Responses to Submitted Questions

Q1) What is the billing fee associated with the Psychological Evaluations? A) The County is asking the bidder to state their flat billing fee for each completed evaluation.

Q2) Is there a peak period for recruitment? A) There is no peak period.

Q3) Page 5 of the RFP, Section II.C.2. states: Bidder/Practitioner must be regularly and continuously engaged in providing post-offer, pre-employment psychological evaluation services for public agencies in California for five (5) of the past seven (7) years. Can the County clarify what is meant by regularly and continuously? A) It means that the vendor performs pre-employment psychological evaluations multiple times each year. Once a year does not constitute regularly and continuously.

Q4) Does the County expect the vendor to have completed a specific number of evaluations? A) The County does not require a specific number,, however, the County would like to know how many evaluations the vendor has done for specific agencies and/or for specific job classifications, and if the agencies are of a similar size and scope to the County.

Q5) Would a vendor be ineligible to bid if that vendor has not regularly and continuously provided post-offer, pre-employment psychological evaluation services? A) A vendor is ineligible to bid if they do not meet this qualification. However, the vendor may partner with a vendor who meets the requirements.

Q6) Page 6, Section II.D.3 states: Bidder/Practitioner shall conduct evaluations at an office within the County of Alameda or provide an alternate East Bay location acceptable to the County. In terms of logistics, does the County expect evaluations to be done on-site at a County facility? County of Alameda, General Services Agency – Purchasing RFP No. 900443, Addendum No. 1

A) Evaluations are not conducted at County facilities or offices. Evaluations are to be performed at a location provided by the vendor in Alameda County or at an alternative East Bay location acceptable to the County.

Q7) Page 7, Section II.D.19 states: Bidder/Practitioner shall assist in the defense of all legal challenges to assessments and recommendations at no additional cost to the County. After the contract ends, is the vendor still required to defend legal challenges? And if so, for how long is the vendor obligated to do so? A) The vendor is required to defend legal challenges while the contract is in effect, and continue for one year following the contract expiration date.

Q8) Page 7, Section II.D.20 states: Bidder/Practitioner shall store and maintain all test files in a secure manner for the life of the contract at no additional cost to the County. At the end of the contract, the Bidder/Practitioner shall forward all test files to the County. Such files contain all interview information, including medical, psychiatric, and psychological information that would not normally be readily accessible to the employer. Where would the County store these files? A) The files would be kept in confidential Risk Management file storage.

Q9) Is the County okay with electronic files? A) Yes.

Q10) What does the County consider adequate testing? Can the County provide guidelines for how much testing, the length of testing, the type or choice of testing, etc.? A) Page 8, Section D, No. 9, list the tests currently administered. The list represents the minimum types and number of tests to be used. If a vendor is proposing additional tests or substituting tests, other than those listed, they are required to provide supporting information for those tests.

Exhibit M, Section I, Description of Proposed Test and Evaluations, explains what the County expects the bidder to include in their test selection submittal.

Q11) Do you allow computerized testing, such as online forms? A) The County will accept computerized testing as long as the system is secured. Q12) Page 8, Section II.F.1 states: A written report for each candidate must be completed within 10 business days of the end of the evaluation process. Sometimes, certain follow-ups can be necessary that would need to extend that 10-day period. How strict is the County with that 10-day period? A) The vendor is required to issue their findings within the 10-day period. If additional information or testing is needed, it should be noted in the report along with the timeline as to when the final report will be completed.

Q13) As part of the contract, does the County expect follow-up for people who are not selected as part of the process? Or is feedback given by the County to the vendor? A) The County will notify the candidates if they are not selected, but will not give any feedback.

Q14) For candidates that go through the evaluation process but are not selected by the County, do they address their concerns with the vendor or with the County? A) Candidates should address their concerns to the County.

Q15) Does the County use multiple criteria to select candidates or is there just the psychological evaluation? A) Yes, multiple criteria, such as background checks, written tests, physical agility tests, medical tests, psychological tests, and interviews are used.

Q16) Is the County pro-active in discussing why candidates are not selected, or do they just file the evaluation? Does the County discuss with candidates why they were not selected? A) A department/agency may request clarification from the vendor/evaluator. However, the County does not discuss with candidates why they were not selected. A letter is sent by the department to the candidate stating they do not meet all required job standards.

Q17) How frequently are assessments performed? A) As indicated in Exhibit B, Bid Form, the County estimates an annual average of 216 assessments. Monthly numbers can vary widely from month to month and the economy may affect future recruitments.

Q18) Will the contract be awarded to a single vendor? Or can there be multiple vendors? A) The County intends to award a single contract, however, a vendor may partner with another vendor.

Q19) Who is the current vendor? A) Law Enforcement Psychological Services (LEPS).

Q20) Will the current vendor’s fee be made available to other bidders? A) The current fee is $350 per exam. County of Alameda, General Services Agency – Purchasing RFP No. 900443, Addendum No. 1

Q21) The RFP states that all appointments for psychological evaluations need to be scheduled within 3 business days. Does this mean that both the testing and the interview need to be completed within 3 days? A) The contractor must set up an appointment within three days of the request. The exam date does not have to be within the three days.

