Although Frank did receive money from his wife while incarcerated, he has been out now for over one year and does not report any financial assistance for his family, or himself. The defendant states his father has used street drugs as well as been physically violent to his sister. Jody also illustrates a pattern of destructive behavior with ongoing alcohol usage. Yes, although Frank likes where he lives, there are frequent, documented police calls to the neighborhood. Leisure/recreation 30. Absence of recent participation in an organized activity? The defendant does not do anything of structure with any pro-social individuals that were reported. He did organize and participate in a gambling league while incarcerated, however that was over one year ago. 31. Could make better use of time? Despite working full time, Frank states that he likes to hang at the library. Recently his internet usage at the library was the foundation for his latest revocation hearing. This would score as a 1. Companions 32. A social isolate? No, Frank is able to maintain relationships fairly easily. 33. Some criminal acquaintances? Yes, Frank has criminal acquaintances from prison. 34. Some criminal friends? Yes, Frank has criminal acquaintances from prison, and mentioned his friends from prison helped him get his current job. He equates criminal activity to having fun, and blames his anti-criminal friends with not having fun in awhile, therefore doesn’t hang out with them any longer. 35. Few anti-criminal acquaintances? No. Frank does state that he has friends that haven’t been in trouble in the court system, however, they also feel he was “framed” and blame the victim. Additionally, he references his wife as being anti-criminal when clearly her problematic behavior has not been law abiding. 36. Few anti-criminal friends? No. Frank mentions friends that he has had in the past that appear to possibly be pro-social on some levels, but he does not spend time with them due to their children and him not being able to have contact with children. He also interjects that they have had to “sacrifice” the good things in life due to family commitments. Therefore, he rejects many of the anti-criminal behaviors overall and likely would not seek these people out for friendships, even if he had the ability. Alcohol/Drug 37. Alcohol problem, ever? Yes, this is evidenced by his report, and criminal history. 38. Drug problem, ever? No, although Frank self reports to experimenting with drugs, he reports to not having any issue with drugs that would appear to be valid based upon his criminal history and other domains. 39. Alcohol problems, current? Frank reports sobriety since he was released from incarceration. There have been violations to indicate otherwise. Does share some insight into the consequences of what this behavior would lead to if he did engage in it again. Scored a 2. 40. Drug Problem, current? Yes, Frank will “sneak” away to gain internet access and also has some social functioning issues that could use improvement. 47. Severe interference/active psychosis? No, not at this time, although it is mentioned prior to the current year, that Frank had threatened suicide. 48. Mental health treatment, past? Yes, Frank was in sex offender treatment (which includes personal counseling as well) while he was incarcerated. 49. Mental health treatment, present? No, Frank is not enrolled in any treatment program at the time. He has been referred to outpatient sex offender treatment, however is somewhat resistant to it now. 50. Psychological assessment indicated? The defendant would appear to score Yes on this question as he is a sex offender with strong disregard for the victim and is lacking in interpersonal skills. Attitude/Orientation 51. Supportive of crime? Frank stated at one point that he was “railroaded” into taking a plea bargain and alludes “this happens in group homes all over world” yet was being singled out. Scored a 1. 52. Poor, toward sentence? Yes, feels as though the sentence was “way too harsh” and he was wrongly sentenced, victim blaming and poses as the victim at times. 54. Poor, toward supervision? Yes, Frank has had two violations while on Supervised Release. The first was for not reporting his activities to the agent and the second was using the internet at the library without permission.
