Dear Customers

Further to our 1st Customer Advisory letter dated 12th July 2010 including general information about European Advanced Manifest Regulation, this 2nd Customer Advisory letter aims to provide you with the most updated information based on correspondence issued by the European Commission (EC) and the World Shipping Council (WSC).

1. What is “ENS”

The European Advanced Manifest Regulation 1875/2006 Import Control System (ICS) will require an Entry Summary Declaration (ENS) to be applied to all inbound shipment discharging into the EU Member States and shipments remaining on board. It is designed by EU Customs as a method of carrying out a risk assessment prior to loading origin base- port.

Consequently, all carriers must electronically submit the required data elements to the EU Customs Office at the vessel’s first EU calling base-port at least 24 hours prior to mother vessel berthing (ETA) at origin base-port.

2. Risk Type

Following receipt of the ENS data from the Carrier, the EU Customs Office at the first entry-port in EU territory will carry out a Security Risk Assessment after-which a ‘Load’ or ‘Do Not Load’ (DNL) authorization will be issued electronically back to the Carrier

3. Main Data Element to be filed

For the Carrier to submit a timely ENS to EU Customs, the Shipper (or their Forwarder) must include within their advanced Shipping Instruction to the Carrier the following information

- Full Name & Full Postal Address of Shipper, Consignee & Notify Party - EORI Number of Consignee, Notify Party & Carrier - B/L Number (Transportation Documentation Number) - Container Number - Voyage Number - Goods Description (General term, for example "general cargo" is not allowed) - 1st 6 digits of the HS Code - Number of Packages - Cargo Gross Weight - Seal Number - UN Dangerous Goods Code

It is imperative that such data elements are meticulously checked for accuracy prior to submission to the Carrier. Alterations issued following submission of the ENS could result in a heightened risk assessment and depending its nature could result in a Do Not Load (DNL). In such cases, any costs associated to subsequent roll-over would be for the account of the Shipper.

4. Effective Date Subject to final approval by the EC, ENS is scheduled to start on 1 st January 2011, which means deep-sea cargo loading overseas on/after 1st January 2011, not cargo arriving EU on/after 1st January 2011. (e.g. all vessels that berth origin base-port after midnight 31st December 2010) No Grace period will be given.

5. Cut Off time for B/L Instruction.

- Shipping Instruction Cut Off Time : 72 hours prior to estimated berthing in export port.

HMM’s Shipping Instruction Cut Off time from Customers is set up to cover the time required for checking, filing and re-filing in the event of encountering problems. Hence, we would like to ask your full cooperation to provide us with accurate cargo information at least 72 hours prior to vessel berthing at loading port, so the carrier can submit a list of legislation-defined data elements to relevant EU customs office without delay.

6. HS Code

The customer is requested to provide the Carrier with a 6 digit HS code on your Shipping Instruction in order for the EU Customs Office to correctly identify the nature of your cargo, thus facilitating the smooth risk assessment process and alleviating the necessity of translation of cargo description into local language for ‘some’ Member States if only 4 digits are supplied. 7. Surcharges & Penalties associated to ENS Filings

The implementation of an ENS filing surcharge for EU bound cargo is currently under consideration and will be informed in due course.

EU Member States, at their own discretion, may announce individual scale of fines associated to inaccurate or late ENS filings. Such information has yet to be published by any of the Member States so any update will be notified if/when known.
