APPLICATION INSTRUCTIONS FOR STUDY ABROAD PROGRAM

Please make sure to read these instructions thoroughly, and keep a photocopy of your entire application packet for your personal records.

SECTION I 1. Applications are not considered complete unless all parts are filled in and submitted by May 1, 2015. 2. If you are accepted for the FIU COL Study Abroad Program, the College of Law will register all students going abroad. You should NOT register for on-campus courses during your term abroad. 3. You are responsible for clearing any and all holds - cashier, financial aid or departmental – in order to be registered for your courses abroad. 4. Financial Aid is available for FIU participants. Non FIU students should meet with your Law School’s Financial Aid Office. 5. All accepted students must attend a pre-departure meeting with the FIU COL, as well as any program specific pre-departure meetings scheduled by the Program Director. Students not in Miami will do a pre-departure via telephone.

SECTION III

PAYMENT SCHEDULE SUMMER STUDY ABROAD PROGRAM IN SEVILLA

The tuition, insurance fee and Registration fee for the Summer Study Abroad Program in Sevilla will be a total of $4,500. This price does not include housing, meals and other expenses. See estimated cost below. The program cost of $4,500 will be collected by the College of Law following the payment schedule detailed below.

You must apply to the program and pay a $400 Registration Fee (non-refundable under any circumstances) by May 1, 2015. Your space in the program will not be reserved until the Registration Fee is received by FIU. You must make final payment of $4,500 by the payment deadline of May 1, 2015. Payments made late will result in a $200 late fee. If you are on Financial Aid, please let us know. If you are on Financial Aid, the tuition will be paid by Financial Aid.

The Registration Fee may be paid using personal check, cashiers check or money order in U.S. dollars. Tuition payment must be paid online using the Panthersoft system. If you are on Financial Aid, this payment will be automatic when your money is disbursed.

We only accept credit cards for housing payment if you decide to live in the dorms. (See attached sheet for payment of Residencias Santa Ana.)

1. Free Application for Federal Student Aid (FAFSA) must be mailed to the Federal processor at least four months prior to the departure date.

2. Financial Aid file must be completed (all documents required for processing of financial aid must be in the Financial Aid Office) at least three months prior to the departure date. It is strongly recommended that the student meet with a Financial Aid Advisor to discuss the resources available to the student.

4. The loan acceptance form must be returned to the Financial Aid office at least six weeks prior to the departure date.

SECTION VI REFUND POLICY AND COURSE REGISTRATION

This program consists of payments to FIU COLLEGE OF LAW for a Registration Fee and payment of tuition.

College of Law – Registration Fee The program Registration Fee is not refundable except as indicated under “Cancellation Policy” below. Other requests for refunds must be made in writing and dated. Verbal, e-mail and fax requests will not be accepted. Students canceling or withdrawing after May 1, 2015 are liable for all expenses. Students on financial aid must adhere to all refund policies and deadlines as stated by the FIU Financial Aid Office. No refund will be given if a student is dismissed for misconduct.

FIU will not refund airfare or other costs incurred as a result of program changes or cancellations.

Withdrawal date Refund Amount The $400 Registration Fee due at time of application is non refundable except as indicated under “Cancellation Policy” below. Payments made prior to May 1, 2015 are refundable less the $400 non refundable Registration Fee. After May 1, 2015 no refunds can be made.

Once the program has begun, there will be no refund made for any portion of the program that the participant declines, or for any unused services following withdrawal from the program.

Cancellation Policy

Florida International University College of Law reserves the right to cancel this program at any time or make changes, modifications or substitutions to the program in case of changes at the host site location or in the interest of the program and its participants. If FIU cancels this program after the $400.00 Registration Fee has been paid, this deposit will be returned to each student and every effort will be made to make arrangements for each student enrolled to attend a similar program, if the student so desires. Tuition and Registration Fees advanced by the student shall be refunded within twenty (20) days after the date of cancellation.

If changes are made in the course offerings or other significant aspects of the program, these changes will be communicated promptly to any applicant who has paid a deposit or registered for the program, and an opportunity will be provided for that person to obtain a full refund of all monies paid if student chooses to cancel.

If a State Department Travel Warning is issued prior to commencement of this program, students will be given the opportunity to withdraw with a full refund of all fees paid. Every effort will be made to make arrangements for each student enrolled to attend a similar program, if the student so desires.

If a State Department Travel Warning is issued while the program is running and FIU cancels the program, students will be refunded the Registration Fee and Tuition within twenty (20) days after the date of cancellation.

FIU COL is not responsible for expenses related to room and board, personal expenses and airfare.

Course Selection This program is open to all students from A.B.A. accredited law schools. Students are required to attend both courses offered. Registration will be done at the FIU College of Law Registrar’s Office. The courses are as follows:

LAW 6253 COMPARATIVE CRIMINAL LAW (3 credits)

Taught by Professor Kotey of FIU Law.

This course entails a comparative analysis of important issues of substantive criminal law and criminal procedure against the background of various legal systems. The analysis focuses on American and continental European law and practice. Topics include structure and dynamics of criminal trials, prosecutorial and police discretion, lay participation in the administration of criminal justice, and a comparative analysis of crucial doctrines of substantive criminal law.

