Title 2 of the 1976 Code is amended by adding: 27 28 “CHAPTER 67 29 30 South Carolina Medal of Honor 31 32 Section 26710. This chapter must be known and may be cited 33 as the ‘South Carolina Medal of Honor Act of 2011’. 34 35 Section 26720. (A) There is created the South Carolina Medal 36 of Honor to be awarded to a South Carolinian, or an individual 37 with certain ties to South Carolina, who was killed either while 38 serving in or deploying to a combat zone. The South Carolina 39 Medal of Honor is awarded on behalf of the people of the State of 40 South Carolina and is presented to the families of these fallen 41 service members.

[4330] 2 1 (B) The South Carolina Medal of Honor may be awarded on 2 behalf of the people of the State of South Carolina to an individual 3 who was killed in action or died while: 4 (1) engaged in an action against an enemy of the United 5 States; 6 (2) engaged in military operations involving conflict with an 7 opposing foreign force; 8 (3) served with friendly foreign forces engaged in an armed 9 conflict against an opposing armed force in which the United 10 States is not a belligerent party; or 11 (4) served in, or was in the process of deploying to, an area 12 where hostile fire pay or imminent danger pay was authorized 13 pursuant to federal law or regulation. 14 (C) Recipients of the South Carolina Medal of Honor shall 15 have their names entered on the South Carolina Medal of Honor 16 roll, which is to be maintained by the Adjutant General of the State 17 of South Carolina. 18 (D) Individuals eligible to receive the South Carolina Medal of 19 Honor include: 20 (1) members of the South Carolina National Guard who 21 were legal residents of South Carolina at the time of their death; 22 (2) members of a Reserve Component of the United States 23 Armed Forces who were legal residents of South Carolina at the 24 time of their death; 25 (3) members of the regular United States Armed Forces who 26 were: 27 (a) legal residents of South Carolina at the time of their 28 death; or 29 (b) stationed in South Carolina by a proper order of the 30 United States Department of Defense at the time they were killed 31 in action; or 32 (4) members of the South Carolina National Guard, a regular 33 or reserve component of the United States Armed Forces who: 34 (a) attended a public or private educational institution in 35 South Carolina at some period during their lives; and 36 (b) were killed or died as described in subsection (B) 37 (E) The South Carolina Medal of Honor shall be awarded 38 solely by a concurrent resolution: 39 (1) introduced by: 40 (a) the President Pro Tempore of the Senate; or 41 (b) the Speaker of the House of Representatives; and 42 (2) adopted by both houses of the General Assembly.” 43
