(1) Unlimited Rights- Boeing and/or Boeing subcontractors retain ownership. However, Boeing and/or the applicable Subcontractor grants or shall obtain for the Commonwealth the license rights in IP to use, modify, develop, reproduce, perform, display, release, or disclose in whole or in part, for Defence Purposes, and to have or authorise others to do so. However, no third party shall obtain the right from the Commonwealth to further sublicense or commercialise the IP for any purpose other than Defence Purposes.

(2) Limited Rights – Boeing and/or Boeing subcontractors retain ownership. However, the Commonwealth is provided the rights to use, reproduce, release, perform, modify, develop, display and disclose the IP in whole or in part and to have or authorise a person on behalf of the Commonwealth to exercise the IP, in order to exercise the rights granted to the Commonwealth under clause 5 of the Contract. However, the Commonwealth may not, without the written permission of the Contractor and/or applicable Subcontractor, release or disclose the IP other than in accordance with clause 5 of the Contract (C439097).
