr. (via telephone), and ex officios James B. Phares, State Superintendent of Schools, Paul L. Hill, Chancellor, West Virginia Higher Education Policy Commission, and James L. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education. Member absent was William M. White.

II. Delegations

Ms. Barbara Thompson, member, West Virginia Schools for the Deaf and the Blind (WVSDB) Board of Advisors, and teacher, Putnam County Schools, addressed the Board regarding the relocation of the WVSDB and the needs of deaf and blind students. Mr. William D. Duty (distributed information), President of the Mingo County Board of Education, addressed the Board regarding the August 2013 Office of Education Performance Audits (OEPA) audit of Mingo County Schools. Ms. Christine Campbell, President, American Federation of Teachers-West Virginia, addressed the Board regarding Policy 5000. Mr. Scott Ingleton, Pastor of Meadow Bridge Lane Methodist Church, addressed the Board regarding the closure of Meadow Bridge High School. Ms. Stacy White, teacher at Meadow Bridge High School, and parent of students attending Meadow Bridge schools, addressed the Board regarding the Fayette County Comprehensive Educational Facilities Plan. Ms. Carolyn Arritt (distributed information), Fayette County citizen and former Fayette County educator, addressed the Board regarding Fayette County school facilities. III. Approval of Agenda

President Manchin requested a motion to approve the agenda. Mr. Jackson moved that the agenda be approved. Mr. Green seconded the motion and upon the call for the question the motion was carried unanimously.

IV. Cabell County/Harless Center Incubator School 2 Mr. William A. Smith (distributed information), Superintendent, Cabell County Schools, Dr. Stan Maynard, Executive Director, June Harless Center, and Senator Robert H. Plymale, Chair of the West Virginia Senate Committee on Education, addressed the Board regarding the Cabell County/Harless Center Incubator School. V. West Virginia's Living Monuments - the Courthouses

Ms. Patricia L. Hamilton, Executive Director, West Virginia Association of Counties, addressed the Board regarding the publication, West Virginia's Living Monuments - the Courthouses.

VI. Governor's Education Agenda

President Manchin, assisted by Ms. Donna Hoylman Peduto (via PowerPoint presentation and distributed information), WVBE Director of Operations, Dr. James B. Phares, State Superintendent of Schools, and members of the Board, provided an update regarding progress toward accomplishing the Governor's education reform agenda including the Commission on School District Governance and Administration (Mrs. Combs and Mr. Campbell provided remarks), Project 24 (Mr. Green provided remarks), cross counseling, using RESAs more efficiently, Preparation for Tomorrow initiative, early learning (Mr. Jackson provided remarks and a video regarding education and income status), teacher certification/professional development, leadership preparation and licensure and ongoing professional development. Superintendent Phares (distributed information) provided an update regarding policy development. Mr. Robert E. Hull, Associate Superintendent, Division of Teaching and Learning, provided an update regarding studies (planning periods and alternative certification) that have been undertaken in response to the Governor's education legislation. President Manchin requested Chancellor Hill and Chancellor Skidmore to provide information. Chancellor Hill (distributed information) and provided an update regarding HEPC collaborative work with the WVDE. Chancellor Skidmore provided an update regarding the community and technical college education system. (Copies appended to Official Minutes, Attachment AA.)

President Manchin called for a break for lunch at 12:20 p.m.

VIII. Call to Order

President Manchin called the meeting back to order at 12:58 p.m. President Manchin requested Dr. Kathy D’Antoni (distributed information), Associate Superintendent, Division of Technical and Adult Education, to provide remarks regarding the West Virginia Simulated Workplace Operational Manual. IX. Capacity Building for Low Performing Schools and Intervention Counties 3 Ms. Michele Blatt (distributed information), Executive Director, WVDE Office of School System Support, Mr. Ted Mattern, System Support Liaison, Office of the State Superintendent, Mr. Randy Keathley, Superintendent, Mingo County Schools, and Dr. K. Lynn Boyer, Superintendent, West Virginia Schools for the Deaf and the Blind, provided information regarding capacity building for a number of low performing schools, the intervention counties and the West Virginia Schools for the Deaf and the Blind. X. Consent Agenda

XI. Office of Education Performance Audit ~ Director's Information 4

Dr. Gus Penix (distributed information), Director of the Office of Education Performance Audits (OEPA), provided an update regarding the revision of Policy 2320, strategic plans for schools, and presented employment requests for the Board’s consideration. (Copy appended to Official Minutes, Attachment DD.)

