Fair Trading (Safety Standard) (Treadmills) Regulations 2009

TOBY HALLIGAN Clerk of the Executive Council 1 Objective The objective of these Regulations is to prescribe a safety standard for treadmills. 2 Authorising provisions These Regulations are made under sections 34 and 165 of the Fair Trading Act 1999. 3 Commencement These Regulations come into operation on 5 August 2009. 4 Definitions

In these Regulations— the Act means the Fair Trading Act 1999;

treadmill means an exercise device that consists of an endless conveyor belt that is either rotated manually or by a motor and on which a person can walk or jog in one place. 5 Compliance with prescribed safety standard (1) On and from 5 August 2009 until 30 November 2009, any treadmill manufactured in Australia or imported into Australia during that period must comply with the prescribed safety standard in regulation 6. (2) On and from 1 December 2009, any treadmill must comply with the prescribed safety standard in regulation 6, regardless of when the treadmill was manufactured or imported. 6 Prescribed safety standard For the purposes of section 33(1) of the Act, the prescribed safety standard for treadmills is the following— (a) a treadmill must display a permanent warning label— (i) that is conspicuous and visible to a user of the treadmill when the treadmill is being used; and (ii) that is separate from any other warning or label on the treadmill; and (iii) on which the following statement appears, in the form prescribed by paragraph (b)—

"WARNING: Keep young children away from this machine at all times. Contact with the moving surface may result in severe friction burns.";

(b) in the statement in paragraph (a)(iii)— (i) the word "WARNING" must appear in bold upper case letters and be at least 5 millimetres in height; and (ii) the remaining words must be in lower case letters and at least 2·5 millimetres in height. ═══════════════
