[1096-2] 1 2 3 4 5 6 7 8 9 A BILL 10 11 TO AMEND SECTION 5051705 OF THE 1976 CODE, 12 RELATING TO CATCH LIMITS IMPOSED ON THE TAKING 13 OF CERTAIN FISH, TO IMPOSE CATCH LIMITS FOR 14 TAKING OR POSSESSING IN ANY ONE DAY A 15 COMBINATION OF SPOT, WHITING, AND ATLANTIC 16 CROAKER. 17 Amend Title To Conform 18 19 Be it enacted by the General Assembly of the State of South 20 Carolina: 21 22 SECTION 1. Section 5051705 of the 1976 Code is amended to 23 read: 24 25 “Section 5051705. (A) As used in this article, a day means 26 sunrise on one day to sunrise on the following day. 27 (B) The limits established in this article apply to all state 28 waters. 29 (C) It is unlawful for a person to take or have in possession 30 more than ten spotted seatrout in any one day. 31 (D) It is unlawful for a person to take or have in possession 32 more than three red drum in any one day. 33 (E) It is unlawful for a person to take or possess more than one 34 tarpon in any one day or a tarpon of less than seventyseven inches 35 in fork length. 36 (F) It is unlawful for a person to take or have in possession 37 more than five black drum (Pogonias cromis) in any one day. 38 (G) It is unlawful for a person to take or possess more than 39 fifteen flounder (Paralichthys species) taken by means of gig, 40 spear, hook and line, or similar device in any one day, not to 41 exceed thirty flounder in any one day on any boat.

[1096] 3 1 (H) It is unlawful for a person to take or have in possession 2 more than one weakfish (Cynoscion regalis) in any one day. 3 (I) It is unlawful for a person to take or possess more than ten 4 sheepshead (Archosargus probatocephalus) in any one day, not to 5 exceed thirty sheepshead in any one day on any boat. 6 (J) It is unlawful for a person to take or possess in any one day 7 more than fortyfive of a combination of the following: spot 8 (Leiostomus xanthurus), whiting (Menticirrhus spp.), and Atlantic 9 croaker (Micropogonias undulatus) taken by hook and line. 10 (J)(K) It is unlawful to take or possess hardhead catfish 11 (Ariopsis felis) or gafftopsail catfish (Bagre marinus). 12 (K)(L) It is unlawful to gig for spotted seatrout or red drum from 13 December first through the last day of February, inclusive. 14 (L)(M)The possession limits do not apply to the possession or 15 sale of properly identified fish imported by seafood dealers or 16 produced by permitted mariculture operations, or to possession as 17 allowed under permit authorized by this chapter.” 18 19 SECTION 2. This act takes effect upon approval by the 20 Governor. 21 XX 22