XII. Education Performance Audit Report for the Mingo County School District

Dr. Penix (distributed information) reported that, as a result of official complaints to the WVBE regarding the Mingo County Board of Education, the WVBE voted to direct the OEPA to conduct a performance audit of the Mingo County School District. An Education Performance Audit of the Mingo County School District was conducted January 10 through January 14, 2005. The audit report was presented to the WVBE at the February 9, 2005, regular meeting. Based upon the results of the Education Performance Audit, the WVBE declared that a state of emergency existed in the school system and voted to issue Nonapproval status to the Mingo County School District. The WVBE deferred action on intervening into the operation of the Mingo County School District to allow its members time to fully review the audit report. The WVBE held a special meeting February 15, 2005, to discuss and take action regarding the Mingo County School District. At the February 15, 2005, meeting, the WVBE voted unanimously to re-intervene into the operation of the Mingo County School District. An Education Performance Audit of the Mingo County School District and the schools was conducted March 17 through March 22, 2013. The review was conducted at the specific direction of the WVBE. This report describes the Education Performance Audit Team’s assessment of progress made by the county school system in meeting the requirements for the Mingo County Board of Education to assume local control of the operation of the school system.

Dr. Penix recommended, because of the progress the county superintendent has made in establishing curriculum and organizational functions, the OEPA recommends that partial control be returned to the Mingo County Board of Education in the following areas: 1) curriculum, 2) the establishment of instructional programs, and, 3) the establishment and operation of a school calendar.

Dr. Penix further recommended, because of the need for developing capacity for board leadership, the OEPA recommends that the WVBE continue the Nonapproval status of the Mingo County School District and continue intervention in the following areas: 1) finance, 2) personnel, 3) facilities, 4) transportation, and 5) policy development.

The OEPA further recommended that the WVBE establish the following provisions and accountability measures for the Mingo County Board of Education to assume further control of the school district: 1) develop capacity of the Mingo County Board of Education to ensure that the board adheres to State Code and WVBE policies, and a system of personnel accountability is in place for the personnel functions; 2) the Mingo County Board of Education conduct meetings according to Open Governmental Proceedings, W. Va. Code §§6-9A-1 to 6-9A-12; 3) all members of the Mingo County Board of Education receive and apply training, provided by the Executive Director of the West Virginia School Board Association; 4) the OEPA conduct a specific review of the Mingo County Board of Education by June 30, 2014, according to guidelines stipulated in W. Va. Code §18-2E-5, to assess the board’s progress in transacting 5 meetings, adhering to WVBE policies, and demonstrating willingness to manage the affairs of the Mingo County School District in a fiscally responsible, ethical, and legal manner.

Discussion ensued regarding the recommendations; no action was taken regarding the recommendations. (Copy appended to Official Minutes, Attachment T and addendum.) Chancellor Skidmore departed the meeting.

XIII. West Virginia Secondary School Activities Commission (WVSSAC) Series 2, Athletics, Provisions Governing Eligibility Mr. Jackson and Vice President Manchin, assisted by Ms. Betty Jo Jordan, Executive Assistant to the State Superintendent, presented the West Virginia Board of Education Master Plan for Statewide Professional Staff Development 2013-2014 for the Board's

Mr. Charles K. Heinlein, Deputy State Superintendent, presented WVSSAC Series 2 for the Board's consideration. The West Virginia Legislature, during the 2013 regular session, amended W. Va. Code (Senate Bill 336) to require the WVSSAC to promulgate rules to address concussions and head injuries in interscholastic athletes. The proposed rule was presented to LOCEA on July 23, 2013. The amendment of this rule will result in the repeal of Series 2, Athletics, Provisions Governing Eligibility, that was to become effective September 10, 2013.

Mr. Dunlevy moved WVSSAC Series 2, as amended, be approved under emergency status and effective upon filing with the Secretary of State and that Series 2 be placed on public comment for 30 days. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachments L-1 and L-2.)

