CERTIFICATE OF NEED MODERNIZATION: CORE PRINCIPLES

On October 8, 2014, CHFS requested feedback from all interested stakeholders regarding possible strategies for and changes to the CON program that would further the implementation of specific core principles. The public comments which have been received are posted on OHP’s website: http://chfs.ky.gov/ohp/con/.

1 OHP TO DISCONTINUE MAILING NOTICES FOR FORMAL REVIEW APPLICATIONS AND NONSUB APPLICATIONS UNDER 900 KAR 6:075 PURSUANT TO KRS 216B.095(3)(f)

Effective July 1, 2014, the Office of Health Policy (OHP) will no longer mail notices to affected persons that review has begun for formal review applications or nonsubstantive applications under 900 KAR 6:075 pursuant to KRS 216B.095(3)(f). 902 KAR 6:065, the Certificate of Need application process regulation, requires the Cabinet to give public notice in the next appropriate certificate of need newsletter (available on the CON website) that the review of formal review applications and applications granted nonsubstantive review status under 900 KAR 6:075 pursuant to KRS 216B.095(3)f has begun. As a courtesy, OHP will continue to email the monthly newsletter. Please contact OHP if you wish to be added to the email listing.

OHP TO DISCONTINUE COURTESY REMINDERS TO SUBMIT PROGRESS REPORTS

Effective July 1, 2014, the Office of Health Policy will discontinue its practice of making phone calls or sending emails to CON holders as a reminder of progress report submission deadlines. A one (1) month extension letter will be mailed if a progress report is not received timely. If the CON holder misses the one-month extension deadline, the Office of Health Policy shall mail the initial notice to revoke. It is the CON holder’s responsibility to submit the outstanding report in a timely manner to avoid revocation.

CON Public Notice 12/18/2014 CHART A Formal Review Proposals Scheduled for Decision March 18, 2015 As of this date the Certificate of Need proposals listed below are officially scheduled for review. A decision granting or denying a certificate of need will be made by March 18, 2015. Applications proposing the same or similar types of services, equipment, or facilities affecting the same health service area are batched in the review cycle so that they can be given comparative review. The following projects are included in this batching cycle: F – Intermediate Care Facilities for Individuals with an Intellectual Disability (ICF/ID).

Any affected persons including parties who have submitted a letter of intent for an application which would provide similar types of services, facilities, or equipment affecting the same health service area, who desire a public hearing on a proposal must submit requests in writing to Certificate of Need Office, 275 East

Main Street, 4WE, Frankfort, Kentucky 40621. All requests must be received within 10 days of this notice, or by January 2, 2014. Affected persons will be notified of all scheduled hearings by mail except that the public and third party payors will be notified through public information channels.

AO-36-14 Integrated Medical Solutions To provide treatment to individuals suffering from acute-onset injuries. The services offered by Integrated Medical Solutions, with Medical doctors employed as independent contractors to perform the exception of therapy services, would satisfy the examinations and provide specialist consultations. Diagnostic testing definition of a special clinic for purposes of KRS will be provided. Physical therapists will provide treatment as 216B.020(1) and a CON would not be required. The independent contractors provision of therapy services would constitute the establishment of a rehabilitation agency and a CON would be required pursuant to KRS 216B.061. AO-38-14 University of Cincinnati Medical Center University of Cincinnati Medical Center, LLC to own and operate a new CON is not required as this satisfies the definition of a Neurology Clinic clinic to be named University of Cincinnati Medical Center Neurology Clinic special clinic for purposes of KRS 216B.020(1) to provide evaluations and treatments for a limited population of patients with known or suspected neurological diseases or disorders. 18 AO-39-14 University of Cincinnati Medical Center University of Cincinnati Medical Center, LLC to own and operate a new CON is not required as this satisfies the definition of a Internal Medicine Multi-Specialty Clinic clinic to be named University of Cincinnati Medical Center Internal Medicine special clinic for purposes of KRS 216B.020(1) Multi-Specialty Clinic to provide evaluation and management services in the internal medical subspecialties of Cardiology, Gastroenterology (digestive diseases), Endocrinology, Nephrology, Pulmonology and 12/11/2014 Rheumatology. The various physician subspecialties will provide evaluations, examinations and treatments for their respective patients, each in their dedicated specialty clinic space. The clinic will provide certain minor cardiology outpatient procedures including ECG, ECHO and stress testing but no surgical or other invasive procedures
