Lafferty Doctor of Philosophy Department of History University of Toronto 2010 Abstract This is a study of a Roman legal document of unknown date and debated origin conventionally known as the Edictum Theoderici (ET). Comprised of 154 edicta, or provisions, in addition to a prologue and epilogue, the ET is a significant but largely overlooked document for understanding the institutions of Roman law, legal administration and society in the West from the fourth to early sixth century. The purpose is to situate the text within its proper historical and legal context, to understand better the processes involved in the creation of new law in the post-Roman world, as well as to appreciate how the various social, political and cultural changes associated with the end of the classical world and the beginning of the Middle Ages manifested themselves in the domain of Roman law. It is argued here that the ET was produced by a group of unknown Roman jurisprudents working under the instructions of the Ostrogothic king Theoderic the Great (493-526), and was intended as a guide for settling disputes between the Roman and Ostrogothic inhabitants of Italy. A study of its contents in relation to earlier Roman law and legal custom preserved in imperial decrees and juristic commentaries offers a revealing glimpse into how, and to what extent, Roman law survived and evolved in Italy following the decline and eventual collapse of imperial authority in the region. -

“Do you not know that your body is a temple of the Holy Spirit within you, whom you have from God, and that you are not your own?” 1 Corinthians 6:19 Saint Gabriel Archangel (patron saint of communication workers) Feast day: September 29, The name Gabriel means "man of God," or "God has shown himself mighty." It appears first in the prophesies of Daniel in the Old Testament. The angel announced to Daniel the prophecy of the seventy weeks. His name also occurs in the apocryphal book of Henoch. He was the angel who appeared to Zachariah to announce the birth of St. John the Baptizer. Finally, he announced to Mary that she would bear a Son Who would be conceived of the Holy Spirit, Son of the Most High, and Saviour of the world. The feast day is September 29th. St. Gabriel is the patron of communications workers. St. Isidore of Seville (patron saint of computer technicians, internet) Feast day: April 4 Isidore was probably born in Cartagena, Spain to Severianus and Theodora. His father belonged to a Hispano-Roman family of high social rank while his mother was of Visigothic origin and apparently, was distantly related to Visigothic royalty. His parents were members of an influential family who were instrumental in the political-religious maneuvering that converted the Visigothic kings from Arianism to Catholicism. The Catholic Church celebrates him and all his siblings as known saints: An elder brother, Saint Leander of Seville, immediately preceded Saint Isidore as Archbishop of Seville and, while in office, opposed king Liuvigild. -

Thornton September 2017 Germanic law codes, which are also known as leges barbarorum, date to between the 5th and 11th centuries. The leges were highly influenced by external legislative regulations and can be basically defined as a combination of Roman law, Germanic tribal laws and canon law. This thesis attempts to examine punishment for aggression and violent crimes in the early Germanic law codes. Violent crimes against another person such as murder, homicide, bodily harm, injury, abduction and rape in the leges barbarorum are analysed in a historical context and punishments for such felonies are investigated in a detailed manner. Specifically, certain issues became apparent due to various social, ethnic and sexual backgrounds of the barbarian people who were subjected to the leges barbarorum. Such matters are discussed in detail by going through each and every article that deals with the punishments for violent crimes. The other purpose of the thesis is to perceive the transformation and adaptation of the Germanic peoples to the new legal systems and to conceive the legal transition process of these newly established political entities using violent crimes base. -
New Directions in the Study of Visigothic Spain
History Compass 14/1 (2016): 29–38, 10.1111/hic3.12294 New Directions in the Study of Visigothic Spain Jamie Wood1* and Javier Martínez Jiménez2 1University of Lincoln 2Oxford Archaeology LTD Abstract Since the fall of the Visigothic kingdom in 711, analysis of its history has been tied to contemporary Spanish politics. Political and economic developments in Spain since the 1970s have driven research into the late antique and early medieval period. Most notably, archaeological evidence has come to play a much more prominent role in analyses of the Visigothic period in Spain. This article synthesises archaeological and historical research from the past 20 years. It draws on recent developments in urban and rural archaeology in order to examine key avenues of research on the period: the negotiated nature of power, post-Roman identity politics, and law and literacy. In recent decades, there has been a burgeoning interest in the study of late antique and early medieval Spanish history. A number of factors have contributed to this development: the col- lapse of the Franco regime and its teleological and single-purpose historiographical discourse, a higher degree of collaboration between Spanish and non-Spanish scholars, which has broken the ‘language barrier’ that in the past hindered interactions between Spanish academia and other scholarly traditions1 and the large amount of material obtained from the boom in commercial archaeology in the 1990s and early 2000s. The main objective of this article is to sketch briefly some of the current themes in Visigothic studies, from historical and archaeological perspectives, citing many of the main scholars, publications and research projects of the past 20years (since 1995). -
Decalvatio in Isidore of Seville and in the Lex Visigothorum
The Judicial Punishment of Decalvatio in Visigothic Spain: a Proposed Solution based on Isidore of Seville and the Lex Visigothorum Jace Crouchi Abstract The Visigothic judicial punishment known as decalvation has been widely studied for more than a century, yet there exists no general agreement concerning its exact nature. Scholars concur that decalvation involved a shameful mutilation of the head and hair, but there is disagreement about whether the punishment involved scalping or merely shaving one‟s head. Some well-known texts seem to suggest scalping, but several little-known passages from Isidore of Seville and the Lex Visigothorum clearly indicate that enduring decalvation did not preclude one‟s hair from growing back, and that decalvation could be inflicted on a malefactor more than once. Additionally, a thirteenth century Castilian translation of the Lex Visigothorum renders decalvation as ráyanle la cabeza, shaving the head. These and other medieval texts support my contention that in the Visigothic kingdom decalvation normally involved shaving the head, or perhaps shearing the hair very closely, but that it did not normally involve scalping.