XIV. Resolution Authorizing RESA 1 to Apply to the U. S. Department of Education for a Transfer of the Former Social Security Administration Building

Ms. Heather Hutchens Deskins, General Counsel to the WVDE and WVBE, assisted by Dr. Robin J. Lewis (distributed information), Executive Director, and Mr. Shawn Cook, Adult Education Coordinator, RESA 1, presented a resolution authorizing RESA 1 to apply to the U. S. Department of Education for a transfer of the former Social Security Administration Building for the Board's consideration. RESA 1 sought the WVBE’s approval to apply for the acquisition of surplus federal real property for educational purposes, which is the former Social Security Administration Building at 214 N. Kanawha Street in Beckley, West Virginia. A federal statute, 40 U.S.C. § 484(k), authorizes the Secretary of the U.S. Department of Education to transfer or lease vacated federal property through an application process to states or political subdivisions of states, tax-supported institutions and nonprofits who will use it for education.

Mr. Green moved that the resolution authorizing RESA 1 to apply to the U. S. Department of Education for a transfer of the former Social Security Administration building on North Kanawha Street in Beckley, now vacant, be approved. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment M and addendum.)

XV. Sale of Vacated School Buildings and Offices in Williamson to the Mingo County Redevelopment Authority 6 on behalf of the Mingo County Commission Mr. Jackson and Vice President Manchin, assisted by Ms. Betty Jo Jordan, Executive Assistant to the State Superintendent, presented the West Virginia Board of Education Master Plan for Statewide Professional Staff Development 2013-2014 for the Board's

Ms. Hutchens Deskins presented the sale of vacated school buildings and offices in Williamson to the Mingo County Redevelopment Authority on behalf of the Mingo County Commission for the Board's consideration. The Mingo County Board of Education sought the WVBE’s approval to sell vacated school buildings and offices in Williamson to the Mingo County Redevelopment Authority on behalf of the Mingo County Commission, which intends to make use of the buildings.

Mr. Jackson moved that the sale of vacated school buildings and offices in Williamson to the Mingo County Redevelopment Authority on behalf of the Mingo County Commission be approved. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment Mc.)

XVI. Policy 5000, Procedures for Designated Hiring and Transfer of School Personnel Mr. Jackson and Vice President Manchin, assisted by Ms. Betty Jo Jordan, Executive Assistant to the State Superintendent, presented the West Virginia Board of Education Master Plan for Statewide Professional Staff Development 2013-2014 for the Board's

Ms. Hutchens Deskins presented Policy 5000 for the Board's consideration. The passage of Senate Bill 359 during the 2013 Regular Legislative Session requires the WVBE to establish an emergency rule on or before July 1, 2013, to comply with W. Va. Code §18A-4-7a and §18A-5A-5. This emergency rule sets forth general hiring criteria for classroom teachers, establishes processes that a faculty senate may adopt when making hiring recommendations for classroom teachers, clarifies certain transfer procedures, and outlines the roles of the principal, county superintendent, and county board of education in the limited hiring and transfer procedures. Emergency rule Policy 5000 was amended by the WVBE on July 17, 2013.

Mr. Jackson moved that action regarding Policy 5000 be tabled until August 15. Mrs. Combs seconded the motion and upon and the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment N-1 and N-2.)

XVII. Policy 4350, Procedures for the Collection, Maintenance and Disclosure of Student Data Mr. Jackson and Vice President Manchin, assisted by Ms. Betty Jo Jordan, Executive Assistant to the State Superintendent, presented the West Virginia Board of Education Master Plan for Statewide Professional Staff Development 2013-2014 for the Board's

Ms. Hutchens Deskins presented Policy 4350 for the Board's consideration. Policy 4350 is being amended to incorporate a change in the Family Education Rights and Privacy Act allowing caseworkers access to student records without parental consent if student is in child welfare agency’s legal custody.

