Wivenhoe Town Council MINUTES of the Planning Committee held in the Council Chamber on th Tuesday 12 September 2017 at 7.30pm.

Apologies for absence. Apologies for absence were received from Cllr. A. Vaughan.

1. Minutes of the meeting held on Tuesday 15th August 2017. Cllr Aldis pointed out that an amendment needed to be made regarding the length of time the Local Plan had been with CBC. Therefore it was agreed that the minutes were to be reviewed at the next Planning Meeting.

2. To consider planning applications received from the Borough Planner for the observations of the Town Council. 4 Applications were received and considered.

COL 172168 REGISTERED 9th August 2017 Chris Harden Proposal: Application to discharge conditions 3 and 4 of planning consent 170753 Address: 1-2 The Folly, Wivenhoe Colchester CO7 9DB Applicant: Mr & Mrs Macaskill Recommendation: The fact that Planning Services have not taken into consideration Wivenhoe Town Council’s comments regarding encroachment on the highway level is especially unconstructive as Wivenhoe Town Council are in dialogue with the ECC PROW officer regarding this. This revised application shows impingement onto more space. Wivenhoe Town Council are concerned about access for high sided vehicles, especially emergency vehicles.

Action Point: Clerk to source PROW map of quay. Cllr. Read agreed to forward email with this information to Clerk.

COL 172192 REGISTERED 22nd August 2017 Mark Russell Proposal: Carry out a remodelling scheme for the dwelling, which includes the following work; internal re-planning of ground, first and second floor; minor alterations to east street frontage, adding exposed timber & render panelling; remodelling of the south el Address: Swatchways, The Quay, Wivenhoe, CO7 9BU Applicant: Mr & Mrs Blaxill Recommendation: OBJECTION: Wivenhoe Town Council wish the original objection to Application 170304 to be considered. In addition WTC would like input from heritage regarding the proposal and setting to ensure that the building being removed is not of historical significance. There are concerns that the additional dorma window will overlook adjacent properties. Proposal is in a Conservation area. Views of neighbours also to be taken into consideration.

COL 172245 REGISTERED 25th August 2017 Bruce O’Brian Proposal: Erection of a replacement dwelling with associated parking facilities following the demolition of the existing. Address: 4 De Vere Close, Wivenhoe, CO7 9AX Applicant: Mr & Mrs A Sherwood Recommendation: There are concerns regarding overlooking. Due to the geographic location of the proposal it is impossible to consider this application without a street scene view.

172194 - Application to part discharge of condition 3 of planning application 170958 COL 170958 REGISTERED 05/04/17 Mark Russell Proposal: Demolition of redundant commercial building and erection of one pair of semi-detached two- storey houses, car parking and landscaping. Address: 15-16 Nelson Close, Wivenhoe, CO7 9FN. Applicant: The Kemble Family Settlement. Recommendations: Concern over loss of commercial premises when they are needed for the vitality of the town. Need to ensure Section 106 contributions are received. DECISION: Accepted with 14 conditions. Condition 3. No works shall take place until an investigation and risk assessment, in addition to any assessment provided with the planning application, has been completed in accordance with a scheme to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The contents of the scheme are subject to the approval, in writing, of the Local Planning Authority. The investigation and risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The written report is subject to the approval in writing of the Local Planning Authority. The report of the findings must include: (i) a survey of the extent, scale and nature of contamination, including contamination by soil gas and asbestos; (ii) an assessment of the potential risks to: • human health, property (existing or proposed) including buildings, crops, livestock, pets, woodland and service lines and pipes, • adjoining land, • groundwaters and surface waters, ecological systems, • archaeological sites and ancient monuments; (iii) an appraisal of remedial options, and proposal of the preferred option(s). This must be conducted in accordance with DEFRA and the Environment Agency’s ‘Model Procedures for the Management of Land Contamination, CLR 11’ and the Essex Contaminated Land Consortium’s ‘Land Affected by Contamination: Technical Guidance forApplicants and Developers’. Reason: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors

Recommendation: No comment.

4 To receive the decisions of the Planning Authority on applications previously considered by the Town Council. 10 decisions were received.

