END USER STATEMENT

In cooperation with the U.S. State Department, Calport Aviation Co. now requires all customers to supply us with End User information for all items sold that have military applications. This is to ensure that the proper licenses that are required for export are obtained in accordance with the U.S. export control laws and regulations if such material requires an export license.

Any item that falls under any of the categories found on the Commerce Controlled List (CCL) of the U.S. Export Administrations Regulations (EAR), or the U.S. Munitions List (USML) of the International Traffic in Arms Regulations (ITAR) is subject to U.S. export control laws. It is the responsibility of the purchaser to determine the correct classification of these items and to obtain the applicable Export License prior to any export.

Furthermore, it is the policy of Calport Aviation Co., to not engage in any sales with any company or individual that is currently on the AECA Debarred List, Denied Persons List, Excluded Parties List, or any other list indicating non-compliance with DDTC laws and regulations.

1) The Buyer understands that the purchase of products from Calport Aviation Co. may be subject to the following U.S. Government regulations: the U.S. Export Administration Regulations (EAR), the International Traffic in Arms Regulations (ITAR), and the policies and mandates of the U.S. Office of Foreign Assets Control (OFAC).

Form CP-100 End User Statement Rev A 06-13-2016 Page 1 of 1 2) The Buyer understands that U.S. law prohibits the Buyer from supplying products in which the sale, transfer, export, re-export or other participation in any export transaction involves individuals, entities, or countries that may be listed by the Bureau of Industry and Security (BIS), the Directorate of Defense Trade Controls (DDTC) or Office of Foreign Assets Control (OFAC).

3) The Buyer will not sell, transfer, export or re-export any products for use in activities, which involve the development, production use or stockpiling of nuclear, chemical or biological weapons or missiles, nor use products in any facilities which engage in activities relating to such weapons.

4) The Buyer, nor any employees, are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered transactions by any Federal department or agency.

5) The Buyer has not been convicted of or had a civil judgment rendered against them for commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State or Local) transaction or contract under a public transaction; violation of Federal or State antitrust statutes or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, or receiving stolen property.

6) The Buyer is not presently indicted for or otherwise criminally charged by a governmental entity (Federal, State or Local) with commission of any of the offenses enumerated in Paragraph 5 above.

I certify that the above information is correct to the best of my knowledge. I also agree to abide by all applicable U.S. export control laws and regulations for any and all material purchased from Calport Aviation Co. and will obtain any licenses required prior to export.