Mr. Green moved that Policy 4350 be placed on public comment for 30 days. Mr. Dunlevy seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment O.) 7

XVIII. Policy 5310, Performance Evaluation of School Personnel Mr. Jackson and Vice President Manchin, assisted by Ms. Betty Jo Jordan, Executive Assistant to the State Superintendent, presented the West Virginia Board of Education Master Plan for Statewide Professional Staff Development 2013-2014 for the Board's

Ms. Blatt (distributed information) presented Policy 5310, with additional consistency of usage corrections, for the Board's consideration. The new educator evaluation system promotes professional growth and development that advances student learning in West Virginia schools. During the June board meeting, the policy was placed on a period of public comment. As a result of the comments received the following area was amended: the provision for evaluation of central office administrators that was inadvertently deleted in the repeal and replaced language was added to clarify the definition of teachers on the advanced progression.

Mr. Dunlevy moved that Policy 5310 be approved as amended. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment P and addendum.) XIX. West Virginia Support for Improving Professional Practice (WVSIPP)

Ms. Blatt presented WVSIPP plans for the Board's consideration. House Bill 4236, sponsored by Governor Tomblin in 2012, required counties to create a WVSIPP plan which documents their data-driven commitment to professional development and continuous support to all educators. It also allows flexibility for combining available funds (including mentoring funds) for that purpose. The Office of School Improvement has reviewed and recommended approval of the WVSIPP plans for each of the 55 counties plus the West Virginia Schools for the Deaf and the Blind. County plans can be accessed at the following WVDE website: http://wvde.state.wv.us/schoolimprovement/wvsipp-plans.html. Additionally, a “Best Practices” document can be found on the WVDE website to provide guidance on continuous improvement of the plans.

Mr. Green moved that the WVSIPP plans be approved. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously.

XX. Policy 2340, West Virginia Measures of Academic Progress Program

Mr. Hull presented Policy 2340 for the Board's consideration. The proposed changes to Policy 2340 reflect the name and numbering changes based on the federally-approved ESEA Flexibility Waiver, the inclusion of COMPASS, and a transition to online assessment.

Mrs. Combs moved that Policy 2340 be placed on public comment for 30 days. Mr. Green seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment Q.)

XXI. Repeal of Policy 5900, Beginning Educator Internship Program

Ms. Betty Jo Jordan, Executive Assistant to the State Superintendent, Office of the State Superintendent, presented the repeal of Policy 5900 for the Board's consideration. House Bill 3157, passed during the 2013 Regular Legislative Session, repealed various sections of state code. One such section was W. Va. Code §18A-3-2b which required professional development for beginning teachers and mentors to be provided by the Center for Professional Development 8 (CPD). Policy 5900 was the rule that the WVBE promulgated to implement W. Va. Code §18A-3-2b. The repeal of W. Va. Code §18A-3-2b was based upon new code that was enacted during the 2012 Regular Legislative Session. The new code, W. Va. Code §18A-3C-3 - Comprehensive system for teacher induction and professional growth, provides counties greater flexibility in the design and implementation of teacher induction and mentoring systems. Counties may still request training from the CPD but it is not required. Each of the 55 counties has developed a plan for the comprehensive system of support for improving professional practice; the plans have been reviewed by WVDE staff and are pending WVBE approval.

Mr. Campbell moved that Policy 5900 be repealed. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment R.)

XXII. Criteria for Approving Programs for Defeated and Discouraged Learners

Ms. Jordan presented criteria for approving programs for defeated and discouraged learners for the Board's consideration. H.B. 2861 amended W. Va. Code §18-2-6 by adding a new section (i) that” finds that the public schools should not be deterred from seeking and assisting with enrollment of students in an alternative program that helps remedy the discouragement, lessens skill deficits and facilitates a successful return to public school.” W. Va. Code §18-2-6(i) requires among other conditions that the alternative program be approved by the state board. The proposed criteria for approving the alternative program are: 1) the program is accredited by one of the following WVBE recognized accrediting agencies: AdvancED, Association of Christian Schools International, American Association of Christian Schools, Independent Schools Association of the Central States; 2) the program has submitted accrediting documentation to WVBE; 3) any alternative program that has begun the accreditation process but not yet received final accredited status must provide evidence regarding the portion of the accreditation process that has been completed. A one year conditional approval could be recommended pending a review by the WVDE and compliance with the remaining criteria; 4) the program has conducted a Criminal Investigation Bureau (CIB) background check on all employees; 5) the program has an independent Board of Directors; 6) the program provides adequate liability insurance; 7) the program complies with county and/or state health and fire safety laws; 8) the program receives an on-site visit by WVDE staff; 9) the program receives official approval during a regular WVBE meeting; and 10) approval of the program does not carry endorsement nor any obligation for the state or county to provide fiscal or other resources to the approved program.