COL 171083 REGISTERED 8 May 2017 Eleanor Moss Proposal: Reconstruction of garage and extensions to rear of bungalow and creation of rooms within roof. Address: 38 Stanley Road, Wivenhoe Colchester CO7 9LP Applicant: Mr & Mrs Martin Tarala Recommendations: Insufficient evidence provided. Wivenhoe Town Council would need to see a clear site plan to know if development falls into permitted boundaries. Concerns about overlooking issues, over development of site, site not in keeping with street scene, minimum parking standard. DECISION: Approve 2 conditions

COL 171936 REGISTERED 20 July 17 Lucy Mondon Proposal: Proposed Signs saying: University of Essex, Colchester Entrance, Wivenhoe Entrance. (Advertisement Consent) Address: University of Essex, Wivenhoe Park, Colchester, CO4 3SQ Applicant: University of Essex Recommendation: Objection Wivenhoe Town Council agree with the points in the objection from Wivenhoe Society. -The proposed fences are not in keeping with the character of the park grounds. -The land on the Boundary Road corner appears to belong to Highways. As the signs are also positioned in such a way to impinge on sightlines of road users Wivenhoe Town Council are concerned that this will impact on the safety of cyclists and pedestrians and could cause accidents and request that Highways comment on this application. - The signs will be externally illuminated which could cause light pollution problems for residents on Colchester Road near to the turning into Boundary Road. The Town Council also have concerns about the impact on the environment caused by removal of hedges. DECISION: Withdrawn

COL 171691 REGISTERED 28/06/2017 Chris Harden Proposal: Conversion of existing house into a 4 bed house and the side wing into a 2 bed assisted living house. Address: 1 Denham Close, Wivenhoe Colchester CO7 9NS

3 Applicant: Mr Paul Kent. Recommendation: Objection Wivenhoe Town Council are concerned that can not be viewed as a side wing to the existing house but is clearly 2 separate dwellings that need minimum parking standards applied to each. In addition the architects plan does not show where stairs arrive on first floor. Site will not comply with minimum parking standards. It is also noted that garden space would be limited and would not be in keeping with neighbouring amenity spaces. This is also contrary to policy standards and an indication that the site would be overly developed and too cramped for the context within which it sits. Wivenhoe Town Council note that CBC have refused applications for the above material reasons previously. DECISION: Approve 3 conditions

COL 171689 REGISTERED 24/06/2017 Mark Russell Proposal: Householder notification for a proposed rear extension measuring at 4.9m from the original rear wall, height to be at 3.6m and eaves to measure at 2.6m from the ground level. Address: 20 Broomfield Crescent, Wivenhoe Colchester CO7 9PZ Applicant: Christine Bianco Recommendation: Views of neighbours to be considered. DECISION: Application for Prior Approval Refused. Whilst no objections have been received, the proposal falls outside of the provisions of Schedule 2, Part 1, Class A. paragraph g (i) of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) in that, when combined with the existing outbuilding to which it would be attached, the proposed extension would measure approximately 10 metres (as opposed to the six metres permitted by that part of the order). The applicant is advised that a full planning application is required for this proposal.

COL 171769 REGISTERED 17/07/2017 Nadine Calder Proposal: Two storey side extension. Address: 1 Westlake Crescent, Wivenhoe, CO7 9RZ. Applicant: Mr & Mrs M Woodland. Recommendations: Views of neighbours taken into consideration. DECISION: Approve 4 conditions.

5 Section 106 and CIL Monitoring Cllr. Read reported that the Clerk has tried to calculate amounts remaining but that the CBC reports do not make it clear what is available and what the borough spent. Cllr. Aldis reported that the Congregational Church have applied for monies for a kitchen refurbishment. Cllr. Tile asked if 106 monies could be used towards the pontoon and there was a discussion about the pontoon as CBC have queried the paperwork. Action Point: Clerk to contact D Cameron of CBC Planning Services to invite him to speak to committee and explain reports and S106 availability. Action Point: Clerk to write to the Marine Management Organisation and request copies of any relevant paperwork. Cllr. Tile to request examples of relevant paperwork from CBC and if possible to arrange a meeting with assistance from Clerk.

6 Neighbourhood Plan. Nothing to report.

7 Decision on purchase of large screen for Planning Meetings (for WTC). Cllr. Singleton reported that his offices were moving and an 80 inch flatscreen Full HD Sharp TV had become available which could be put on the Chamber wall to assist with displaying information during meetings. As this is another public sector organization he has asked regarding a “transfer of inventory” which would mean making a small donation in kind. Cllrs. Aldis and Newton reported that it had been agreed that Planning would have a small spend of up to about £1500 at a meeting 2 years ago.

It was proposed by Cllr. Aldis, seconded by Cllr. Newton and AGREED unanimously that

4 Cllr. Singleton should be able to spend up to £500 on a new screen and any extra equipment available.

8 EE Mast. No CBC Planning consultation Cllr. Vaughan reported that a resident had spotted the mast on the CBC planning site. The application was withdrawn but CBC reported that as the mast was under 25m that no permission was required therefore WTC were not consulted. The Clerk confirmed that she had contacted the Planning Officer who reported that CBC did not need to consult. Cllrs. were concerned about possible emissions from masts. Cllrs Tile and Singleton agreed to ask about when the changes historically came in regarding consultations on masts. Cllr. Aldis suggested getting a CBC member to ask.

Action Point: Cllr. Tile to draft a query and Cllr. Singleton to provide relevant documentation and information.
