The purpose of this letter is to provide you with the review agency responses to the above named development application that have been received to-date by Planning and Community Development.
You are encouraged to directly contact those agencies that did provide review comments if the comments require additional action by the applicant/applicant’s representative. You are also encouraged to directly contact those agencies that did not provide review comments if such response is required by state statutes and the El Paso County Land Development Code.

ELPASO COUNTY HEALTH DEPARTMENT
Please accept the following comments from El Paso County Public Health for the variance renewal referenced above:
Wastewater service for the existing house is provided by an onsite wastewater treatment system (OWTS) that El Paso County Public Health does not have a record; therefore, the size and location of the system components are unknown. These components must be located and must all be inside the property lines of the proposed 5 acre lot and meet the current OWTS Regulations installation setbacks. There must be sufficient area dedicated on the proposed lot for a secondary soil treatment area if the existing soil treatment area were to require repair/replacement. Water service for the existing house on the proposed 5 acre lot is a private individual well. The well must be 100’ minimum from the closest part of the soil treatment area, and at least 50’ from the septic tank.
El Paso County Public Health suggests that this OWTS information be submitted to Planning and Community Development prior to scheduling for hearing.

PIKES PEAK REGIONAL BUILDING DEPARTMENT
The El Paso County Assessors database states that the residential home & 2 commercial sheds/misc are under the address of 21430 Spencer Road. We believe all structures on this 40 acre parcel are under one address. The residence and commercial buildings can no longer share the same address. Provide a site plan of the entire 40 acres identifying all structure so that all addressing can be assigned properly. Current aerial view shows more structures, this is why we need clarification on structure locations. The final plat shows more structures by the office what are these? On the 5 acres what is the large shed structure being utilized for? FINAL PLAT STAGE: ENUMERATIONS/FLOODPLAIN WILL REVIEW THE MYLAR PRIOR TO PLAT FOR ADDRESS PLACEMENT, ROAD NAMING, TITLE BLOCK, & FLOODPLAIN STATEMENT. $10.00 PER LOT & TRACT FEE WILL BE DUE AT THE TIME OF THE REVIEW OF THE MYLAR. Whichever building keeps 21430 Spencer Road will not be assessed the $10.00 plat fee. CHECK SHOULD BE MADE OUT TO PIKES PEAK REGIONAL BUILDING DEPARTMENT. PAID DIRECTLY TO ENUMERATIONS DEPARTMENT. A COPY OF THE FINAL RECORDED PLAT IS REQUIRED PRIOR TO PLAN SUBMITTAL FOR RESIDENTAL. Mountain View Electric Association, Inc. (MVEA) has these comments about the following:
Project Name: Seigel Boys Racing Project Number: MS-17-003, P-17-002 Description: Approval is being requested for a minor subdivision along with rezone to allow an outdoor amusement center and a five acre residential lot. This parcel is located at 21430 Spencer Road in Section 22, Township 12 South, Range 63 West.
This area is within MVEA certificated service area. MVEA will continue to serve this area according to our extension policy. Information concerning connection requirements, fees and upgrades under MVEA line extension policy can be obtained by contacting the Engineering Department of MVEA.
MVEA has no objection to the minor subdivision or the rezone of this 40 acre parcel at 21430 Spencer Road in Calhan, CO.
MVEA has existing facilities within this parcel of land. If there is any removal or relocation of facilities it will be at the expense of the applicant.

COLORADO GEOLOGICAL SURVEY
Colorado Geological Survey has reviewed the SBR Racing minor subdivision referral. I understand the applicant proposes to subdivide a 40-acre parcel at 21430 Spencer Road, Calhan, creating a 35-acre parcel for the existing SBR Motorsports Park (an outdoor amusement center/go-kart racing track, Lot 1), and a five-acre parcel for an existing home, outbuilding, well, and septic system (Lot 2). The Letter of Intent (April 3, 2017) states that no change in use and density, and no “site modification/improvements, earth disturbing activities, or construction operations” are proposed. The available referral documents include an SBR Motorsports final plat (Eagle Land Surveying Inc., March 27, 2017), a Geology and Soils Report (RMG, September 21, 2017), and other documents.
RMG’s Geology and Soils Report provides a valid description of surface conditions and potential development constraints. CGS agrees that the site contains no surface conditions or geologic hazards that would preclude the existing and proposed uses and density. CGS therefore has no objection to approval of the two-lot minor subdivision as proposed.
Drainage modifications. An intermittent drainage/sand wash traverses the property from near the center of the northern property boundary toward the southeast. The dirt track appears to disrupt the drainage at two crossings. The county may wish to evaluate the impacts of disrupting this drainage on offsite flooding (all adjacent land is currently unimproved), erosion and sedimentation.

ELPASO COUNTY PARKS DEPARTMENT
The Planning Division of the Community Services Department has reviewed the development application for SBR Racing Minor Subdivision, Rezone, and Special Use Permit, and has the following comments of behalf of El Paso County Parks. This application will be presented to the Park Advisory Board on November 8, 2017. This application is a request for approval by Classic Homes on behalf of Lee Seigel for SBR Racing Minor Subdivision, a two lot minor subdivision totaling 40 acres. The applicant has also requested a concurrent zoning classification change from A-35 to A-5, as well as a special use permit to operate the outdoor amusement center and go-kart racing facility. The property is located on Spencer Road, east of Peyton Highway and north of Judge Orr Road.
The 2013 El Paso County Parks Master Plan shows no parks, trails/routes, or open space directly impacted by the proposed subdivision. The proposed Judge Orr Road Bicycle Route is located 2 miles south of the project site, while the Peyton Highway Bicycle Routes is located approximately 2.5 miles west of the site. The subject property is not located within any Candidate Open Space, although the Judge Orr Road Candidate Open Space is located approximately 2 miles west of the property.
El Paso County Parks staff recommends fees in lieu of land for regional park purposes in the amount of $814 as shown on the attached Subdivision Review Form.
Recommended Motion:
“Recommend to the Planning Commission and Board of County Commissioners that approval of the SBR Racing Minor Subdivision, Rezone, and Special Use Permit include the following condition: require fees in lieu of land dedication for regional park purposes in the amount of $814.”

Please address the comments as listed above. A detailed letter needs to accompany the revisions to allow for an expeditious re-review timeframe. The letter should include each comment listed above and, immediately thereafter, include a response from the applicant addressing the comment.
If any review agency has an issue that needs resolution or requires a revision, you will need to provide the necessary documents, drawings, etc., to the Planning and Community Development Department in the form of a resubmittal. The Planning and Community Development Department will then forward the resubmitted items directly to the appropriate review agency. If you have any questions pertaining to specific agency comments please contact the appropriate agency directly.
PLEASE NOTE: The application cannot be scheduled for public hearing until and unless a final response has been received by Planning and Community Development from those agencies that are required (pursuant to state statute and the El Paso County Land Development Code) to provide such response (i.e.- State Engineer’s Office, County Attorney’s Office, County Health Department, etc).
In order to be considered for the December 19, 2017 Planning Commission hearing, all outstanding issues must be resolved no later than November 28, 2017. In order to give the reviewers time to confirm that those outstanding issues have been resolved, revisions need to be submitted by November 14, 2017.
