[4641-2] 1 2 3 4 5 6 7 8 9 A BILL 10 11 TO AMEND SECTION 5911250, AS AMENDED, CODE OF 12 LAWS OF SOUTH CAROLINA, 1976, RELATING TO 13 INSTATE TUITION RATES FOR MILITARY PERSONNEL 14 AND THEIR DEPENDENTS UNDER CERTAIN CONDITIONS, 15 SO AS TO REVISE THE CRITERIA UNDER WHICH 16 VETERANS WHO ARE HONORABLY DISCHARGED AND 17 THEIR DEPENDENTS MAY RECEIVE INSTATE TUITION 18 RATES. 19 20 Be it enacted by the General Assembly of the State of South 21 Carolina: 22 23 SECTION 1. Section 5911250 of the 1976 Code, as last amended 24 by Act 246 of 2010, is further amended to read: 25 26 “Section 5911250. (A) Notwithstanding another provision of 27 law, during the period of their assignment to duty in South 28 Carolina, members of the Armed Services of the United States 29 stationed in South Carolina and their dependents are eligible for 30 instate tuition rates. When these armed service personnel are 31 ordered away from the State, their dependents are eligible for 32 instate tuition rates as long as they remain continuously enrolled at 33 the state institution in which they are enrolled at the time the 34 assignment ends or transfer to an eligible institution during the 35 term or semester, excluding summer terms, immediately following 36 their enrollment at the previous institution. In the event of a 37 transfer, the receiving institution shall verify the decision made by 38 the student’s previous institution in order to certify the student’s 39 eligibility for instate tuition rates. It is the responsibility of the 40 transferring student to ensure that all documents required to verify 41 both the previous and present residency decisions are provided to 42 the institution. These persons and their dependents are eligible for

[4641] 3 1 instate tuition rates after their discharge from the armed services 2 even though they were not enrolled at a state institution at the time 3 of their discharge, if they have evidenced an intent to establish 4 domicile in South Carolina and if they have resided in South 5 Carolina for a period of at least twelve months immediately 6 preceding their discharge. 7 (B) In addition to the provisions of subsection (A), a veteran of 8 the Armed Services of the United States who has been honorably 9 discharged , and their dependents, who are not otherwise eligible 10 for instate tuition rates, are entitled to receive instate tuition rates 11 at state institutions provided that within two years of the date of 12 discharge, they enroll at a state institution and have evidenced an 13 intent to establish domicile in South Carolina. These individuals 14 are eligible for instate tuition rates as long as they remain 15 continuously enrolled at a state institution or transfer to an eligible 16 institution during the term or semester, excluding summer terms, 17 immediately following their enrollment at the previous institution, 18 subject to provisions concerning such transfers as provided for in 19 subsection (A).” 20 21 SECTION 2. This act takes effect upon approval by the 22 Governor. 23 XX 24
