Project Attorney Designation - Resolution No. 1066 - July 7, 1975

RESOLUTION NO. 1066

A RESOLUTION SETTING FORTH POLICY AND PROCEDURES FOR DESIGNATION OF PROJECT ATTORNEYS IN THE CITY OF OVERLAND PARK, KANSAS.

WHEREAS, the Finance and Administration Committee of the City Council, at its meeting on the 18th day of June, 1975, recommended to the City Council, a policy and procedure for designating of project attorneys; and

WHEREAS, the Governing Body of the City of Overland Park, Kansas, did on the 7th day of July, 1975, find such policy and procedures acceptable.

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF OVERLAND PARK, KANSAS, as follows:

1. That the Law Department of the City of Overland Park, Kansas, be designated as project attorneys for the City of Overland Park, Kansas, and that charges for these services be assessed against each project as part of the administration and supervision of said projects as authorized by K.S.A. 126a01(d), or any amendments thereto.

2. That in the event the work load of the Law Department or other good and sufficient reasons shall warrant retention of additional project counsel, the City Manager or City Attorney may recommend to the Governing Body the appointment of such counsel, who shall serve and be governed by the provisions of O.P.M.C. 2.69.110, et seq., and any amendments thereto.

3. The City Manager or designated staff shall maintain a roster of qualified attorneys available to perform these services. Names of attorneys will be placed on the roster upon their request, the request of the Governing Body, or when recommended by the Law Department.

Each attorney or firm listed on such roster shall be responsible for maintaining a current resume of qualifications in benefit district work to include the following data:

(a) Name, address and telephone numbers. (b) List of project work experience for Kansas Governmental Units to include names of cities or other governmental units for which the work was performed and the dates of the same. (c) List of current project work being performed and not yet completed to include name of governmental unit, description of project and status of the same.

(d) If roster lists a law firm, the names of the individual attorneys available to perform such services, with experience and length of time with the firm.

4. The Finance and Administration Committee shall recommend to the Governing Body the appointment of such counsel based upon the following:

(a) Specialized experience in benefit district work. (b) Record of the attorney or firm in accomplishing work on other projects in a timely manner. (c) Quality of work previously performed by the attorney or firm for the City.
