CLUBHOUSE RENTAL CONTRACT

IT IS THE RESPONSIBILITY OF THE HOMEOWNER/LESSEE TO KEEP ATTENDANCE WITHIN ALLOWABLE LIMITS, WHICH IS 100. If at any time it is found that the attendance exceeds that allowed, the Homeowner/Lessee will be notified and required to reduce attendance to the maximum allowable with 15 minutes. If compliance is not achieved, the Fire Marshall shall be called. Homeowner/Lessee use will be terminated immediately and WILL RESULT IN FORFEITURE OF FULL DEPOSIT.

Creekside Village HOA agrees to rent the clubhouse facilities to Homeowner ______. Use of the facility is at no cost to the Homeowner/Lessee. A $200.00 security deposit is required to use the facility. Failure to abide by the rules listed below will result in the loss of partial/full refund of the security deposit and/or restriction from future use, both of which will be at the discretion of the Board. The deposit will be refunded to the Lessee when the facility has been inspected and it cleaned to an approved condition and there have been no complaints by neighboring homeowners.

1. The Homeowner/Lessee is responsible for all damages and agrees to reimburse the Homeowner Association for all damages to the premises or properties which are over and above the $200.00 security deposit.

2. The Homeowner/Lessee agrees that the Association is not liable for accidents, lost, stolen or misplaced articles.

3. The facility is to be used for social events only and may not be used for business, civic, religious or commercial purposes of any kind. Money-making or product-selling functions are not permitted at any time.

4. The Homeowner/Lessee/Guests agree to comply with all applicable Federal, State, City and County laws and all applicable Association rules/regulations during the use of the facility.

5. Guest must observe all parking rules.

6. The Homeowner/Lessee must be a resident of Creekside Village and must be in attendance at all times. No person under the age of 21 may rent the clubhouse and there must be at least one adult (person 21 or over) Homeowner/Lessee on the clubhouse premises at all times.

7. Use of the clubhouse DOES NOT include use of the pool, spa, saunas or weight room. These may not be reserved or used by guest using the clubhouse. The inner doors to the restrooms must be locked, outer doors closed, clubhouse doors and windows closed and locked, air conditioning or heating turned off when the function is over.

8. No alcohol/liquor will be served to minors and all Homeowners/Lessees/Guests hold Creekside Village Homeowner Association harmless. The Association accepts no responsibility. No alcohol/liquor is allowed in the restroom areas. 9. No smoking is permitted at any time.

10. The building must not be defaced in any way. Nails or tacks shall not be driven into any surface. Tape shall not be used on any painted surfaces. Only masking tape may be used on any other surfaces. All decorations shall be non-flammable or treated with a flame retardant. Candles may be used for decoration only; no open flames of any kind are allowed.

11. Disorderly conduct or noise which will disturb the neighbors is not permitted at any time. To reduce or eliminate the noise factor, all functions held in the clubhouse must come to an end by 10:00 PM on weekdays and Sundays and 11:00 PM and Fridays and Saturdays or night preceding holidays. Noise must be kept at tolerant levels at all times. The deposit will NOT be refunded if two (2) or more complaints are received from different residents about excessive or after-hour noise.

12. Satisfactory clean-up must be completed by 12:00 noon the following day, or if there is a rental the following day, it must be cleaned up prior to the next party needing the clubhouse. Satisfactory clean-up includes the following: a. Removal of all decorations. b. Removal / Cleaning of all substances / spots from the floor, tables, counters, furniture, refrigerator, sinks, walls and ceilings. Floors must be swept and carpets vacuumed. c. All trash / refuse must be removed from the premises in your containers and taken to your units for subsequent garbage pick up. You may not use any of the on site garbage receptacles. d. Any cost for repairs, equipment replacement, or attendants required for clean-up after your use will be deducted from your security deposit. If the fees due exceed the deposit, you will be billed for the balance.

BY YOUR SIGNATURE, YOU HAVE AGREED TO ABIDE BY THE TERMS AND CONDITIONS SET FORTH HEREIN.

If the facility is being used by a tenant, the Homeowner hereby agrees that all damages and /or costs incurred by the HOA during the use of the facility by the TENANT and/or guests are the responsibility of the HOMEOWNER.