Q22) The RFP states that "bidder shall schedule face-to-face interviews allowing sufficient time to cover background checks, test results and follow up questions." Who conducts the background checks? A) The County departments do the background checks prior to scheduling the psychological evaluations.

Q23) What is the timing of these checks relative to the testing and interview process? A) Background checks should be done prior to psychological evaluations or simultaneously so that information can be shared/compared.

Q24) The RFP states that bidder "shall assist in the defense of all legal challenges to assessments and recommendations at no additional charge to the County." How many legal challenges have there been per year in recent years? A) None.

RFP No. 900443, Pre-employment Psychological Evaluation & Services Addendum No. 1

The County of Alameda is soliciting bids from qualified vendors to furnish its requirements per the specifications, terms and conditions contained in the above referenced RFP number. This Bid Acknowledgement must be completed, signed by a responsible officer or employee, dated and submitted with the bid response. Obligations assumed by such signature must be fulfilled. 1. Preparation of bids: (a) All prices and notations must be printed in ink or typewritten. No erasures permitted. Errors may be crossed out and corrections printed in ink or typewritten adjacent and must be initialed in ink by person signing bid. (b) Quote price as specified in RFP. No alterations or changes or any kind shall be permitted to Exhibit B, Bid Form. Responses that do not comply shall be subject to rejection in total. 2. Failure to bid: If you are not submitting a bid but want to remain on the mailing list and receive future bids, complete, sign and return this Bid Acknowledgement and state the reason you are not bidding. 3. Taxes and freight charges: (a) Unless otherwise required and specified in the RFP, the prices quoted herein do not include Sales, Use or other taxes. (b) No charge for delivery, drayage, express, parcel post packing, cartage, insurance, license fees, permits, costs of bonds, or for any other purpose, except taxes legally payable by County, will be paid by the County unless expressly included and itemized in the bid. (c) Amount paid for transportation of property to the County of Alameda is exempt from Federal Transportation Tax. An exemption certificate is not required where the shipping papers show the consignee as Alameda County, as such papers may be accepted by the carrier as proof of the exempt character of the shipment. (d) Articles sold to the County of Alameda are exempt from certain Federal excise taxes. The County will furnish an exemption certificate. 4. Award: (a) Unless otherwise specified by the bidder or the RFP gives notice of an all-or-none award, the County may accept any item or group of items of any bid. (b) Bids are subject to acceptance at any time within thirty (30) days of opening, unless otherwise specified in the RFP. (c) A valid, written purchase order mailed, or otherwise furnished, to the successful bidder within the time for acceptance specified results in a binding contract without further action by either party. The contract shall be interpreted, construed and given effect in all respects according to the laws of the State of California. 5. Patent indemnity: Vendors who do business with the County shall hold the County of Alameda, its officers, agents and employees, harmless from liability of an nature or kind, including cost and expenses, for infringement or use of any patent, copyright or other proprietary right, secret process, patented or unpatented invention, article or appliance furnished or used in connection with the contract or purchase order. 6. Samples: Samples of items, when required, shall be furnished free of expense to the County and if not destroyed by test may upon request (made when the sample is furnished), be returned at the bidder’s expense. 7. Rights and remedies of County for default: (a) In the event any item furnished by vendor in the performance of the contract or purchase order should fail to conform to the specifications therefore or to the sample submitted by vendor with its bid, the County may reject the same, and it shall thereupon become the duty of vendor to reclaim and remove the same forthwith, without expense to the County, and immediately to replace all such rejected items with others conforming to such specifications or samples; provided that should vendor fail, neglect or refuse so to do the County shall thereupon have the right purchase in the open market, in lieu thereof, a corresponding quantity of any such items and to deduct from any moneys due or that may there after come due to vendor the difference between the prices named in the contract or purchase order and the actual cost thereof to the County. In the event that vendor fails to make prompt delivery as specified for any item, the same conditions as to the rights of the County to purchase in the open market and to reimbursement set forth above shall apply, except when delivery is delayed by fire, strike, freight embargo, or Act of God or the government. (b)Cost of inspection or deliveries or offers for delivery, which do not meet specifications, will be borne by the vendor. (c) The rights and remedies of the County provided above shall not be exclusive and are in addition to any other rights and remedies provided by law or under the contract. 8. Discounts: (a) Terms of less than ten (10) days for cash discount will considered as net. (b) In connection with any discount offered, time will be computed from date of complete, satisfactory delivery of the supplies, equipment or services specified in the RFP, or from date correct invoices are received by the County at the billing address specified, if the latter date is later than the date of delivery. Payment is deemed to be made, for the purpose of earning the discount, on the date of mailing the County warrant check. 9. California Government Code Section 4552: In submitting a bid to a public purchasing body, the bidder offers and agrees that if the bid is accepted, it will assign to the purchasing body all rights, title, and interest in and to all causes of action it may have under Section 4 of the Clayton Act (15 U.S.C. Sec. 15) or under the Cartwright Act (Chapter 2, commencing with Section 16700, of Part 2 of Division 7 of the Business and Professions Code), arising from purchases of goods, materials, or services by the bidder for sale to the purchasing body pursuant to the bid. Such assignment shall be made and become effective at the time the purchasing body tenders final payment to the bidder. 10. No guarantee or warranty: The County of Alameda makes no guarantee or warranty as to the condition, completeness or safety of any material or equipment that may be traded in on this order.
