CALL TO ORDER

Mr. von Reider called the meeting to order at 4:35 p.m.

REVIEW OF MINUTES

The Board reviewed the minutes of the April 18, 2006, meeting. Ms. Hughes made a motion, seconded by Ms. Young to approve the minutes. The motion was unanimously carried.

UNFINISHED BUSINESS

Update of Application for Occupational Therapist – Terrie Roney

The application of Terrie A. Roney for an occupational therapist license was reviewed. It was found that the applicant had been convicted of a crime in Pennsylvania that was substantially similar to a crime that the Board had previously determined to be substantially related to the practice of occupational therapy, as set forth in the Board’s rules and regulations. Ms. Adams explained that the Statute did not grant the Board discretion to grant a license where the applicant has committed a crime that the Board has found to be substantially related to OT practice. Ms. Adams explained the procedure to be followed when proposing to deny an application, including the issuance of a proposal-to-deny letter the ramifications of this letter and motion. Ms. Hughes made a motion, seconded by Ms. Young to propose-to-deny the application based on the applicant’s criminal history. The motion was unanimously carried.

Update on Department of Health and Social Services Statute: 16 Delaware Code, Section 122(3)o, 4406 Home Health Agencies Licensure

Ms. Rochester informed the Board that she had contacted the Department of Heath and Social Services to discuss details of Statute; 16 Delaware Code, §122(3)o, 4406 Home Health Agencies Licensure. She was advised that there has been a lot of public comment on the changes, and that they had been tabled indefinitely. She advised Ms. Hughes that she could contact Mary Peterson if she wished to add her comments. Ms. Rochester had provided this contact information to Ms. Hughes prior to this meeting. Ms. Adams stated that she would provide advice in connection with a letter expressing the Board’s concerns with this legislative change. Ms. Young stated that she would contact the president of the Delaware Occupational Therapy Association to ensure that she is aware of the proposed changes as well. It was requested by the Board to keep this issue on the agenda to discuss at the next meeting.

NEW BUSINESS

Review of Occupational Therapist/Occupational Therapy Assistant Applications

Mr. von Reider made a motion, seconded by Ms. Mirro to approve applications for the following persons:

 Amy K. Lynch - Occupational Therapist  Donna L. Queen – Occupational Therapy Assistant  Mary Patricia Wiegand – Occupational Therapist Board of Occupational Therapy Practice Minutes – February 8, 2006 Page 3

 Thomas Mitchell – Occupational Therapy Assistant  Debra Jakob – Occupational Therapy Assistant

The motion was unanimously carried.

Ms. Hughes made a motion, seconded by Ms. Mirro to approve the following application pending receipt of NBCOT Certification and verification from the state of Massachusetts:

 Annette Mestern – Occupational Therapist

The motion was unanimously carried.

Review of Continuing Education Activities

Ms. Mirro made a motion, seconded by Ms. Young to approve the following courses:

 MED2000, Inc., Pilates & Other Movement & Exercise Therapies – 6 hours  Therapeutic Service Systems, Treatment of Orthopedic Shoulder – 12 hours  Austill’s Rehabilitation Services, Inc., Ready, Set, Write! – 4.25 hours  Kerri Carpenter, Management of Spasticity Associated with Cerebral Palsy Using Neurotoxins – 2 hours  Institute for Natural Resources, Aging Brain – 6 hours  Peninsula Regional Medical Center and Ability Rehab Associates, Rehabilitation Treatment Advances for Patients with Neurological Impairments – 4 hours

The motion was unanimously carried.

Review of Continuing Education for Audit Licensees

The Board reviewed the continuing education for audit licensees. The audits for the following occupational therapists were approved:

The audits for the following Occupational Therapy Assistants were approved:

The audit for Gina Johnson was not approved pending clarification of Continuing Education category.

Ms. Hughes made a motion, seconded by Ms. Young to approve the audits with the one exception. The motion was unanimously carried.

Voluntary Treatment Option (VTO) Program Presentation by Deputy Director Kay Warren

Kay Warren, Deputy Director with the Division of Professional Regulation presented the Voluntary Treatment Option (VTO) program to the Board. This program provides an opportunity for regulated professionals to confidentially access professional help for their chemical dependency (alcohol or drugs) or impairment. The Board designated Mr. von Reider as the Board's VTO representative to help in the administration of this program. Program forms and information is available at www.dpr.delaware.gov.

The 12 th Annual NBCOT National Conference – September 30, 2006

The 12th annual NBCOT National Conference will be held on September 30, 2006.

Other Business Before the Board (for discussion only)

There was no other business brought before the Board.

Public Comment

A licensee made a comment concerning the continuing education audit deadline of May 31, 2006. The concern was that the licensee may still have a course or meeting to attend after that date. Ms. Hughes explained that this was done in an effort to provide the licensee with ample time to take an approved course. She also stressed that the licensee should not wait too long to take a class that may not be approved and thus wasting the licensee’s time and money. The other public members in attendance understood and agreed with the explanation that was given.

Another licensee addressed the board. She stated that the licensing requirements that are posted in the rules and regulations are not clear. The Board answered her questions and she appeared to accept the Board’s explanation, but still felt that there should be better clarification of the requirements for licensure and continuing education.

The next meeting will be held on June 28, 2006 at 4:30 p.m. in Conference Room B, second floor of the Cannon Building, 861 Silver Lake Boulevard, Dover, Delaware.