LAW 6831 COMPARATIVE PROPERTY LAW (3 credits)

Taught by Professor Rodriguez-Dod of FIU Law.

This course offers the students an opportunity to study a comparative analysis of a wide array of property law issues. Topics may include issues related to topics such as rights in personal property, present and future interests, marital property, real estate transactions and financing, landlord/tenant law, and takings. These concepts may be examined in either a commercial or residential context. Students interested in property law generally and in transnational property transactions would benefit from an understanding of the differing property law systems.

STUDY ABROAD INSURANCE INFORMATION

FIU requires all students who participate in an FIU approved study abroad program to have international health and accident insurance with a specified minimum coverage for the entire length of the program abroad. Students who are participating in a FIU sponsored or FIU approved study abroad program will be enrolled in a Study Abroad Insurance Plan that meets FIU’s requirement. Each student will be enrolled according to the length of their program.

You will be automatically enrolled in the Study Abroad Insurance Plan. The cost of the insurance premium will be covered by the Registration Fee.

I, the undersigned, ______, being of legal age, do hereby agree and promise the following for and in consideration of my application for participation and acceptance in a Study Abroad Program (“Program”) offered by Florida International University (FIU).

1. I shall be bound by and comply with the terms, conditions, and obligations of the Program, including those relating to fee payment, late application, and refund policies. My failure to comply with the terms of the Program or to conduct myself in a fitting manner may result in my involuntary withdrawal from the Program by either FIU or my host institution.

2. My participation in the Program is voluntary and is not a requirement of my curriculum at FIU. I have chosen to participate in the Program because of the learning and cultural experiences I will gain through study in a foreign country. I acknowledge that I am neither an agent nor representative of FIU and may not look to the University or the State of Florida for reimbursement of expenses. I accept full responsibility for all costs and expenses associated with my participation in the Program.

3. I acknowledge that, in the course of my participation in the Program and related activities, I may be exposed to risks inherent in travel to a foreign country, some of which are known and some of which are unknown, which may result in property damage or loss, as well as personal or bodily injury which could be painful, permanently disfiguring or debilitating and even fatal. I voluntarily assume all risks, including, but not limited to, sickness, bad weather, hurricanes, strikes, war or military actions, quarantine, detention, delay, vandalism, muggings, kidnappings, earthquakes, tsunamis, and/or acts of terrorism. I further expressly assume full responsibility for any risk of bodily injury, death, or property damage due to the negligence of the State of Florida, the Florida Board of Trustees, the Florida University Board of Trustees or FIU, and their respective employees and agents, or otherwise.

4. I agree and acknowledge that I will have time for, and may engage in personal activities unrelated to the purpose of the Program while I am abroad. Such activities will be at my sole responsibility and risk.

5. I acknowledge that FIU, the FIU Board of Trustees, the Florida Board of Trustees and the State of Florida and their respective officers, employees, and agents are not responsible for losses or expenses suffered by me due to delays, changes in itinerary, changes in the content of Program study, or other matters which are beyond their control.

6. I, for myself, my heirs, executors, administrators and assigns release, waive, discharge and relinquish, and agree to hold harmless the State of Florida, the Florida Board of Trustees, the FIU Board of Trustees, and FIU, and their respective officers, employees and agents, from and against all claims and causes of action for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise from my participation in the Program and its related activities, whether the same should arise by reason of the negligence of anyone participating in the Program or its related activities, or otherwise. I specifically understand that I am releasing, discharging, and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by FIU. I agree that, under no circumstances will I, or anyone claiming through me, prosecute or present any claims for personal or bodily injury, property damage or loss, or wrongful death against the State of Florida, the Florida Board of Trustees, the FIU Board of Trustees, or FIU, or their respective officers, employees, and agents.

7. I, for myself and any others claiming through me, accept full responsibility for my safety and expenses and assume the complete risk of any injury to myself or my property which may arise out of or in the course of my participation in this study abroad program.

8. I further expressly agree that this Overseas Student Participation Agreement Release & Assumption of Risk is intended to be as broad and as inclusive as the laws of the State of Florida will allow, and that if any portion thereof is held to be invalid, it is agreed that the balance shall, notwithstanding the invalid portion, will continue in full legal force and effect.

Santa Ana Residencias

This is typical Spanish dorm room (very basic) housing with three meals a day/air conditioning and cleaning of common areas. Rates are from May 24 to July 2, 2015. Prices include breakfast, lunch and dinner (DIETARY NEEDS CAN BE MET). Additionally, they will pack a meal and you can take it with you. Dinner is not provided on Sundays and holidays. Rooms for two people (double) or Rooms for one person (single). Price includes weekly cleaning, laundry room for self service, linens and towels and free internet, air conditioning in rooms and 24 hour guard. Please visit: www.sta-ana.com From Santa Ana, you would walk for 5 minutes to Plaza Nueva and take the trolley which stops in front of the law school. It is a five minute walk to all interesting points in Seville and Spanish university students will be living there.