Mr. Linger moved that the criteria for approving programs for defeated and discouraged learners be approved. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment S.)

XXIII. West Virginia Center for Professional Development (WVCPD) Strategic Plan for Advanced Placement

Ms. Karen Linville, West Virginia Center for Professional Development, and Mr. Joel Gulko, The College Board, presented the WVCPD's strategic plan for Advanced Placement for the Board's consideration. In July 2010, the WVBE accepted the WVCPD Advanced Placement Strategic Plan that covered the school years 2010-11 through 2013-2014. That strategic plan represented a partnership among the WVCPD, the WVBE, the WVDE, and the College Board. 9 The West Virginia Advanced Placement Leadership Team has recently revised the Advanced Placement Strategic Plan to reflect goals for Advanced Placement achievement through 2017-2018.

Mr. Jackson moved that the WVCPD's strategic plan for Advanced Placement be accepted. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment T.)

President Manchin called for a break at 3:05 p.m.

President Manchin called the meeting back to order at 3:20 p.m.

XXVI. Discussion regarding Pending Legal Matter in Jorea M. Marple v. West Virginia Board of Education Executive Session

President Manchin called for a motion to enter into executive session as provided in W. Va. Code §6-9A-4 [matters involving attorney client privilege per Peters v. County Commission, 205 W. Va. 481 (1999)] and stated that no action will be taken in executive session and that the meeting would recess following the return from executive session.

Mr. Green moved that the Board move into executive session as provided in W. Va. Code §6-9A-4 [matters involving attorney client privilege per Peters v. County Commission, 205 W. Va. 481 (1999)]. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously. The Board entered into executive session at 3:22 p.m. Mr. Campbell and Mrs. Combs exited the executive session. Mr. Campbell and Mrs. Combs entered the executive session at 3:45 p.m.

XXVII. Return from Executive Session

The Board returned from executive session at 4:50 p.m. President Manchin announced that no decisions were made or action taken.

XXVIII. Recess

President Manchin recessed the meeting at 4:51 p.m. and announced that the meeting would reconvene on August 15 at 9:00 a.m. in the same location.

XXIX. Reconvene

XXX. WVBE Personnel inclusive of Executive Director of Regional Education Service Agency (RESA) 4 Search and State Superintendent National Search

President Manchin introduced Mr. Daniel W. Greear, Office of the Attorney General, who announced that the law firm of Pullin, Fowler, Flanagan, Brown & Poe, PLLC, has been selected to assist in the State Superintendent National Search. Mr. Victor Flanagan, Pullin, Fowler, Flanagan, Brown & Poe, PLLC, addressed the Board regarding the State Superintendent National Search.

President Manchin called for a motion to approve the Board's personnel attachment. Mr. Dunlevy moved that the WVBE personnel matters found in the attachment be approved. Mr. Green seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment U)

XXXI. WVBE Regular Meeting Dates/Locations 2013-2014

President Manchin presented the Board's 2013-2014 meeting dates and locations for consideration. Discussion ensued regarding meeting locations (Mr. Campbell suggested meeting in Greenbrier County in August of 2014 during the State Fair). Mr. Linger departed the meeting.

Mr. Green moved that the WVBE regular meeting dates and locations found in the attachment for be approved. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment V.)

XXXII. Appointments to WVBE Statutory Units/Liaisons/Presidential Committees 2013-2014

President Manchin (distributed information) presented appointments to WVBE statutory units/liaisons/Presidential Committees for 2013-2014 for consideration. During President Manchin’s recitation of committee chairs and vice chairs, Mr. Linger was identified as the vice chair of the Accountability Committee which conflicted with the attachment. Discussion ensued regarding the conflicting information and it was determined that the attachment is correct and that Mr. Dunlevy, not Mr. Linger, is vice chair of the Accountability Committee.

