Dear Miles,

Planning Permission No. LW/462/CM(EIA) Construction and operation of an Energy Recovery Facility together with ancillary infrastructure including waste transfer station, administration/visitor centre, landscaping and highway works. Land at northern end of North Quay Road, Newhaven - Minor Amendment

I refer to an email from Paul Mabbett of vonRoll Inova, received on 26th May seeking an extension of the working hours to continue to try and recover lost time on this project and to enable separate work activities to be undertaken as much as possible with enhanced Health and Safety arrangements.

I note that it is now wished to work on the afternoon of Saturday 29th May in addition to the times agreed in my letter of 25th May.

I can confirm that under the powers delegated to me, I agree to the extension of working hours on this day between 13.00 and 17.00 hours on the Saturday and 08.00 hours until 17.00 hours on the Sunday. The additional construction times are agreed pursuant to the provisions within condition 29 to the above planning permission.

In approving these additional hours, I understand that all best practicable means are to be taken to reduce noise and in any case noise levels will not exceed the level set out in part (b) to condition 30.

Please note that if at any time the activities being carried out in these extended hours give rise to justifiable complaint, or harm to amenity, I reserve the right to withdraw this temporary amendment to the permitted working hours. Please note that if at any time you receive any complaints, please notify Peter Earl on Lewes (01273) 482650 within two working days of receiving the complaint.

In considering any future requests I will need to have regard to the potential that residents in proximity to the site will increasingly be outside and wishing to leave windows open at this warmer time of the year.
