PROCEEDINGS OF THE PIERCE COUNTY, NORTH DAKOTA, BOARD OF COUNTY COMMISSIONERS October 4, 2016

The Pierce County Board of County Commissioners met in regular session on October 4, 2016. Chairman Migler called the meeting to order at 8:00 A.M., with members Christenson, Brossart, Johnston and Larson present. Also present was Bryce Berginski, Pierce County Tribune.

Chairman Migler led the Pledge of Allegiance.

Moved by Brossart and seconded by Larson, to accept the September minutes as mailed. Motion carried.

Moved by Christenson and seconded by Johnston, to approve those bills previously paid and those yet unpaid were ordered paid. Motion carried.

Moved by Johnston and seconded by Brossart, to accept the financial report for the month of September. Motion carried.

Board reviewed Officer fee reports and hourly workers time sheets.

Moved by Christenson and seconded by Larson, to approve Treasurer’s checks #5682-5688 in the amount of $1,354.98 for the month of September. Motion carried.

Moved by Johnston and seconded by Brossart, to transfer $100,000.00 from Highway Distribution Fund to Road and Bridge Fund. Motion carried.

Moved by Christenson and seconded by Larson, to transfer $2,310.00 from General Fund to E-9-1-1 Fund. Motion carried.

Moved by Johnston and seconded by Brossart, to transfer $100,000.00 from County Poor Relief to Social Welfare Fund. Motion carried.

Moved by Christenson and seconded by Larson, to transfer $15,000.00 from Wireless Funds to E-9-1-1 Funds. Motion carried.

Moved by Christenson and seconded by Brossart, to appoint Yolanda Schmidt and Donald Jelsing, as delegates to the State Fair Association annual meeting. Meeting will be held on November 17, 2016, at the FFA Hall, State Fair Center, Minot, ND at 1:00 P.M. Motion carried.

Moved by Larson and seconded by Christenson, to transfer $105.70 from General Fund to Sheriff’s Grant. Motion carried.

Moved by Christenson and seconded by Brossart, that payment be made from the 2013 Disaster Fund to Road District #26 (Hillside) $15,788.69; and that payment be made from the 2014 Disaster Fund to Road District #26 (Hillside) $28,864.30. Motion carried.

Board reviewed proposal from North Central Builders for replacing the shingles on the Social Service’s Building. Moved by Johnston and seconded by Larson, to hire North Central Builders, Inc. to replace the shingles. Motion carried.

Mike Brossart and Mike Christenson discussed brieflythe water issues on Curt Halvorson’s land. Darren Heidbreder, Chief of Security, joined the meeting.

Board reviewed correspondence from Tanya Wieler, HR Consultant, concerning the county’s employee manual on 307-2 Sick leave benefits, 502- Work schedules and 507- Overtime. Moved by Larson and seconded by Johnston, to make the changes to 307-2 Sick leave benefits, 502- Work schedules and 507- Overtime, as per Tanya Wieler, HR Consultant. Motion carried. Chairman Migler asked Auditor- Treasurer, Fursather, to get this information to all county employees.

Mike Graner, Jail Administrator, gave the board a report for the month of September, for Josh Sielger, Pierce County Sheriff, for his department. Total calls-56; Medical calls-1; Fire calls-1; Traffic accidents- 2; Assist Other Agencies-9; Prisoner Transports-8; Arrests-13; Citations-7; Papers Served-26; Warrants served-9.

Board recessed to sit on the HACTC Board.

Mike Graner, Jail Administrator, HACTC, went over the bills for the month of September. Moved by Christenson and seconded by Brossart, to approve those bills previously paid and those yet unpaid were ordered paid for the month of September for the HACTC. Motion carried.

Mike gave the board an update on the inmate population for September, which was 116 inmates. Today’s inmate population is 120. There were 108 bookings and 92 released. Personnel- 1 retired; one new hire . There was a profit of $55,598.27 for the month of August. YTD profit $64,431.00. Pierce County had 14 prisoners for the month @cost of $14,000.00. YTD cost for Pierce County is $136,000.00.

Mike Graner explained to the board problems that they are having with their network connection that affects the jail, sheriff, dispatch, BCI, Highway Patrol and City police. They currently have 10 MB circuit. In talking with ITD Department at the State, it would go from 10MB to 50MB. Mike said he didn’t know if the upgrade to 9-1-1 system is causing the problem. ITD at the State doesn’t have anything in between the 10MB-50MB. Mike requested that the board consider going to 50MB for the network. The cost is approximately an additional $400.00 per month. Moved by Christenson and seconded by Larson, to approve the request to go to 50MB to their network. Motion carried.

