Check Testing Results July to December 2015

GEMS ACT COMPLIANCE: CHECK TESTING RESULTS JULY TO DECEMBER 2015

1. Purpose This report presents the results of check tests of models of GEMS products finalised between 1 July and 31 December 2015.

2. Background Check testing refers to activities undertaken to ensure that models of GEMS products meet the relevant determination’s GEMS level requirements, often referred to as minimum energy performance standards or MEPS; and the energy efficiency claims of manufacturers and suppliers. Check tests are conducted on behalf of the GEMS Regulator by National Association of Testing Authorities (NATA) accredited or affiliated laboratories either in Australia or overseas. 3. GEMS Products Check Tested The GEMS Regulator finalised the check tests of 41 models of the following nine GEMS products:

4. Check Test Results Twenty-four of the 41 models (59%) met the relevant determination’s GEMS level requirements and the energy efficiency claims of manufacturers and suppliers at the completion of Stage (1) check testing. Seventeen models (41%) did not.

In accordance with the GEMS Check Testing Policy, registrants of the 17 models failing the Stage (1) check test were given the choice to arrange for Stage (2) check testing or elect to cancel the registration of the models. 1 The registrants of five models: four self-ballasted compact fluorescent lamps and one clothes washing machine chose to arrange Stage (2) check testing that subsequently found those models met the relevant requirements and claims of the manufacturers and suppliers. No further action was required.

Twenty-nine models (71%) in total therefore met the relevant GEMS level requirements and energy efficiency claims of manufacturers and suppliers at the completion of Stage (1) and Stage (2) check testing. Twelve (29%) did not. The following graph depicts the percentages for each GEMS product.

Details of the 29 models that passed Stage (1) or Stage (2) check testing are included at Attachment “A”.

5. GEMS Regulator Responses In relation to the 12 models that did not meet requirements or claims, the GEMS Regulator responded as follows:

5.1. Cancel registrations The registrants of 12 models elected to cancel their registrations. Attachment “B” details these models and the reasons for the cancellations.

6. Registration Issues A number of models of GEMS products were unregistered at the time of check testing. The GEMS Regulator worked with manufacturers and suppliers of these models to ensure GEMS registration requirements were met.

7. Monitoring and Enforcing Compliance The GEMS Regulator reminds all suppliers of GEMS products of their obligations under the GEMS Act 2012. The GEMS Regulator, assisted by GEMS inspectors, monitors compliance with the GEMS Act via a GEMS Compliance Monitoring Program of check testing and market surveillance.
