Section 50-13-1610 of the 1976 Code, as last 23 amended by Act 181 of 1993, is further amended to read: 24 25 “Section 50-13-1610. It shall be unlawful, at any time, to sell, 26 offer for sale, barter, traffic in, or purchase swordfish (Xiphias 27 gladius), as a food item or otherwise, or any game fish so classified 28 under the provisions of Section 50-1-30, except as to fresh-water 29 trout as provided in Sections 50-13-1680 and 50-13-1740, 30 regardless of where caught. Any person violating this section is 31 guilty of a misdemeanor and, upon conviction, shall for the first 32 offense be fined not less than one hundred dollars nor more than 33 three hundred dollars. For the second offense within five years of 34 the date of conviction for the first offense, he shall be fined not 35 less than two hundred dollars nor more than five hundred dollars 36 and be imprisoned for thirty days. For a third offense within five 37 years of the date of conviction for the first offense, he shall be 38 fined not less than five hundred dollars nor more than one 39 thousand dollars and be imprisoned for not more than thirty days. 40 Fourth and subsequent offenses within five years of the date of 41 conviction for the first offense shall be punished as provided for a 42 third offense.”