Mrs. Combs moved that the WVBE appointments to WVBE statutory units/liaisons/Presidential Committees for 2013-2014 be approved. Mr. Jackson seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment EE.)

XXXIII. Budgetary Discussion 11

Superintendent Phares (distributed information), assisted by Mr. Terry Harless, Chief Financial Officer, WVDE Office of Internal Operations, and Mr. Joe Panetta, Assistant State Superintendent, Division of Student Support Services, presented a preliminary FY14 Budget and FY15 budget considerations for the Board's information/consideration. Mr. Campbell departed the meeting.

The meeting recessed due to a fire drill at 10:50 a.m. and reconvened at 11:07 a.m.

Mr. Panetta continued his presentation. Following the presentation President Manchin deferred action regarding budget to the WVBE Finance Committee and directed Superintendent Phares to meet with the WVBE Finance Committee in a timely manner. (Copy appended to Official Minutes, Attachment FF.)

XXXV. Call to Order

President Manchin called the meeting back to order at 12:03 p.m.

XXXVI. Policy 5000, Procedures for Designated Hiring and Transfer of School Personnel

President Manchin requested Ms. Hutchens Deskins present Policy 5000 (tabled earlier in the agenda) for the Board’s consideration. Ms. Hutchens Deskins reviewed changes made to the policy as a result of comments received during the comment period. Mr. Campbell joined the meeting. Discussion ensued regarding the newly proposed language “during that school year” at section 10 and the language “may be compensated” in section 7.3.

Mr. Jackson moved that: 1) Policy 5000 be approved as presented in Attachment N-1 with further amendment to language at section 7.3 - changing the word "may" to "shall" (shall be compensated), 2) the WVDE require county boards of education to transmit to the WVDE appropriate records regarding the cost of said compensation, 3) that a request be included in the improvement package to pay, retroactively, for said compensation costs, 4) the State Superintendent immediately convene a meeting with Berkeley County, as well as any other similarly affected counties, and the teacher organizations to address needs regarding the filling of positions (specifically in regards to language found at section 10) and, 5) the State Superintendent provide a report to the WVBE in October. Mr. Dunlevy seconded the motion and upon the call for the question the motion was carried unanimously. Mr. Dunlevy departed the meeting. (Copy appended to Official Minutes, Attachments N-1 and N-2.)

XXXVII. WVBE Procedural Matters

President Manchin led discussion regarding WVBE procedural matters including: 1) WVBE committees (Communications Committee/development of a media strategy and other WVBE committees) – it was determined that a Communications Committee was not necessary and that Ms. Cordeiro would contact appropriate members for emerging issues; 2) WVBE 12 Committee Status Reports – none were offered; 3) agenda development inclusive of monthly reports from the RESA Liaison (President Manchin requested members to continue their representation to assigned RESAs – RESA Executive Directors are to notify members in a timely manner of meetings), the Chancellors of HEPC and CCTC provided reports on August 14; 4) President Manchin provided an overview of current WVBE staff roles/responsibilities and indicated that position postings for legal counsel and a monitor of OEPA/WVSDB/ RESAs/institutional programs will be issued in the near future; 5) WVBE protocol - President Manchin requested feedback regarding reimbursement of expenses and stated her recommendation that posted meetings be eligible for reimbursement of expenses and per diems and that individually scheduled meetings are not eligible (Mr. Green requested clarification as to whether members should request a per diem for meetings via conference call that require a minimal amount of time); and 6), assisted by Ms. Peduto, provided information to regarding assistance to be provided to WVBE by the Appalachian Regional Comprehensive Center Technical Assistance. Mr. Campbell departed the meeting.

XXXVIII. Board Items for Future Consideration

President Manchin requested that items for future consideration be provided to her in advance of meetings and indicated that the Appalachian Regional Comprehensive Center and West Virginia Public Broadcasting, will provide presentations in October. XXXIX. Future Meetings

The next regular meeting of the WVBE will be held September 11, 2013, at the West Virginia Schools for the Deaf and the Blind in Romney, West Virginia. The meeting will continue on September 12, 2013, if the agenda is not completed on September 11, 2013. President Manchin provided an overview of events being planned for the September meeting.
