EXPLOITATION RIGHTS LICENCE AGREEMENT

For the use of existing copyrighted material

Foreword This Agreement is intended to secure the legal protection of the results of CEN’s European standardization activities. This Agreement must be signed when contributors to the standardization activities of CEN hold copyright on a Work that is considered to be a 'significant element' of the technical content of a CEN deliverable and needs to be incorporated into it. 'Significant element' is understood to be an essential contribution to the CEN deliverable that may represent more than 5 % of the technical content of the same. However, TC Chairmen / WG Convenors may also decide as appropriate to request this Agreement to be signed to guarantee CEN legal protection on copyrighted Work representing less that 5 % of the technical content of the CEN deliverable. This Agreement does not apply to the Work produced by ISO (International Organization for Standardization) or by a national member of CEN that has to be incorporated into a CEN technical deliverable.

Licence Agreement

1. This Agreement is concluded in the framework of the Berne Convention for the protection of literary and artistic works between the European Committee for Standardization (CEN) and the copyright owner (the Licensor) as indicate hereafter. 2. CEN shall develop and publish technical deliverables as defined in paragraph 1.2 of the CEN/CENELEC Internal Regulations Part 2 that require the incorporation of all or a part of the literary work (referred to as ‘the Work’), the copyright of which is owned by the Licensor:

(insert name of the Licensor), It is hereby agreed that: (a) The Licensor warrants that the Work is his original work, not copied wholly or substantially from any other work or material and that he is the legal owner having the right to grant this License. (b) The Licensor grants to CEN the irrevocable non-exclusive License (and power to sub- license to others) to use, change and adapt the Work in the development, publication and revision of CEN technical deliverables thereof. (c) The Licensor agrees that in case he continues exploiting his own copyright of the Work, he shall refrain to undertake any act that may directly or indirectly adversely affect the exploitation of the related CEN technical deliverable.

3. This License is granted free of charge worldwide and covers all languages and all forms of exploitation known at present, in particular and non-restrictively: publication, reproduction and adaptation by all means and all graphical support systems, by print, press, photocopy, microfilms, and via all magnetic, electronic and numerical support systems, memory cards, CD-ROMs, DVDs, Blu-Rays, films, photographs, slides, teledistribution, cable, satellite, web applications and on-line document servers and networks, distribution, sub-distribution, translation, derive revenue from duplication, communication to the public in total or in part, in summary or with comments, transfers of exploitation licenses to third parties. 4. The Licensor agrees that CEN deliverables containing all or part of the Work of the Licensor may be published without mention of his/her name. 5. The Work to which this Agreement applies is known as:

6. This Agreement is subject to the Belgian law. Disputes arising with regard the interpretation of this Agreement and/or the obligations that ensue from it shall be brought before the competent court. This Agreement enters into force from the date of the last signature.