Moved by Johnston and seconded by Brossart, to approve the financial report for the month of September, for the HACTC. Motion carried.

Board held hearing on minimum sale price for real estate acquired through tax deed action, in accordance with section 57-28-11. No one appeared and no written comments were received. Moved by Christenson and seconded by Brossart, to approve the minimum sale price, as recommended by the Tax Director, and that the terms of the sale on November 15, 2016, be for cash only. Motion carried.

Board reviewed abatement application submitted by Mary Kay Oppen (2016-70) for the following described property: Lot 7 Block 2, Little Flower Addition, located in the City of Rugby. Moved by Larson and seconded by Brossart, to approve the abatement application for tax year 2016 (70), as recommended by the Tax Director, in accordance with homestead credit filed. Motion carried.

Board reviewed members on the LEPC board. Moved by Christenson and seconded by Larson, to approve the LEPC Board members that Kelsey Siegler, DES Coordinator, recommended. Motion carried.

Auditor-Treasurer, Fursather, went over the 2017 preliminary budget. No one appeared for the budget hearing that was held at 10:00 AM. Moved by Johnston and seconded by Christenson, to approve the preliminary budget as the final budget, in the amount of $9,821,666.93 beginning January 1, 2017 and ending December 31, 2017. Motion carried.

A conference call was held at 10:30 A.M., with Mark Austin, Minot Housing Authority. Mike went over the HUD Fair Market Rents and Pay Standards for the Pierce/McHenry Housing Authority. Moved by Migler and seconded by Brossart, to adopt resolution #127, for the Fair Market Rents and Pay Standards for Pierce/McHenry Housing Authority. Motion carried.

Jessica Tagestad, Wold Engineering, met and gave the board an update on the road projects. Jessica went over change order #1 for road projects CNOB-3521(060); CNOC-3526-(055) and CNOC-3548(056), that would save the county approximately $38,000 on the overlay. Moved by Larson and seconded by Johnston, to approve change order #1 on the overlay project. Motion carried.

As the hour of 11:00 A.M. was past, the chairman called for the opening of the #2 fuel oil, propane and gasoline bids. The following bid was received from Envision- with two options- Option 1- Fixed priced contract of $1.77 per gallon from October 5, 2016 thru April 30, 2017 or Option #2 fuel oil-priced based on the cost of the day the fuel is delivered plus $.04. Propane- $.94 per gallon; Gasoline-cost will be a net reduction from pump price, less $.03 per gallon. Board accepted the bid from Envision.

Allan Meckle, Community Service Coordinator, met and gave the board an update on the community service program. Allan gave the board a handout of the worksites and the number of hours worked at the sites from January 1, 2016 thru September 30, 2016. Total hours worked for the following counties- Pierce- 1,915.6; McHenry- 777.25; Bottineau- 939.25 and Rolette- 235.

Galen J Mack, States Attorney, joined the meeting.

Christenson left the meeting.

Galen shared with the board cuts that have been done by the State. The State has cut the Judicial Referee position, secretary position, and they are possibility going to cut the Juvenile Probation Officer. He asked the board to consider writing a letter to the Court Administrator, asking them to keep the Juvenile Probation Officer that is located in Bottineau County.

There being no further business, Migler adjourned the meeting at 11:35 A.M.

The Pierce County Board of County Commissioners met in special session on October 18, 2016. Chairman Migler called the meeting to order at 9:15 A.M., with members Christenson, Brossart, Johnston and Larson present. Also present was Bryce Berginski, Pierce County Tribune.

Kari Hunt, Representative with Blue Cross Blue Shield, explained different tier options of insurance plans through Blue Cross Blue Shield. She explained the grandfathered versus non-grandfathered plans and costs. Kari said they also offer dental and vision and you don’t have to be on Blue Cross Blue Shield health insurance policy.

Fursather, Auditor-Treasurer, explained that a bill was paid in September for graveling that was done on the line between Walsh/Christenson Township, without the commissioner’s approval. Moved by Christenson and seconded by Brossart, to transfer $5,537.26 from Walsh Township to Christenson Township. Motion carried.

Chairman Migler informed that rest of the board that the blade operators will go to 40 hours a week, which started on October 17th.

There being no further business, Migler adjourned the meeting at 10:00 A.M.
