Client : UBS Investment Bank Jan 2015 – June 2015 Role : Web Developer Project : ACT

Description:

In an effort to curb tax evasion, as related to US taxpayers hiding money in offshore accounts, the US Department of the Treasury and the Internal Revenue Service enacted FATCA (Foreign Account Tax Compliance Act) on March 18, 2010. These provisions were included in a broader piece of regulation, the Hiring Incentives to Restore Employment (HIRE) Act. Final FATCA regulation, also known as IRS Code Sections 1471-1474 or Chapter 4, were issued on Jan 17, 2013.

FATCA aims to improve tax compliance by equipping the US Govt. with the necessary tools to obtain information to US taxpayers who have offshore accounts or assets. Therefore, FATCA mandates that all foreign

SUSHMA Page 3 of 10 Financial Institutions (FFIs) register with the IRS, thereby agreeing to identity, collect and report informatin to the IRS. FATCA, which takes a "stick" approach, requires a 30% withholding or penalty tax on certain income earned by clients or entities that fail to comply with FATCA requirements.

ACT is the tax information reporting solution for NON-Qualified Intermediary (NQI) accounts. The IRS requires UBS as the broker to report income to US and Non-US clients on forms 1099 and 1042-S respectively. In the case of certain Non-US partnerships that may have US partners, the IRS requires reporting the allocated incomes directly to all the partners instead of the partnership.

Some partnerships have simple structures with a handful of beneficial owners while some have highly complex structures.
